HomeMy WebLinkAbout1959-07-08 9[1 Bozeman, Montana July 8, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City ~all Building, Wednesday, July 8, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded I. by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Claims for the Month Claims Nos. 5101 to 5401 inclusive were presented on the various funds as follows: General $17,095.69 Water 12,093.53 Library 1,908.02 Cemetery 2,911.03 Garbage 4,903.52 Police Reserve 528.80 P. E. R. S. 776.51 Street 9,068.68 ... S. D. S. 4,765.03 Park 6,543.55 Band 71.40 Parking Meter 1,052.87 Cemetery Suspense 30.00 Cemetery Per. Care 50.00 Tot a 1 - - $61,798.63 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. Aft~r examina- I tion of the claims in detail by the Commissioners and checking against the Claim Register, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants drawn for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Proposed Schedule for the Valuation of City Mobile Units A proposed schedule for valuation of City mobile units for the purpose of fire and theft cov,erage was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the schedule be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Reports The following reports for the month of June, 1959 were presented: Librarian Police Judge Sewage Plant Operator Sanitary Inspector Fire Chief Chief of Police Inspector (May & June) Cashier It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being I: Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. City Officials Authorized to Travel .... Request has been received for authorization for city officials or employees to travel as follows: For Fire Chief Penttila to attend the Pacific Coast Inter-Mountain Association of Fire Chiefs at Spokane, Washington, July 13, 1959. For two firemen to attend the State Convention of Firemen at Helena, July 16th to 18th, 1959, the expenses of one of these firemen to be paid by the Firemen's - Relief Ass'n and the expenses of the other one to be paid by the City. 0) . ",. None of the above requested travel or absence will necessitate hiring replace- ments for the men involved. 'It was moved by Commissioner Swanson, seconded by Commissioner Berg, tha.t the requested travel be as requested ~authorized and that their a.ctual travel and convention expenses/~e paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner I Swanson and Commissioner Berg; those voting No, none. Bonds of Brown's Plumbing and Heating Bonds of Brown's Plumbing and Heating, Townsend, Montana, to operate as gas fitters and master electricians in Bozeman, were presented. These bonds being approved as to form by the City Attorney, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the bonds be accepted and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. .... Special Request for Building Permit - Charles Vanderzee Charles Vanderzee is the owner of the West 58 ft. of Lots 1, 2 and 3, Block 44, Park Addition of the City of Bozeman. Before he purchased this property and several times subsequentj,thereto, Mr. Vanderzee has checked with City officials to be sure that he could build a residence on this property which would meet all building and zoning requirements of this City. Emergency Ordinance No. 813, passed on June 24, 1959, amending the Zoning Ordinances, placing further restrictions in the zone where this property is located, would make it impossible for a residence to be constructed thereon. In view of the fact that to refuse a permit to build a residence which would meet the requirements of the exist- ing ordinances prior to the passage of Ordinance No. 813 would impose unwarranted hardship and cause I undue finanolal loss to the owner, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that, upon submission of an application in proper form for permit to build a residence on this property which would meet all requirements of ordinances existing prior to June 24, 1959, the Building Inspector be, and is hereby, authorized to grant such a permit and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Agreement relative to Waters of Rocky, Bridger and Bozeman Creeks A proposed agreement between Malcolm C. Story and wife, the Montana Flour Mills Company of Great Falls, Montana and the City of Bozeman, relating to water and ditch rights from Bozeman Creek, Rocky and Bridger Creek was presented. Under the terms of the agreement, Malcolm C. Story relinquished all right, title and interest in any of the waters and stream channels or ditches used for conveying water from Bozeman Creek which had previously been owned by the Montana Flour Mills Company. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the agreement be accepted and approved and that the Mayor and Clerk be authorized to sign it for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; . those voting No, none. -I Adjournment There being no further business to come before the Commission at this time, it was moved by ~, Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. ~~tf)~ ~~ Mayor ATTEST: .- ... ~ (t/(/I~rh'~ Clerk of he City Commission
