HomeMy WebLinkAbout1959-02-25 :37 Bozeman, Montana February 25, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, February 25, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Swanson, secondeo by Commissioner Berg, that the minutes be approved as read and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Permi tJ& Li'cense for Self-Service Gasoline Pumps Again Refused Mr. Wayne Pearson, of Vendo Enterprises, presented a written request to have his application for a city license and a building permit to construct and operate a self-service gasoline pump on the lot of the Parkway Groce~r located at Ninth and College reconsidered. Mr. Pearson stated that a bill introduced in the Legislature to prohibit the sale of gasoline from self-service gasoline pumps had been killed, and he presented and read affidavits from operators of this type of enterprise commend- ing its operation. The Commission stated that their action of January 28th, 1959, denying these applications, had been based on zoning regulations of the City of Bozeman and recommendations in the Fire Prevention Code of the Board of Fire Underwriters and they declined to reconsider their previous action in the matter. Changes in Buildings to be Listed on Fire Insurance Schedule The following buildings are included in the "Statement of Values" furnished the Montana Fire I Rating Bureau on which to establish average rates on insurance: Chlorinating Plant 3 miles southeast of Bozeman Chlorinating Plant 2! miles Northeast of Bozeman The following buildings are not included in the above described "Statement of Values": Control Building at Sewage Treatment Plant Digesters and Connecting Pump and Heat Exchanger Building at Sewage Treatment Plant New water Treatment Building at South Side Reservoir Booster Station on Lyman Creek Water Supply Line. Because of the type of construction and the location and occupancy of these buildings, it appears uneconomical to insure these buildings under the present blanket insurance coverage. In the new Ci t;sr Yard at Rouse Avenue and Tamarack Street there are the folloWing buildings of frame construction: One shop building, 40 ft. X 60 ft. One frame storage building, 24 ft. X 30 ft. One frame storage building, 16 ft. X 24 ft. These buildings are not included in the latest schedule of values on city owned properties. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be and is hereby authorized to file amendments to the above referenced schedule of values to specifical~y I- first exclude therefrom the six structures/1isted herein and to include thereon the frame buildings'in the new City Yard and the motion was car,ried by the following A,ye and No vote: those voting ~ye being Mayor Erwin, Commi,ssioner Swanson and Commissioner Berg; those voting No, none. water WOrks Project - Additional r-laim of Statewide Plumbing & Heating j Letter from Statewide Plumbing & Heating Company for alleged extra work caused by improper testing of the water supp~y line was presented. The amount claimed was $1,~00.00 and the repairs for which the claim was made were made in June and Ju~y, 1958. The letter was dated December 1, 1958 and was deli vered to the City Manager on February 22, 1959 by Mr. Lauren Gibbs. Action was deferred pending receipt of the recommendations from a Board of Arbitrators on the disputed claims of Statewide :38 Plumbing & Heating Company. Water WOrks Project - Agreement - ReceivinR Award of Board of Arbitrators The City Manager informed the Commission that the two arbitrators, appointed by the City and by Statewide Plumbing & Heating Company, respectively, have been negotiating for a period of several days and that they had informed him that they may have reached an agreement as to the settlement of the dispute between the City and Statewide Plumbing & Heating Company. Before submitting their recommendation to the Cit;y, however, the arbitrators had requested that the City and Statewide take . 1 some official action to approve their deliberations as a two~an board of arbitrators instead of a three-man Board as called for in the specifications and that such action indicate that the parties were willing to receive the award from the two arbitrators the same as if it had been made by a three- man Board. The Manager then presented to the Commission an agreement prepared by the City Attorney between the City and Statewide Plumbing & Heating Company in which the parties agree to receive the award or findings of the two-man Board the same as if it had been made by a three-man Board reserving, however, unto each party the right to reject the award. The City Manager recommended that the agreement be approved and that the Mayor and Clerk be authorized to execute the same in behalf of the City. There- fore it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the said agreement be approved and that the Mayor and Clerk of the Commission be authorized to execute the same and the motion was carried by the following A,ye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request for water Service - 118-126 South Eleventh A request from Ray Hill to connect a water service for proposed buildings on Lots 11 to 14, Block 6, West Park Addition (118-126 South 11th Avenue) to the service line for the residence on Lots 9 I & 10, Block 6, West Park Addition (116 South 11th Avenue), was reported. Due to the fact there is no water main on Eleventh Avenue in this block, the Commission stated that an agreement presented by Mr. Hill for this service in accordance with terms recommended by the City Engineer would be looked upon with favor. Purchase of Copper Fittings Need for copper fittings in the water Department was reported. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be authorized to purchase copper fittings in the approximate amount of $700.00 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Amendment to TlJuisance Ordinance A proposed amendment to Ordinance No. 646, declaring it a nuisance for minors to be in possession of intoxicating beverages, was discussed. It was reported that other cities have similar ordinances. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Attorney be instructed to prepare an amendment to Ordinance No. 646 to include this matter and the motion was 1 carried by the following Aye and No vote: those voting A,ye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Continuation Certificates for Budd Plumbing & Heating Continuation Certificates for a r~s Fitter's Bond and Plumber's License Bond for Budd Plumbing & Heating Company were presented. The certificates were approved as to form by the City Attorney. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the certificates be approved and accepted and the motion was carried by the follOwing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. '-19 t.. "- Offer to Purchase T,ots An offer from Alex Weaver to purchase Lots 6 & 7, Block 4, Western Sub-di vision was read. Action was deferred pending investigation.
