The Commission of the City of Bozeman met in regular session in the Conunission Room, City Hall
Building, Wednesday, March 11, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, Acting City Manager Cutting, City Attorney Lovelace and the Clerk. The
following proceedings were had:
I Minutes of the last regular session were read and it WdS moved by Commissioner Swanson, seconded
by Conunissioner Berg, that the minutes be approved as read and the motion was carried by the follow-
ing ~ye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Petition for Storm Sewer District "Area B"
Petitions representing 24.5% of the property in a proposed special improvement district for a
storm sewer drainage district to serve an area between Main Street and Durston Road and between North
Grand Avenue and North Seventh Avenue were presented.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Rngineer prepare
the necessary data and, based on this data, the City Attorney be instructed to prepare the resolution
of intention to create the district and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
RAsolution No. 943 -- Intention to Create S. I. D. No. 40B
The City Attorney as instructed has prepared a resolution of intention to create Special
Improvement District No. 408, a storm sewer drainage district to serve the area between Main Street
and Durston Road and, North Grand Avenue and North Seventh Avenue. Resolution No. 943 was presented

It was moved by Commissioner Berg, seconded by Comm:i.ssioner Swanson, that the resolution be
passed and adopted and April 1, 1959 be set as the date for hearing protests and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Petition for Storm Sewer District rtArea Art
Petition representing 29.11% of the property in a proposed special improvement district for a
storm sewer drainage district to ser'~ the area from Main Street to Beall Street and between North Seventh
and North Eleventh Avenue was presented. It was moved by- Commissioner Berg, seconded by' Commissioner
Swanson, that the City Engineer prepare the necessary data and based on this data the City Attorney
be instructed to prepare a resolution of intention to create the district and the motion was carried
I by the following Aye and No vote: those voting Aye being Mayor Erwin, Conunissioner Swanson and
Commissioner Berg; those voting No, none.
Purchase of r,rushed Gravel
The Acting City Manager requested authority to purchase approximate~y 500 cubic yards of 3/411
crushed gravel to be used for street maintenance. It was moved by Commissioner Swanson, seconded by
Co:(linri.ssioner Berg, that the request be approved and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.

Discussion of Sanitary Land Fill Garbage Disposal
The proposed sanitary land fill garbage disposal program and purchase of equipment for that purpose
was discussed at length following presentation of cost and financing data by the representative of a
machinery company. Amending the present garbage ordinance to require garbage racks, cans of standard
specifications, and the convenient placing of cans was also discussed. Further action was deferred
pending demonstration of equipnent and further study of available funds and present operations. I
water Improvement Project - Communication from Statewide re: Award of Board of Arbitration
A letter from Statewide Plumbing & Heating Compa~y, dated 9 March 1959 at Murray, Utah, stating
that they accept the findings of the Board of Arbitration as final and offering a settlement of their
disputed claims on that basis was read. The Acting Manager was instructed to advise the members of the
Board of Arbitration of an error in the totals as presented in their award and request their authoriza-
tion for its correction. Further action on the Contractor's settlement proposal was deferred pending
receipt of that information and confirmation of the final contract amount.
Approval of Telephone C;ompany Placing Cable Underground on North Seventh

Plans from the MOuntain States Telephone & Telegraph Company of the proposed underground cable
"
installation of a section of its Beach-Helena Toll, 15 feet from the east property line along North
Seventh Avenue from Villard street to the north city limits were presented. It was moved by Commissioner
Berg, seconded by Commissioner Swanson, that this proposed project be approved, subject to approval by
the Montana State Highway Commission and any other regulatory authority involved, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and
Commissioner Berg; those voting No, none.
Proposed Men's Dormitory - Tenth & C;ollege I'
Preliminary drawings for a proposed men's dormito~r at Montana State College to be located at
Tenth and College were reviewed. Approval of these plans was withheld due to a lack of provision for
off-street parking and pending the receipt of further advice of a satisfactory solution of this problem.
The Acting Manager was instructed to advise Montana State College of this action and also that the
connection of this building to the City's sanitary sewer trunk lines serving the campus bringcc these
lines to their rated capacity and that same other provision must be made by Montana State College for
any further building on the campus requiring sanitary sewer service.
Claim - Truck Insurance Exchange
ClajJm No. 4338 of the Truck Insurance Exchange in the amount of $121.60 was presented. It was
moved by Commissioner Berg, seconded by Commissioner Swanson, that the claim be approved and a warrant
issued for its payment and the motion was carried by the following Aye and No vote: those voting Aye
being JI.ayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Reports
Tne following reports for the month of February, 1959 were presented:

and ordered filed and the motion was carried by the following Aye and No vote: those voting ~ye

Cancellation of Bond for Anderton
A request from the Home Indemnity Company was read requesting Bond #28 25 44 of George B.
Anderton be cancelled as this bond has been replaced with another bond. It was moved by Commissioner
Swanson, seconded by Commissioner Berg, that this bond be cancelled as requested and the motion was
carried by the follO'\-ri.ng Aye and No vote: those voting Aye be1.ng Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.

Ordinance No. 810 -- Possession of Liquor by Minors a Nuisance
The City Attorney as instructed by the City Commission has prepared an ordii:ancG declat'inp it a
nuisance for minors to be in possession of intoxicating beverages. Ordinance No. 810 vlaS presented,
entitled:
AN ORDINANCE PROHIBITING THE PURCHASE BY PERSONS UND"ER THE AGE OF Tt'IDJTY~NE YEARS OF
INTOXICATING LIQUOR, BEER, OR vaNE; PROHIBITnTG THE POSSESSION BY ANY PERSON mmER THE
AGE OF TWENTY~NE YEARS OF ANY INTOXICATING LIQUOR, BEER, OR WINE; DECLARING THE
POSSESSION OF ANY INTOXICATING LIQUOR, BEER, OR WINE BY ANY PERSON UNDER THE AGE OF
TWENTY~NE YEARS TO BE A NUISANCE AND TO CONSTITUTE CONDUCT CALCUlATED TO DISTURB THE
PUBLIC PEACE OF THE CITY OF BOZEMAN AND OFFENSIVE TO THE PUBLIC MORALS OF THE CITY OF
BOZEViAN; AJID PROVIDING FOR A PENALTY FOR VIOLATION OF THIS ORDDTANCE.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the ordinance be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being ~~yor

Wldth of North Eleventh Avenue
Inquiry has been made regarding the desired width of Eleventh Avenue for platting purposes.
After discussion by the Commission, it was decided the City should not vacate a~y part of Eleventh
Avenue between Main Street and Beall Street, and that the width of Eleventh Avenue north of Beall
Street should be platted ninety feet wide, as proposed in the Master Plan for the City of Bozeman.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
