July 22, 1959
The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, July 22, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, City Manager Henderson and the Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded
I by commissioner Berg, that the minutes be approved as read and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergj
those voting No, none.
Adjourned Hearing Resolution No. 953 - Intention to Create S. 1. D. No. 413
Hearing on Resolution No. 953, which was adjourned to this time from the meeting of the City
Commission on July 15th, was resumed. Again twenty or more owners of properties in the proposed district
were present as protesters. No new information was furnished to change percentage of property represented
by protest but, in view of statements made by protesters and with the particular view of giving full
consideration to hardship cases and to every qualified protest, it was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the hearing on this resolution be further adjourned until the next
regular meeting of the City Commission at 1:00 P. M. on July 29, 1959 and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Proposal to Vacate Streets and Alleys in Central, Prospect Hill, Highland and Valley View Additions
to the City of Bozeman
Proposed Resolution No. 956, which was presented to the Commission at the last regular meeting,
I was again considered. C. V. Henderson, representing the Deaconess Hospital Board, submitted a new
proposal under which all streets in these four additions except those on which there is abutting
property not owned by the Deaconess Hospital Board will be vacated. It was moved by Commissioner
Swanson, seconded by Commissioner Berg, that the City Attorney be instructed to rewrite proposed
Resolution No. 956 in accordance with these recommendations and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergj those
voting No, none.
Ordinance l~o. 814 - 1959-60 Salary Ordinance
Ordinance No. 814, the annual salary ordinance, covering salaries of heads of departments and of
employees who are direct appointees of the Commission, was presented entitled:
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, FIXING THE MONTHLY SALARY AND OFFICIAL BOND
OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS, AND OTHER EMPLOYEES OF THE CITY COMMISSION
AS REQUIRED BY LA'ov.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the ordinance be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Ordinance No. 815 - Annual Appropriation Ordinance - Provisional Passage
I The City Manager reviewed the proposed budget for the fiscal year ending J1me 30, 1960 and presented
Ordinance No. 815, entitled:
AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED ~~CESSARY AND IN ACCORDANCE WITH
BUOOETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF
BOZBl1AN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th, 1960.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that this ordinance be pro-

visionally adopted and that July 29, 1959 be set as the date for public hearing on it and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Bergj those voting No, none.

Reports
The following reports for the month of June, 1959 were presented:
Cemetery Director of Finance
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I
Proposed PIaL - Spring Dell Addition
R. J. Rickabaugh presented a proposed plat of Spring Dell Addition which adjoins the City adjacent
to Langohr's and Dudley's Additions. This plat was given tentative approval at the April 2, 1959 meet-
ing with certain conditions and additional conditions were recorded at the meeting of the City
Commission on May 6, 1959. Action on the plat now presented by Mr. Rickabaugh was deferred until the
conditions set forth at the above referenced meetings are complied with in full.
nequisition from S. H. DeBoer & Company
Requisition from S. R. DeBoer & Company as basis for them to secure partial payment on the
contract between their company, the City of Bozeman and the Montana State Planning Board in the amount
of $1,753.52, being partial payment due DeBoer & Company for services rendered for the period November
1, 1959 through June 1, 1959, was presented. The City Manager stated that he has checked this account
and that the amount claimed, which is to be paid by the Montana State Planning Board, is correct. It
was moved by Commissioner Swanson, seconded by Commissioner Berg, that the requisition be approved and
that the Mayor and Clerk be authorized to sign the same for the City of Bozeman and the motion was carried
by the folloY-ling Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none. I
Proposed Lease - Parking Lot
A letter was presented from Security Building, Inc. proposing to rent Lots 29, 30, 31 and 32 and
the East 3.5 ft. of Lot 33, Block "C", Original Townsite of Bozeman, Montana to the City of Bozeman
for a public parking lot. This ground is approximately the East 1/2 of ground previously rented by
the City from the Eagles Lodge and Security Building, Inc. at the corner of Babcock Street and Bozeman
Avenue. The proposal was to rent this ground to the City for a three year term at a rental of $75.00
per month. It was Illoved by Commissioner Swanson, seconded by Commissioner Berg, that, in view of
extra expenses that the City must stand in re-arranging this lot, the City Manager be instructed to
present a counter proposal to Security Building, Inc. to rent thislground in accordance with their
proposal but at a rental of $60.00 per month and the motion was carried by the following Aye and No
vot e : those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
License - Hiniature Train to Operate on Streets
The Bozeman Junior Chamber of Commerce has made inquiry regarding license for Western Amusement
Company, Idaho Falls, Idaho, to operate a motorized sight-seeing train on the streets of Bozeman during
the Annual Jaycee Rodeo. I
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that license for this opera-
tion be set at $10.00 per day and be subject to the operators complying with all traffic regulations
or other laws of the City of Bozeman and the motion was carried by the following A:ye and No vote:
those voting Aye being :Hayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
S;vimming Pool
The City Manager reported on progress being made to re-open the swimming pool following the fire
at that installation on July 14, 1959. He stated that every effort is being made to get the pool into
operation as an unheated pool but complete renovation or replacement of the building and equipment lO:l
cannot be made in time for use in the 1959 swimming season.
Streets - Policy as to Construction and Maintenance
Question has arisen regarding responsibility of the City to put an irrigation ditch underground
where it crosses a street in Royal Vista Addition. It was pointed out that the City's Street Fund
is for the operation and maintenance of streets and not for their construction. The Commissioners
I stated that they do not consider it to be the responsibility of the City to provide culverts or
similar structures for new streets and that the responsibility of the City as to streets or alleys
which may have been previously platted but never opened or on streets and alleys on ground newly
platted within the City or on new additions being brought into the City shall be limited to leveling
the existing surface, where practicable, of the proposed traveled portion of streets and avenues and
to outlining the gutter lines thereof by grading but that it should not include making cuts or fills,
grade changes, or similar work which should be classed as street construction and not street
maintenance.
Proposed "Typical Section" for Paving in 90 Ft. Right-of-way Streets in New Subdivisions
Special attention of the Commission was called to the proposal of B & E Corporation and of the
Bozeman Deaconess Hospital Board to pave to a 24 ft. width on Highland Boulevard with an additional
24 ft. to be paved at some future date. This matter was taken under advisement for further study.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
