HomeMy WebLinkAbout1959-04-01 53 Bozeman, Montana April 1, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, April 1, 1959 at 1:00 o'clock P. M. Present were Mayor ~rwin, Commissioner Swanson, Acting City Manager Cutting, City Attorney Lovelace and the Clerk. The following proceedings were had: I Vdnutes of the last regular session and of the Special Session held March 26, 1959 were read and it was moved by Commissioner Swanson, seconded by Mayor Erwin, that the minutes be approved as read and the motion was carried by the following ~ve and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Hearing - Special Improvement District No. 408 This was the time and place set for hearing objections to the creation of ~3pecial Improvement District No. 408. The affidavit of publication of the Notice was presented, together with the Clerk's Mailing Certificate that all property owners have been notified. The written protests represent- ing 51.12% of the property in the district were presented together ~~th requests representing ~+.56X of the property that their names be removed fram the protest petitions. This leaves a net of 36.56% of the property in the district protesting the creation of the district. It was moved by COmrrD_ssioner Swanson, seconded by }fayor Erwin, that the protests be overruled as insufficient and the City Attorney be instructed to prepare the resolution creating the district and the motion was carried by the following Aye and No vote: those voting Aye being Hayor Er~Iin and Commissioner Swanson; those voting No, none. I Request to Purchase "Well Site" A written request from the Bozeman Development Company to purchase the south one-half of Lots 15, 16, 17 of Block F, Rouse's Addition, was presented and read. The matter was taken under advisement. Fees waived for Dormitory - Tenth & College A communication from R. R. Renne, of Montana State College, was read, stating off-street parking for the dormitory at Tenth and College will be provided west of Eleventh Avenue. It was moved by Commissioner Swanson, seconded by I1,ayor Erwin, that a building permit be issued for city records, and all other fees and permits for plumbing, electrical and gas inspections be wdived and ~hese inspections be provided by Hontana State College and the motion was carried by the followin[': A,ye and ~Jo vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Widening of Street - Mendenhall & Tracy In connection with the improvements of the building at the corner of Mendenhall and Tracy Avenue (North part of Lots 22 to 25, Block A, Tracy's Addition), it is proposed to replace the ddewa1k anti curb on Mendenhall Street and request has been made to have the sidewalk three feet narrower and Mendenhall Street three feet wider for the length of this property. All expense in connection with this street widening, including excavation, gravel fill and the moving of any light poles, will be I done at the expense of the property owner, the City of Bozeman to furnish 'clack-top material for this widening. It was moved by Conunissioner Swanson, seconded by Mayor Erwin, that the request be granted under the conditions as stated and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those votinf, No, none. Legion Auxiliar;v Poppy sale ~equest from the American Legion Auxiliary to have their annual Poppy Sale on Saturday, ~BY 23, 1959, was reported. It was moved by Commissioner ~wanson, seconded by !{ayor Erwin, that the request be approved and the motion was carried by the following Aye and :To vote: those voting Aye being V1B.yor Erwin and Conunissioner Swanson; those voting No, r.one. fj,t Resignation of Elizabeth B. Plew - Cemetery Board The written resignation of l1rs. Elizabeth B. Flew as a member of the Cemetery Board was read. Closing Bars Durin~ Elections I IT. B. Lan d oc , repre::.;entine the local Retail Liquor Dealers' Association, appeared before the Commission in regard to I-IT) 504 which states the hours places of business selling beer shall be required to close during elections. The City Attorney was instructed to prepare an ordinance so the (;it;)' reouired closinp' of bars would be consj.stant -with the state law. ~ ~ . RRDort on nivil Defense Meeting Chief of PoJJ.ce ~3aunders and Fire Chief PeYlttila reported on the Civil Defense meeting they attended. Snecifications for Tractor Specifications for a tractorLo be used in connection ,-ri.th sanitary land-fill operations at the cit;y dump were discussed. City :Engineer l.iquin was instructed to consult with Commlsf>ioner Berg regarding propo:3ed specifications for such a tractor.
