The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, March 25, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Swanson, Commissioner Berg, Acting City Manager Cutting, City Attorney Lovelace and the Clerk. The
following proceedings were had:
I ~inutes of the last regular session were read and it was moved by Commissioner Berg, seconded
by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Dump Grounds - White Rat Infestation
E. E. Seyler of the Federal Fish and Wild Life Service was present and informed the Commission
of the "~Vhite Rat Infestation" at the City Dump. He explained the method used by his agency for the
control of rats. At the request of the City Commission, Mr. Seyler stated his organization would
initiate treatment at the city dump near the loth of April, 1959.
Automotive Sales Promotion Program Approved
Mr. R. ~. Dye, representing the local Automobile Dealers' Association, was present to make certain
requests in connection with a parade to be held on Saturday, April 4, 1959, during their sales promo-
tion program. Permission to have a parade on this date was approved.
Resolution - Maintenance of Main Street CU. S. No. 10)
A resolution authorizing the City to contribute to the expense of repairing Main Street from
Buttonwood to Fifth Avenue was presented, entitled:

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
C'.ancellation of Agreement - Salvage Rights at 8i ty Dump
It was pointed out that the agreement dated December 31, 1952 between the City and B. J. Cuker
covering salvage rights at the city dump has not been carried out in a manner satisfactory to the City
or according to the terms of the agreement.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Commission considers
the agreement to be breached and in default, and that the agreement be ordered cancelled as of this date,
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner ,swanson and Commissioner Berg; those voting No, none.
Ditch Across Westlake Property - S. T. D. No. 408
I Myron Westlake was present to inquire what the City proposes to do with the storm water after it
leaves the sewer line of proposed S. I. D. No. 408. He asked that the City provide some means to carry
this storm water across his property. After consideration, it was moved by Commissioner Berg, seconded
by Commissioner Swanson, that the City will agree to provide a 1'V" shaped ditch of sufficient size to
carry the run-off of this district for approximate~y one-half mile (from Peach Street across Oak Street)
if and when Special Improvement District No. 408 is created and the motion was carried by the following

those voting No, none.

Opening of Highland Boulevard in Ryall te Sub-division
A communication from C. V. Henderson of the Board of Trustees of the Bozeman Deaconess Hospital
was read, stating same of the problems to be met and solved in connection with the proposed opening
and extension of the Highland Boulevard across the Hyalite Sub-division. The matter was taken under
advisement pending further study.
Plans for Buildings at r.i ty Yards
The matter of moving buildings to the new City Yards was discussed. It was moved by Commissioner
Swanson, seconded by Conunissioner Berg, that the City employ Wn. E. Grabow to prepare pre-preliminar;r
plans for the location of new and/or old buildings at the City Yards now being purchased from the
Standard Construction Company and the motion was carried by the following Aye and No vote: those
voting Aye beine ~~yor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
VFW Buddy Poppy Sale set as of May 16, 1959
It request from the Veterans of Foreign Wars to have their annual Buddy Poppy Sale on .::JB.turday,
Hay 16, 1959, W"cl.S read. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the
request be granted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.

Examination of Depository Bonds
The Commission proceeded to exmnine the Custodiants Receipts of Depository Bonds held by the
Director of Finance as security for City funds deposited in the various banks. It was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the securities be approved and set forth in
full in the minutes of this meeting and the motion was carried by the following Aye and No vote: those
