HomeMy WebLinkAbout1958-11-05 3 Bozeman, Montana November 5, 1958 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, November 5, 1958, at 1:00 o'clock P. M. Present were ~yor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing proceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Vacating Lincoln Street Petitions presented at the meetings of October 29th and 22nd, 1958 requesting that Lincoln Road be vacated from Grand Avenue to the alley between Fifth and Sixth Avenues were again considered. Martin Whalen, Superintendent of Physical Plant at Montana State College, was present to discuss his letter which states reasons why MOntana State College does not favor vacating this street. A communica- tion from the Plan Board requesting that action in this matter be deferred until the petitions could be considered by that Board was read. Don Norman was present and stated he favored closing the street. After consideration, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the petitions and other applicable information be referred to the Plan Board for their consideration and recommendations and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Petition to Abandon Maintenance District No. 6 I A petition representing 47% of the property in Parking Maintenance District No.6, Willson Avenue from Babcock to College Street, requesting that said Maintenance District be abandoned, was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Attorney be instructed to prepare a resolution of intention to abandon this district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water Improvement Project - Board of Arbitration A letter, dated November 1, 1958, from the Statewide Plumbing & Hmting Co., Inc., was read. This was in reply to a letter written to them on October 23, 1958 by City Manager Henderson, at the direction of the City Commission, to again offer them $5,000.00 in full settlement of claims in the amount of $27,914.37 which they had presented a~inst this City on July 23, 1958. Their letter now requests that settlement of these claims be submitted to a Board of Arbitration as provided for in the specifications of the water ~stem Improvement Project. The,y advise that they have picked their member for such a Board and request that the City do likewise. The City Manager was instructed to inform Statewide Plumbing & Heating Company that a member will I be chosen by the City at the earliest possible date. Tag Day - Association for Retarded Children A request from the Association for Retarded Children to have a Tag Day on November 29th, 1958 was read. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Right-of-way Easement - Th.ompson Hereford Ranches, Ine., Hya1:i.te View Water Line A right-of-WlY easement from Thompson Hereford Ranches, Inc. for the water main to s'erve the H,'valite 4 View Sub-division was presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the easement be approved and accepted, and the motion was carried by the following Ave and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Driveways for Kenyon-Noble Lumber Co. A request for driveways for Kenyon-Noble Lumber Company for their property at the corner of Mendenhall and Black Avenue was presented and read. They request a twenty-foot driveway on Black Avenue and two drive- ways on Mendenhall, one to be thirty-six feet wide and the other twenty feet wide. '. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the request be granted and the motion was carried by the following Aye and No vote: those voting ~ve being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Reports The following reports for the month of October, 1958 were presented: Fire Chief Sewage Plant Operator librarian Police Chief and the report of the Director of Finance for the month of September, 1958. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Radio Units for Superintendents' Cars Need for radio units in cars of Superintendents in various departments of this City was discussed. Estimated cost of such equipment is $4,029.00. Since these vehicles would become an important part of "Civil Defense" equipment of this City in the event of any general emergency, it is possible that the Federal Civil Defense Administration will participate in the cost of such radio equipment to the extent I of 50%. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that Mayor Erwin be authorized to submit an application to the Federal Civil Defense Administration, through the State Director of Civil Defense, for them to participate to the extent of 50% in the purchase of radio equipment for emergency vehicles, the total estimated cost of such equipment being $4,029.00 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Claims for the Month Claims Nos. 3003 to 3274 inclusive were presented on the van.ous funds as follows: General ------------- 15,319.32 street -------------- 6,042.95 Water -------------- 13,664.32 S.D.S. D. ------------ 12,938.58 Total ==== $71,659.04 The Manager stated he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail by the City Qommission and checking against the Claim Register, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants issued for their payment and the motion was carried by the following Aye and No vote: those voting Aye being . ;) Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
