The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, December 3, 1958, at 1:00 o'clock P. M. Present were Mayor Erwin,
Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk.
The following proceedings were had:
I Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded
by Commissioner Berg, that the minutes be approved as read and the motion was carried by the followin~
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Proposed Platting Block D - Harwyn Re-arrangement
Dr. R. A. Williams was present and presented a proposed re-arrangement of Block D of the Marwyn
Re-arrangement. The proposed plat was referred to the Plan Board for recommendations.
This proposed platting would abandon the baseball field known as "Williams Field". Dr. Williams
stated that the lack of interest in baseball and the year~y maintenance cost had influenced him in
deciding to put this ground to another use. Possible means of retaining "Williams Field" were discussed,
and it was thought advisable to bring the matter to the attention of the Recreation Board, Montana State
College, and other civic organizations.

Claims Nos. 3275 to 3548 inclusive were presented on the various funds as follows:

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommended that warrants be issued for their payment. After examina-
tion of the claims in detail by the Commission and checking against the Claim Register, it was moved
by Commissioner Swanson, seconded by Commissioner Berg, that the claims be approved and warrants drawn
for their payment and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Heports
The following reports for the month of November, 1958 were presented:

It was moved by COmrrO.ssioner Berg, seconded by Commissioner Swanson, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Planning - Approval of Area of Jurisdiction and Road Net Maps
A map of the "area of jurisdiction" and a map of the "road and street netn which are parts of the
"Master Plan" of this City being prepared by S. R. DeBoer & Company, Planning Consultants, were
presented. A public hearing was held before the City-County Planning Board on November 10, 1958 at

whicn thes-e phases of planning were presented. There having been no specific protests against these
proposals, the maps were recommended by the said Planning Board for approval by the City Conunission
of Bozeman and the County Conunissioners of Gallatin County.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, subject to their
continuous revision as changing conditions may necessitate, these maps as presented be approved and
the motion was carried by the following Aye and No vote: those voting ~ye being Mayor Erwin, I
Conunissioner Swanson and Commissioner Berg; those voting No, none.
Abandoning Parking Maintenance on South Eig,hth Avenue -
A petition to abandon Parking M3.intenance District No. 45, on South Eighth Avenue from Koch Street
to Dickerson Street, was presented. The Commission has previously received a petition to abandon
Parking Maintenance No. 4S, (South Eighth Avenue from Main Street to Koch Street). This would leave
only Parking Maintenance District No. 77, (South Eighth Avenue from Dickerson to Harrison Street) to
be maintained by the City. The City Commission deemed it to the best interest of the City to declare
their intention to also abandon District 77. It was moved by Commissioner Swanson, seconded by
Commissioner Berg, that the City Attorney be instructed to prepare resolutions of intention to abandon
Parking Maintenance Districts No. 45, 48 and 77, and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
Resolution No. 936 - Certifying Delinquent Taxes
Resolution No. 936 certifying delinquent taxes in the amount of $10,745.S2 to the County Treasurer
was presented, entitled:

It was moved by commissioner Swanson, seconded by Commissioner Berg, that the resolution be p~ssed

It was moved by Commissioner Berp, se~onded by Commissioner Swanson, that the applications be
approved and the Director of Finance be authorized to enter the tax abatements on the tax records, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Swanson and Commissioner Berr'; those voting No, none.
Water System Improv~nent Project - Completion of Haggerty-Messmer Contract
A communication from Morrison-:t-1aierle, Inc., was read recommendint"' that, to establish date of
acceptance and date of beginning of the guarantee neriod for the construction work of Haggerty-Messmer 1~3
Company on the water 3,ystem Improvement Project, a letter of acceptance be written to them to make
record of acceptance of their work under all phases of their contract on this project as of September
10, 1958. The construction work of Haggerty-Messmer Company covers the following phases and schedules
of the project:
Reservoir (Phase I, Schedule I)
.1 Booster Station (Phase I, Schedule III)
Improvements on LYman Creek Reservoir (Phase I, Schedule IV)
Pre-sedimentation Basin (Phase II, Schedule III)
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the date of acceptance
and the date for the beginning of the guarantee period on the above described contract be set as of
September 10th, 1958, and that the City Manager be authorized and instructed to so notify Haggerty-
Messmer Co., and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
