SUBJECT: Final Plat for The Crossing 2 at Baxter Meadows Subdivision, Phase 4F
MEETING DATE: March 6, 2017

RECOMMENDATION: That the City Commission approve the Final Plat for The Crossing
2 at Baxter Meadows Subdivision, Phase 4F, authorize the Director of Public Works to execute
the same on behalf of the City of Bozeman, and authorize the Director of Community
Development to execute the improvements agreements on behalf of the City of Bozeman.
BACKGROUND: The City Commission granted preliminary plat approval for The Crossing at
Baxter Meadows Subdivision, Phases 4B-4I on March 25, 2013, by a 4-0 vote.
§76-3-611(1), MCA, provides that the City Commission shall approve the plat only if:
(a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of
this chapter and regulations adopted pursuant to this chapter; and
(b) the county treasurer has certified that all real property taxes and special assessments assessed
and levied on the land to be subdivided have been paid.
The County Treasurer has certified that all real property taxes and special assessments assessed
and levied on the land to subdivide have been paid. Attached is a memorandum from Mitch
WerBell, Assistant Planner, stating the staff has concluded that all terms and conditions of the
preliminary plat approval have been met.
Two Improvements Agreements are required for final plat approval of this subdivision. The first
improvements agreement guarantees the installation of public sidewalk within two (2) years of
the filing of the final plat. An irrevocable standby letter of credit in an amount not to exceed
$28,927.50 has been provided for financial security. The second improvements agreement
guarantees the installation of street lighting, common open space improvements, and public
landscaping within nine (9) months of the filing of the final plat. An additional irrevocable
standby letter of credit in an amount not to exceed $22,410.00 has been provided for financial
security. All other necessary infrastructure improvements are constructed.

UNRESOLVED ISSUES: None identified.
ALTERNATIVES: None suggested or proposed.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from new development, along with increased costs to deliver municipal
services to the property.

SUBJECT: FINAL PLAT REVIEW FOR THE CROSSING 2 AT BAXTER MEADOWS
SUBDIVISION, PHASE 4F, APPLICATION 17019

Genesis Engineering, Inc., on behalf of Bright Development, LLC (Applicant), has made application
to the City of Bozeman Department of Community Development for Final Plat review and approval
for The Crossing 2 at Baxter Meadows Subdivision, Phase 4F, a nine lot major subdivision.
Phase 4F will plat remaining area in a restricted development lot within the Crossing 2
Subdivision. The Crossing 2 was granted preliminary plat approval to subdivide 36.94-acres in
multiple phases to create ninety-five (95) single-household residential lots, one (1) residential
multi-household lot, and the remaining area as common open space, public trails, and streets.
Attached is a copy of the signed Findings of Fact and Order dated May 6, 2013.
Two Improvements Agreements are required for this subdivision, one for the installation of public
sidewalk and a second for street lighting, common open space improvements and public
landscaping. All other necessary infrastructure improvements are constructed.
Based on the summary review provided below the City Engineering Division and Department of
Community Development have reviewed the application against the conditions of preliminary plat
approval; and as a result, find that the final plat application may be approved by the City
Commission.
Three (3) original mylars of the Final Plat, original Platting Certificate, original common open
space quit claim deed and Realty Transfer Certificate, copy of each Improvements Agreement and
letters of credit, copy of the applicant’s narrative, and a copy of the Findings of Fact and Order are
attached for your review. The property owner’s association documents and other applicable
documents were previously recorded at the Clerk and Recorder’s Office.

Community Development Staff respectfully requests that you prepare a City Attorney's
Certificate using the attached original Platting Certificate as updated, and approve the
Certificates of Director of Public Works and Certificate of Completion "as to form". The final
City signatures will be obtained once the City Commission has approved the final plat.
The Community Development Department received the Final Plat application on January 11, 2017.
Based on the applicant having submitted an application on January 11, 2017 for Final Plat review
and approval, and further finding that after receiving supplemental information, Improvements
Agreement applications and financial security, application fees, and payment for cash in-lieu of
water rights, Staff deemed the application complete on February 10, 2017. As such, the 45
working day review period for this final plat would expire on April 17, 2017.
The conditions of preliminary plat approval, which are pertinent to this major subdivision and
how they have been met are described in the submittal materials. An exception to this is that it
was determined that two subdivision improvements agreements are required for uninstalled
sidewalks, street lighting, common open space improvements, and public landscaping. The City
has the signed agreements and the financial guarantees have been provided by irrevocable
standby Letters of Credit from First Interstate Bank.
Note: The Planning and Engineering Divisions reviewed the final plat application against the
preliminary plat cited code provisions and found compliance with these code requirements.
The Engineering Division also reviewed and approved the “closure” of the final plat.
The project is scheduled for consideration by the City Commission on March 6, 2017. Please let
me know if this will not work.
