H. Present were Hayor -;:;rwin, Commissioner ~}wanson, COITunissioner Berg, Acting City Manager Cutting, Cit;y Attorney Lovelace and the Clerk. The Following proceedings were had: I jJlinutes of the last regular session were read and it was moved by Conunissioner Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion 1Im.s carried by the following Aye and ~\TO vote: those voting Aye being ~~yor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Public J.rearing - 3. 1. D. No. 409 This was the time and place set for hearing objections to the creation of Special Improvement District No. 409. Affidavit of Publication of the l"Jotice was presented, together "rith the Clerk's ]\1ailing Certificate that all property ownerS have been notified. The written protests representinp, 1.77% of the property in the district were presented. It ,.;as moved by Commissioner Swanson, seconded by Commissioner Berg, that the protests be over- ruled as insufficient and the City Attorney be instructed to prepare the resolution creating the district and the motion was carried by the followir'g A~re and No vote: those voting Aye being Hayor Erwin, Conunissioner Swanson and Commissioner Berg; those votinp; No, none. Resolution No. 945 - r.reatin~ S. T. D. No. 408 The City Attorney, 3.S instructed, has prepared the resolution creating Special Improvement District No. 408. Selling of "Well 3i te" Property In regard to the inquiry of the Bozeman Development Company to purchase .South one-half of Lots 15 to 17, Block F, Rouse's Addition, it was moved by Commissioner Swanson, seconded by Cownissio~er Derg, that the Cit;y will look with faVOr upon negotiating for the sale of the above-described lots, and the motion was carried by the following Aye and No votp-: those voUng Aye being Ma~ror Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Ordinance No. 811 -- Setting Hours for Bars on Election Days The City Attorney, as instructed, has prepared an ordinance stating the hours places of business selling beer or liquor shall be required to close on certain election days. Ordinance No. 811 was ~. I presented, entitled: AN ORDINANCE OF THE CITY OF BOZEMAN ESTABLISHING THE HOURS DURprG v-JHICH BEER Arm LIQUOR HAY BE SOtD, OFFERED FOR .SALE OR GIVEN AWAY IN SAID CITY OF BOZEHAN AND REPEALING SECTION 10 OF ORDINANCE NO. 641, SECTION 5 OF ORDINANCE NO. 675 AND ALL OF ORDINANCE ".JO. 724. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting ~To, none. Curb Cut - City Center r.1otel - West Main Street Plans for the City Center Hotel on Lots 3 to 7, Block E, Tracy's Addition, show a curb cut of eighty-four feet on Main street. It was moved by Commissioner Swanson, seconded by ~<ayor Erwin, that 56 permission to cut the curb as proposed in the plans be granted and the motion was carried: those vot:i_ng A.ye being ITayor Erwin and Corrurrissioner Swanson; Commissioner Berg did not vote; those voting No, none. Discussion of Equipment for Sanitary IJand Fill tylo Swinton and Don Nash of Nash-Davis Machinery Company were present and discussed the pur- chasing and other matters pertaining to equipment that could be used for the sanitary land fill method of garbage disposal. Engineer for Improvements in Hyalite View SubdivisIon The request of the B & E Co., Inc., presented on Ma.rch 18th, 1959, to retain John S. Bereman, Ci viI Engineer of Cody, '\~roming, in a consultant capacity if and when a special improvement district 57 is created w.ithin property being developed by the B t, E Co. for improvements ir; Eyalite View Sub- division, was considered. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that Hr. Chauner 0:' the B & E Company be informed that the City Commission would favorably consider John S. Bereman in an engineering consulting capacity, as requested, and t.he motion was carried by the followir.gAye and ;-:0 I vote: those voting Aye being Mayor Erwin, Corrunissioner Swanson and Commissioner Berg; those ',oting tro, none. wage Increase for Fire Chief Penttila The matter or a salaDT increase for the position of Fire Chief was considered.
