HomeMy WebLinkAbout1959-08-26 118 Bozeman, Montana August 26, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, August 26, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner - Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ... ing proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded I by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Revised Rules & Regulations -- Police Department Proposed Revised Rules and Regulations governing operations of the Police Department of The City of Bozeman as presented at the last regular meeting were further considered. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the said rules and regulations be approved . and the Mayor and Clerk of the Commission be authorized to sign the same as so approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Discussion on Proposed Zoning Ordinance Larry Gerckens, who has been employed to coordinate existing and proposed new zoning regula- tions, appeared before the Conunission and discussed proposed matters to be incorporated in the proposed new zoning ordinance. City Attorney Lovelace suggested that he will prepare a rough draft of the proposed new ordinance for further study by the Commission, Mr. Gerckens, the City-County Planning Board and others, and that a special meeting of the City Commission then be called to con- I sider the ordinance. Further action was deferred pending preparation of the proposed ordinance. Cancellation of Plumbers & Gas Fitters Bonds -- James S. Croston A request from the bonding company that the bonds of James S. Croston for a Plumber's bond and a Gas Fitter's bond be cancelled was presented. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the bonds be cancelled as of August 26, 1959 and the motion Wae carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Sale Lot 12, Cleveland Subdivision A deed requesting transfer of City owned property, Lot 12, Cleveland Subdivision, a suburb to Bozeman, in SEkNwk Section (12), T2S, R5E M. P. M. to Earl C. RlJJIUiUls and wife was placed before the Commission. The sale of this property is to be in accordance with terms and conditions set forth in a written agreement presented by Spomer Homes and approved by the City Commission on January 28, 1958. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City approve the sale, subject to the above described agreement, and that the Mayor and Clerk of the Commission be .'"' authorized to sign the deed for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Repairs to Roof of City Hall -- Earthquake Damage City Manager Henderson reported that preliminary inspection and estimate of temporary repairs necessary to the roof of the present City Hall are in the amount of between $5,000.00 and $8,000.00. The Commission directed Mr. Henderson to secure additional information and date on the matter and delayed further action until a later date. Proposed Plan - Highland Drive - Curtiss to Hospital Ground A plan, prepared by City Engineer Liquin to show proposed right-of-way extending south from 119 Babcock Street on Cypress Avenue, thence east on Cypress Avenue to Golf Way and thence southerly between the Elks'Country Club and Sunset Hills Cemetery to the south line of said cemetery, was presented. To establish this right-of-way will necessitate securing certain land from the Elks'Country Club and the dedication of certain land from the cemetery. Based on the plan as presented, negotia- tions were authorized to be continued to secure the required area for right-of -way from the Elks' " Country Club. I Authority to Attend Planning Conference -- Missoula -- September 18-19, 1959 A planning conference is scheduled to be held at Montana State University in Missoula on September 18-19, 1959. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that it being in the public interest, City Engineer Liquin and Larry Gerckens, City Representatives, and Ralph Aaker and H. D. Korslund, County Representatives, on the City-County Planning Board, be authorized to attend this conference and that their expenses be paid from the Planning Board fund and the" motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Report The July, 1959 report of the Director of Finance was presented and reviewed by the Commission. Commissioner Berg moved that the report be accepted and ordered filed and Commissioner Swanson seconded the motion and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bozeman Reservoir Company -- Meeting August 19, 1959 City Manager Henderson reported on the meeting of the directors of the Bozeman Creek Reservoir I Company, held on August 19, 1959, at which plans and specifications, prepared by Engineer Theadore Williams, for construction of a new spillway and other repair and improvement work at Mystic Lake Dam were approved. Bids for the proposed work have been advertised to be opened at the City Hall at 7:30 P. M. on Thursday, September 3, 1959. Plans and Specifications -- Proposed Improvements in Hyalite View Subdivision Plans for sanitary sewers, sewage disposal lagoon, street paving and other improvements, proposed to be installed in Hyalite View SUbdivision, have been prepared by Engineer Bereman and submitted to City Engineer Liquin for examination and recommendation. It has been suggested that Harold Hoskins & Associates be employed as Consulting Engineers to further review and make recommendations on these plans and specifications. The City Manager was authorized to negotiate with Harold Hoskins & Associates to secure their services in such a consulting capacity. DeBoer Contract Terms of the contract between the City of Bozeman, the Montana State Planning Board and S. R. DeBoer and Company provided that the latter named company was to prepare a Master Plan for Bozeman and surrounding area and was to be continued in part time employment for one year after completion of the ., Master Plan as consultants in the implemen~tion of the said plan. It was originally recommended by I S. R. DeBoer that the contract be for two years of such consulting services but the Housing & Home Finance Agency, who were providing 50% of the costs, would not approve the contract for more than one year of consulting services. Time for preparation of the Master Plan and one year of consulting services under the contract has expired and question arises as to renewal of the contract for an additional year. It has been recommended by the City-County Planning Board and the City Manager that the contract not be renewed. The City Manager was instructed to request a detailed statement from S. R. DeBoer and Company as to completion of the existing contract and to notify them that the contract will not be renewed beyond the one year of consulting services. 120 ' Street Conditions City Manager Henderson reported that the Bridger Development Company has made excavation in Cypress Avenue between Babcock and Curtiss Streets and in Curtiss Street from Cypress Avenue to existing pavement in Marwyn Addition in apparent anticipation of permanent improvements being made in these streets. These streets have been left in an unsafe and unsatisfactory condition. A petition is before the Commission to include the above described and other streets in a proposed' special improvement district to provide for paving but insta.llation of the improvements can not I possibly be done before the sununer of 1960. The City Manager was instructed to serve notice on . . the Bridger Development Company to put the above described streets back in safe and useable condi- tion but to require the work to be of a temporary nature in view of the permanent improvements proposed to be done. Shops and Storage Building in New City Yard -- Rouse and Tamarack Architect William Grabow has made informal recommenda.tion that the most satisfactory and economical building which could be constructed in the new city yard at Rouse and Tamarack to meet operating needs of the City would be a concrete block building approximately 50 ft. wide and 250 ft. long. His preliminary estimate of cost of such building was $60,000.00. The City Manager was instructed to secure further information regarding possible financing of such a building6n a rental basis. Adjournment There being no further business to come before the Commission at this time, it was moved by commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson I and Commissioner Berg; those voting No, none. ., /J" .
