The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, December 10, 1958, at 1:00 o'clock P. M. Present were Mayor Erwin,
Commissioner Swanson, Commissioner Berg, City Manager Henderson and the Clerk. The following proceed-
ings were had:
Minutes of the last regular session were read and it was moved by Commissioner Berg, seconded I
by Commissioner Swanson, that the minutes be approved as read and the motion was carried by the
following Aye and No vote: those voting AYe being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Communication - Montana Flour Mills - M:acAdow "Mill" Ditch
A communication was read from the Montana Flour Mills, stating that it was their intention to
stop the flow of water in the nMill Ditch".
Heports
The following reports for the month of November, 1958 were presented:
Sanita~ Inspector - Cemete~ Board - Cashier - Wa ter Collector
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be
accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Water Improvement Project - Final Estimate of Haggerty-Messmer Company
Final estimate for construction work done by Haggerty-Messmer on the Water Improvement Project,
as prepared and recommended for payment by Morrison and Maierle, Inc., in the amount of $4,888.17,
was presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that this be I
accepted as the final estimate on the contract of Haggerty-Messmer Co. and that their claim be
approved and warrant issued for its payment and the motion was carried by the following A,ye and No
vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
Proposed Contract with Yellowstone Pine Company
The proposed contract with the Yel]owstone Pine Company regarding construction of a pioneer
road to MYstic Izke and harvesting timber from city owned land in the Bozeman Creek watershed was
presented to the Commission for review.
Hesolution No. 937 - Intention to Abandon Parking }'faintenance District No. 45
The City Attorney as instructed has prepared the resolution of intention to abandon Parkin~
Maintenance District No. 45, and Resolution No. 937 was presented, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE
INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 45
AND TO ABA~mON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CLERK OF
THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT TO THE STATUTES IN SUCH
CASES MADE AND PROVIDED.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reso]~tion be
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye I

The City Attorney as instructed has prepared the resolution of intention to abandon Parking
Maintenance District No. 48, Resolution No. 398 was presented, entitled:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE
THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT
NO. 48 AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be

Resolution No. 939 - Intention to Abandon Parking Maintenance District No. 77
The City Attorney as instructed has prepared the resolution of intention to abandon Parking
Maintenance District No. 77. Resolution No. 939 was presented, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE
THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT
NO. 77 AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE
CLERK OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT TO THE
STATUTES IN SUCH CASES MADE AND PROVIDED.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the resolution be
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Encroachment Permit for Eagles Lodge Fire Escape
An Encroachment Permit to the Eagles Lodge No. 326 to maintain a fire escape and cement deck
for garbage cans at the rear of their present building at 316 E. Main Street was presented. The
permit was approved as to form by the City Attorney. It was moved by Commissioner Berg, seconded by
Commissioner Swanson, that the Encroachment Permit be approved and the Mayor and the Clerk of the
Commission be authorized to sign the permit for the City of Bozeman and the motion was carried by the
I following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Ave being Mayor Erwin, Commission Swanson
and Commissioner Berg; those voting No, none.
