COMMISSION RESOLUTION NO. 4775
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
AUTHORIZING THE CITY MANAGER TO PURCHASE A TRACT OF LAND
NECESSARY FOR THE PURPOSE OF EXPANDING THE VEHICLE
MAINTENANCE PROPERTY.

WHEREAS, the City of Bozeman finds it necessary to acquire certain real property
to allow it to utilize such property for purposes of expanding the Vehicle Maintenance
property; and
WHEREAS, the real property to be acquired is described in Exhibit "A" attached
hereto and by this reference incorporated herein; and
WHEREAS, the Montana Department of Transportation has offered to sell said
real property by submission of a written offer in accordance with Section 60-4-202, Montana
Code Annotated;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Bozeman,Montana,that it authorize the City Manager's execution of the Offer Letter for the
Purchase of the real property described in Exhibit "A," together with all necessary closing
documents, and accept the Deed to transfer ownership of the real property from the Montana
Department of Transportation to the City of Bozeman.
PASSED AND APPROVED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 30'h day of January, 2017.

Description
Parcel No. 101 on Montana Department of Transportation Project STPP 86-1(44)0, as shown
on the Right-of-Way plan for said project recorded in the office of the County Clerk and Recorder
of Gallatin County, Montana. Said parcel being a portion of the property conveyed under Film 95,
Page 1605 and is also described as a tract of land within Certificate of Survey recorded under s
Film 1, Page 928 situated in U.S. Government Lot 2 (sometimes referred to as the NW%NE'/)
of Section 6, Township 2 South, Range 6 East, P.M.M., Gallatin County, Montana. as shown by
the shaded area on the plat consisting of 1 sheet attached hereto and made a part hereof,
containing an area of 58.425 sq. ft., more or less.

Dear Mr. Woolard,
The property that the City of Bozeman (City) is interested in acquiring is shaded on the
attached plat and is approximately 58,425 square feet in size with a 6,500 square foot
service garage. The Montana Department of Transportation (MDT) hired a fee
appraiser who determined that the fair market value of the property on November 14,
2016 was $650,000.00.
MDT is agreeable to transferring all of its right, title, and interest in the property to the
City if they agree to the following:

• pay MDT 100% of the appraised fair market value of the property; and
• honor the existing Lease Agreement with Knife River"as is" without any
revisions especially regarding the term and the compensation. (See attachment.)
MDT is not requiring a survey of the property, but if a survey is needed for recording or
other purposes, the City would be required to provide a survey of the property at their
sole expense.
If the City agrees to these terms, please send MDT the following by February 1, 2017:
• this letter signed and dated by the appropriate representative for the City as
acceptance of this offer; and
• a check for the 10% deposit of the $650,000.00 or$65,000.00 payable to the
Montana Department of Transportation.

The remaining balance of $585,000 would be due on or before March 2, 2017. Once the
property is paid for in full, I will proceed to have a deed prepared to transfer the property
to the City. Also, include the last 4 digits of the City's FEIN number below.
Because land values are always changing, this offer is only good until February 1, 2017.
If I do not receive this signed letter and a check for $65,000 from the City on or before
said date, this offer will be rescinded.
