The Commission of the City of BozeJ1l.an met in regular session in the Commission Room, City Hall
Building, ivednesday, July 29, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson,
Commissioner Berg, City Manager Henderson and the Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded
by Commissioner Berg, that the minutes be approved as read and the motion was carried by the follow- I
ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Conunissioner Berg;
those voting No, none.
Public Hearing -- S. I. D. No. 413
Hearing on Resolution No. 953, which was adjourned to this date from the regular meeting of the
City Commission on July 22nd, was resumed. Forty or more persons, all except two or three of whom were
protesters against the proposed district, were present. Further review of this proposal made by the
Conunission has shown that a number of protests that were originally filed against the proposed special
improvement district were not considered as qualified protests because they were not made by actual
owners of record but were made by contract purchasers or other persons who were actually the principal
owners of the properties they represented by protest. Recognition of these protests would raise
the total protest to represent much more than 40% of the total property in the proposed special
in~rovement district. In view of these circumstances, it was moved by Commissioner Swanson, seconded
by Conunissioner Berg, that the protests be declared sufficient and that proceedings toward establish-
ment of the proposed S. I. D. No. 413 cease and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Question Concerning Plat for Building Site on North Seventh Street I
Mr. Myron Westlake has made verbal inquiry as to whether or not the City would approve a plat of
a single building site, with approximately 100 ft. of frontage on North 7th Avenue, on his unplatted
land abutting 7th Avenue between lIemlock Street and the city limits at Oak street. The Commission
instructed the Cit;y Hanager to inform Mr. Westlake that it does not look with favor on plats of such
small area but that, if he would prepare an acceptable plan showing his proposed eventual development
of all of his unplatted ground within the city limits and, in conformity with that plan, present a
plat of that part of his land actually fronting on North 7th Avenue between Hemlock and Oak Streets,
it would be looked upon with favor.
Petition -- Create s. 1. D. to Pave Highland Drive
Petition of the Bozeman Deaconess Hospital Board and the Bridger Development Company was presented
for a Special Improvement District to be established to pave what is proposed to be a part of Highland
Drive and to include other streets in the Harwyn Re-arrangement of a part of Northern Pacific Addition.
Highland Drive, as outlined in the petition, extends south from the intersection of Cypress Avenue and
Babcock Street, on Cypress Avenue to Curtiss Street, thence east to McAdow Avenue, thence southeasterly
and south on the line of Golf way to the northwest corner of Central Addition, thence southerly, on a I
route which is being surveyed, to the northwest corner of Western Union Addition. The City Manager was
instructed to inform the petitioners that it is necessary to have additional engineering data and to
have required right-of-way for the proposed Highland Drive before action can be started on the creation
of the requested special improvement district.
Request for SevIer Service -- Bonn Sub-Division
SimGraf Corporation has requested permission to construct a sanitary sewer extending west from
South Church Avenue in East Story Street to serve dwellings which they are constructing on the south
side of East Story street between Church Avenue and Bozeman Creek. The sewer is proposed to be

installed in the parking on the south side of Story Street between the pavement and the sidewalk. - .J
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, subject to this
installation being made by the SimGraf Corporation entirely at its expense and to meet the specifica-
tions and inspection of the City Engineer and on the completed sewer becoming a part of the City's
regular sewer system, the request be granted and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting

Proposal to Vacate Streets and Alleys in Central, Prospect Hill, Highland and Valley View Additions
to The City of Bozeman
The City Attorney, as instructed, had rewritten proposed Resolution No. 956 entitled:

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting AJ'e being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
I Special Hequest to Erect Sign -- Electrical Products Consolidated
Electrical Products, Consolidated, Billings, Montana has made verbal application to the Building
Inspector for permit to erect a sign at a new motel being built on West Main Street just west of 5th
Avenue. The proposed sign does not comply with Ordinance No. 786 because it is more than 20 ft. in
height. Investigation by the Building Inspector has shown that signs at six other motels in Bozeman
exceed the height limitation of the ordinance and that the design of the sign proposed to be erected
is such that it will not create hazards normally associated with a ground sign. In view of these
circumstances, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that an exception
be granted to the requirements of the sign ordinance in this case and that, upon presentation of an
application in proper form, the Building Inspector be and is hereby authorized to grant a permit for
the erection of this sign and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Public Hearing on Annual Budget
This was the time and place set for public hearing on the Appropriation Ordinance No. 815 for the
fiscal year ending June 30, 1960.
Affidavit of publication of Notice of Hearing was presented. No one was present to be heard
I on the proposed ordinance and accompanying annual budget and no one had made inquiry or protest regard-
ing it.
It was moved by Cormnissioner Swanson and seconded by Commissioner Berg that the Clerk of the
Cowmission be authorized to have the Ordinance published as required by law and the motion was carried
by the following Aye and No vote: those voting Aye being ~~yor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Proposed Lease -- Parking Lot on East Babcock
As instructed by the Commission on July 22nd, City ~ffinaeer Henderson presented a counter proposal

to Security Building, Inc. to rent Lots 29, 30, 31 and 32 and the east 3.5 ft. of Lot 33, Block
"C", Original Townsite, at a monthly rental of $60.00 for a public parking lot and the counter
proposal has been accepted.
It was moved by Commissioner Swanson, seconded by Conunissioner Berg, that the City Attorney be
instructed to prepare a lease in accordance with this proposal and that the Mayor and Clerk of the
Commission be authorized to sign the lease for t.he City and the motion was carried by the following I
AJ'e and No vote: those voting Aye being Mayor Erwin, Conunissioner Swanson and Commissioner Berg;
those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Mayor Erwin, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Yayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
