HomeMy WebLinkAbout1959-01-21 25 Bozeman, Montana January 21, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, wednesday, January 21, 1959, at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bids for Bridge in Alley, Block tfC", Original Townsite This was the time and place set for opening bids for construction of a bridge over Bozeman Creek in Block "e", Original Townsite. Affidavit of publication of Notice was presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and commissioner Berg; those voting No, none. The following bids were opened and read: Haggerty-Messmer Company $2,610.00 W. D. Howells 2,180.00 Wallace Dietman 3,716.60 After checking and tabulation by the City Engineer, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the bid of W. D. Howells be accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner I Berg; those voting No, none. Building Inspector to Conference in Billings There will be a Building Officials' Conference in Billings, February 5 and 6, 1959. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that Building Inspector Roy Smart be authorized to attend this meeting and his expenses be paid from the General Fund, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Meeting of Legislative Committee of Montana Murticipal League The Legislative Committee of the Montana Municipal League will meet in Helena, January 22, 1959. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that two members of the City Commission be authorized to attend this meeting and their expenses be paid from the General Fund and the Motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Reports Annual reports of the Chief of Police and of the Building Inspector for the year 1958 were I presented. It was moved by Commissioner Berg, seconded by Mayor Erwin, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Application for Gas Pump - Business District Part II Application of Wayne Pearson to install a "self-service" gasoline pump on the lot at 9th Avenue and College, discussed at the meeting of January 14th, was further considered. Mr. wayne Pearson, Joe Buckmaster and Richard Kuhl were present in the interest of the application and ten persons having varied interests in sale of gasoline in Bozeman, with Attorney James Morrow as their spokesman, were present to oppose granting the application. Mr. Pearson informed the Commission that this type of 26 self-service pump has been in existence for twenty-five years; there has never been a fire from the operation of this type of pump; that it is a labor-saving device without an automatic nozzle; and that there are many installations of this type pump in other states. Joe Buckmaster stated the installation would be similar to other self-service gas stations in the city, that 24-hour service will be offered and that it is not their intention to start a gas price war. Mr. J. H. Morrow, representing the Gallatin Petroleum Dealers' Association, spoke in opposition to granting a permit for this installation, stating that it would be hazardous to the safety of the public .. principally because there would be no attendant present. He also requested that an ordinance be passed to prohibit selling volatile liquids without an attendant being present. Don Lock called attention to Montana statutes which prohibit sale of volatile liquids in glass containers and pointed out that, if this self-service installation is permitted to operate without an attendant, any person would be free to come there and purchase gasoline in any kind of container. After all present had been given an opportunity to be heard, the Mayor informed them that, before a decision is reached, the Commission will make further investigation and secure further information regarding this type of installation. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. #dA<~~. .
