HomeMy WebLinkAbout1959-05-06 55 Bozeman, Montana May 6, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall' Building, Wednesday, Hay 6, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following pro- ceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. "" Option for Lots in Proposed Spring Dell Addition A communication from R. J. Rickabaugh was read asking if the city would approve an option agree- ment to repurchase Lots 1 to 3, Block 2, of proposed Spring Dell Addition if these lots were deeded to the City in lieu of dedicating land for park purposes in this proposed addition, said lots to be appraised at $2,347.80 or $782.60 per lot and the option agreement to give the owner the right at any time within two years to purchase them at that appraised price. Mr. Rickabaugh was informed that, subject to the sale price including any expense or cost which the City may have had to pay on the lots between the date they are deeded to the City and the date the option to purchase them is exercised, the City would look upon such a proposal with favor. Encroachment on Alle:v at II West r.olle~e Ben Nielson, of the Sigma Nu Fraternity, 11 West College, appeared before the Commission to request permission for this Fraternity to construct a retaining wall in the alley along the west side of this I fraternity building. After consideration by the Commission, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the requested permission be granted subject to the preparation and sign- ing of a proper easement agreement which would limit the life of the agreement to the time in which the building in question is continued in its present use and occupancy and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. .. . Clean-up Week Activities Approved A committee from the Retail Merchants Committee of the Chamber of Commerce requested permission to display appropriate merchandise for Clean-up Week on the sidewalks in front of stores on Monday, , May 11th, 1959, also permission to have a parade on this day, and requested further that city clean-up equipnent take part in the parade. The Commission granted the requests. Reports The following reports for the month of April, 1959 were presented: Librarian Cashier Sewage Plant Operator Fire Chief Water Collector Building Inspector Police Chief I It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request to Remove Meters at Crenshaw Apartments A request from B. M. Crenshaw was read requesting that parking meters Nos. 106 and 107 be removed from Babcock Street in front of the Crenshaw Apartments to provide more convenient ingress and egress to his private dr~veway at this location. The request was referred to the City Engineer and Chief of Police for investigation. fiG Claims for the Month Claims Nos. 4583 to 4837 inclusive were presented on the various funds as follows: General $16,990.98 Street 6,055.55 Water 36,996.48 S. S. 648.99 Total--- $111,601.44 The Manager stated he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail by the City Commission, and checking against the Claim Register, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants issued for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Protest to Truck Route A written protest from the Hawthorne School PTA to the location of the Truck Route along the Hawthorne School was read. The matter was referred to the Chief of Police for study and recommendation. Platting of Hyalite Sub-division Mr. John Bereman presented a proposed plat of Hyalite Sub-division. He explained that, because of I the nature of the terrain, two proposed cul-de-sacs will be more than 500 feet in length, and the length of one of the streets more than 1300 feet in one city block which would not comply with provisions of Ordinance No. 796, the Sub-division Ordinance of this City. After examination of the proposed plat, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that, the requirements of the said Ordinance No. 796 as to maximum length of streets ending in a cul-de-sac and the maximum length of a street in a single block be waived to permit such of these variances as are proposed in this plat and the motion was carried by the following ~ye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Extension of water Main on North Ninth - Royal Vista Addition A request of Roy D. Houser to extend the water main on Ninth Avenue approximate1.y one block in the Royal Vista Addition was presented. This extension would abut on land which has been dedicated for park purposes. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that because the line abuts park property the City participate in one-half of the cost of laying the water main, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Trade of Land in Bozeman Creek vatershed The City Manager explained a possible exchange of the N. W. t of Section 29, T 3 S, R 6 E, which the City owns within the Gallatin National Forest and the Bozeman Creek watershed, for the S. ! of the N. W. i of Sec. 8, T 3 S, R 6 E, owned by the U. S. Forest Service in the same general area. It was pointed out that such an exchange would be advantageous to the C:tty in getting a needed road to Mystic Lake within this watershed from which it gets a large part of its public water suppl,y and to the U. S. Forest Service by giving it ownership to the quarter section of land now owned by the City of Bozeman which land is entirely surrounded by Forest Service lands. fi7 After discussion, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Mayor and the Clerk of the City Conunission be authorized to sign an "Info:nna.l Land Exchange Offer" (land for Land) (Act of 3-20-22 as amended) to be presented to the Supervisor of Gallatin National Forest to initiate required proceedings in this proposed land exchange and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and I Commissioner Berg; those voting No, none. Appointment of Don Cobb - Police Connnission Mayor Erwin announced the re-appointment of Don Cobb as a member of the Police Conunission for a three-year term ending April 30th, 1962. It was moved by Conunissioner Berg, seconded by Commissioner Swanson, that the appointment be approved and the motion was carried by the following ~ye and No vote: those voting Aye being Mayor Erwin, Conunissioner Swanson and Commissioner Berg; those voting No, none. Purchase of Tires for Motor Grader It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be authorized to purchase 4 new tires and '2. re~apPed tires for the motor grader at an approximate cost of $788.00 and the motion was carried by the following Aye and No vote: those voting ~ve being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Option Agreement - Sale of "Well 51 te" An Option Agreement for the purchase of the South one-half of Lots 15 to 17, Block F, Rouse's Addition, from the City of Bozeman by the Bozeman Development Company was presented. The agreement having been prepared by the City Attorney, it was moved by Commissioner Swanson, seconded by I Commissioner Berg, that the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 947 - Intention to r.reate S. I. D. 410 The City Attorney as instructed has prepared the resolution of intention to create Special Improvement District No. 410, paving on North Eighth, Ninth, and Tenth Avenues from Main to Beall Street, and on Mendenhall and Lamme Streets from Seventh Avenue to Tenth Avenue. Resolution No. 947 was presented, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 410 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTAU.ING A PAvnmJT PROJECT ON NORTH EIGHTH AVENUE, NORTH NINTH AVENUE, AND NORTH TENTH A VENUE FROM WEST MAIN STREET TO WEST BEALL STREET, AND ON WEST MENDENHALL STREET AND WEST LAMME STREET FROM NORTH S:EVENTH A VENUE TO NORTH TENTH AVENUE, SAID PROJECT TO INCLUDE THE CONSTRUCTION AND INSTAu.ATION OF COMBINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE, AND OTHER WORK INCIDENTAL THERETO. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be passed and adopted and June 3rd, 1959 be set as the date for hearing protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I .
