The Commission of The City of Bozeman met in regular session in the Conunission Room, City Hall
Building, Wednesday afternoon, December 24, 1958, at 1:00 o'olook P. :M. Present were Mayor Erwin,
Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attomey Lovelaoe and the Clerk.
The following prooeedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Berg, seoonded I
by Cononissioner Swanson, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Hearing Abandoning of Parking Maintenance District No. 45
Resolution No. 940 - Abandoning Distriot No. 45
This is the time and place set for hearing on abandoning Parking Maintenanoe District No. 45.

Affidavit of publication of Notioe was presented. No one was present to protest and no protests have
been filed. Resolution No. 940, abandoning said district, was presented entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, ABANDONING CITY OF BOZEMAN
SPECIAL IMPROvnmlT DISTRICT NO. 45 AND ABANDONING THE MAINTDUNCE OF STREET PARKINGS
THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PURSUANT TO
AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 937 AS PASSED AND ADOPTED BY SAID CITY
COMMISSION ON THE 10TH DAY OF DECDmER A. D. 1958.
It was moved by Commissioner Swanson, seoonded by Oommissioner Berg, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.

Resolution No. 941 - Abandoning District No. 48
This is the time and plaoe set for hearing on abandoning Parldng Maintenance District No. 48. I

Hearing - Abandoning Parking Maintenance District No. 77
Resolution No. 942 - Abandoning District No. 77
This is the time and place set for hearing on abandoning Parldng Maintenance Distriot No. 77.

Bids for C~pper Pipe
Need for copper pipe for use in the Water Department was reported. It was moved by Commissioner
Swanson, seoonded by Commissioner Berg, that the Clerk of the Commission be authorized to advertise for
bids for 9700 feet of 3/4" pipe and 300 feet of 1" pipe, and the motion was carried by the following

Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
those voting No, none.
Contract - Yellowstone Pine Road Construction & Timber Sale
The City Manager advieed the Commission that the final draft of the proposed Road Construction
and Timber Sale Contract between the City and Yellow tone Pine had been approved and executed by the
I proper and authorized officials of Yellowtone Pine and that the same had been approved by the City
Engineer, the City Attorney and himself, and that it was in order for the same to be executed by the
Mayor and Clerk of the Commission. In accordance with the understanding of the parties to this
contract, the City has agreed to sell a ma:x1mlDll of 10 million board feet of commercial saw timber from
city-owned lands at a price of $4.00 per thousand board feet with the Company being granted 10 years,
with an option for an add! tional five years, to remove said timber and the Company to build a road
into the area, at their expense, said expense to be paid for in timber at the contract rate. Discussion
of the contract was had by the Commission, and upon motion by Commissioner Berg, seconded ~
Commissioner Swanson, it was moved that the oontract be approved and that the M9.yor and Clerk of the
City Commission be authorized to execute the same for and on behalf of the City, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Report
Report of the Director of Finance for the month of November, 1958 was presented. It was moved
by Commissioner Swanson, seconded by Oammiesioner Berg, that the report be accepted and ordered filed
and the motion was carried by the follow.i.ng Aye and No vote: those voting 'Aye being Mayor Erwin,
I Commissioner Swanson and Commissianer Berg; those voting No, none.
Licenses - Beer & Liquor
The following applications for Beer and Liquor Licenses for 19'9 were presented:

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the applications be
approved and the licenses issued and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Bids for Bridge Across Bozeman Creek - Alley in Block C, Original Townsite
The City Engineer presented estimates of cost and specifications for construction of a bridge
across Bozeman Creek in the alley in Block C, Original Townsite. It was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the Clerk of the Commission be authorized to advertise for bids
for this bridge and the motion was carried by the following Aye and No vote: those voting Aye being

Assistant Fire Chief Fisher on Sick Leave
A conununication from the Fire Chief was read stating that Assistant Fire Chief Homer Fisher was
being placed on sick leave on written recommendation of his physician and that his disability may be
permanent.

The Mayor announced the following appointments as City members to the City-County Plan Board:

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the appointments be

Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Berg, that the meeting adjourn and the motion was I
