MINUTES OF THE MEETING OF THE CITY COMMISSION
Bozeman, Montgna
July 29, 1964
The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, July 29th, 1964 at 1:00 o'clock P.M. Present were Acting Mayor Sedivy, Commissioner
Langohr, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Langohr,
seconded by Acting Mayor Sedivy, that the minutes as read be approved and the motion was carried by
the following Aye and No vote. Those voting Aye being Acting Mayor Sedivy and Commissioner Langohr,
those voting no, none.
Bids for S.I.D., Nos. 439 & 440
This was the time and place set for the opening of bids for construction of the improvements
scheduled for Special Improvement District No. 439 and for Special Improvement District No. 440. The
affidavit of publication of f1Notice to Bidders" was presented and it was moved by Acting Mayor Sedivy,
seconded by Commissioner Langohr, that the bids on file on Special Improvement District No. 439 and
Special Improvement District No. 440 be opened and read and the motion was carried by the following
Aye and No vote. Those voting Aye being Acting Mayor Sedivy and Corrnnissioner Langohr, those voting
No, none.
The bids for Special Improvement District No. 439 were opened and read as follows:

Following the recommendation of the City Manager, the bids were referred to the engineering con-
sultant firm retained by the City for the districts and the City Engineer to check the bids in detail,
to prepare the final tabulations and to ascertain the lowest and best bid for the construction of the
improvements for each district.

It was reported by the Director of Finance that approximately $26,000.00 of SDS funds of the City
currently invested are to mature in the near future and he requested authority to re-invest the sum
in U.S. Treasury bills for a period of ISO days. The City Manager concurred in the request and it
was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, that the re-investment as requested
be approved and the motion was carried by the following Aye and No vote, those voting Aye being
Acting Mayor Seidivy and Commissioner Langohr those voting No, none.

Authority to Pave Southside Park Tennis Courts -- Lump sum Moo.oo
The City Manager reqorted that Pioneer Ready Mix, Bozeman, had agreed to pl"lce a l~" asphalt
mix half-sole on the tennis courts located in the Southside Park for a lump sum total of $gOO.(U,

and requested that he be authorized to notify Pioneer Ready Mix to proceed with the improvement.
It was moved by Acting Mayor Sedivy, seconded by Corrunissioner Langohr, that the improvement as
stipulated he Clpproved and the motion was carried by the following Aye and No vote, those voting
Aye being Acting Mayor Sedivy, and Corrunissioner Langohr, those voting No, none.
Appropriation Ordinance No. 848 -- Provisionally Passed
The City Manager reviewed the proposed budget for the, fiscal year ending June 30th, 1965,
and Ordinance No. 848 was presented, entitled:
ORDINANCE NO. 848
AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE
WITH THE BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF
THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th, 1965.
It was moved by Corrunissioner Langohr, seconded by Acting Mayor Sedivy, that the Ordiance
be provisionally adopted and August 5th, 1964, be set as the date for public hearing and the motion
was carried by the following Aye and No vote, those voting Aye being Acting Mayor Sedivy and Corrun-
issioner Langohr, those voting No, none.
App_covalof Plat -- Westlake's Second Subdivision
The palt of Westlake's Second Subdivison was presented and it was reported the Bozeman City-

County Planning Board had approved the plat on July 6, 1964, and that provision for park areas
as approved by the Park Recreation Board had been provided as indicated on the plat. After
discussion, it was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, that the plat
be accepted and approved and the City Manager be directed to sign the plat as Director of Public
Service for the City. The motion was carried by the following Aye and No vote, those voting
Aye being Acting Mayor Sedivy and Commission Langohr, those voting no, none.
"JC" Hequest -- Declare August 2-8, as "'d'estern Week"
It was moved by Acting Mayor Sedivy, seconded by Corrunissioner Langohr, that the "JC's" request
that the City of Bozenan declare the week of August 2-8, 1964, as "Western Week" in conjunction
with the "JC"Rodeo be approved and the motion was carried by the following Aye and No vote, those
voting Aye being Acting Mayor Sedivy and Conunissioner Langohr, those voting No, none.
Hesolution of Purchase of Road Oil
A resolution authorizing the City Manager to purchClse not to exceed 25,000 gallons of road

oil during the fiscal year July 1, 1964 to <Tune 30, 1965, for use by the Street department in
repairing pavement and for sealing certain sections of existing pavement within the City from the
Montana State Highway Department was presented ws follows:
WHEREAS the City of Bozeman will rave need during the fiscal year, July 1, 1964-June 30,
1965, for road oils for use in repairing streets and for sealing certain sections of
existing pavements within the City, and

WHEREAS the City of Bozeman does not have proper facilities for handling and storing the needed
quantities of oils and
WHEREAS The Montana State Highway Department does have quantities of the required types of
oils stored in Bozeman from which it can supply the quantities needed for the City of
Bozeman,
NOW, THEREFORE, BE IT RESOLVED:
That an emergency does exist relative to the procurement of road oils by the City
Manager is hereby authorized to purchase stocks in storage in Bozeman, approximately
twenty-five thousand (25,000) gallons of road oil, this to be purchased from time to time
during the fiscal year, July 1, 1964 - June 30, 1965, as needed by the City of Bozeman
for repair and sealing of existing pavements, and these quantities of road oils to be
purchased at cost plus normal handling charges.
Passed and adopted by the City Commission of Bozeman, Montana, at a regular meeting
of said Commission held on the 29th day of July, 1964.

It was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, that the resolution
be passed and adopted and the motion was carried by the following Aye and No vote, those voting
Aye being Acting Mayor Sedivy and Commissioner Langohr, those voting No, none.
SID No. 439 -- Award of Contract
The engineers having completed their check of the extensions and final tabulation of all
bids submitted, recommended that Utility Builders, Inc., Great Falls, Montana, be awarded the
contract for the construction of the sewer mains in Special Improvement District No. 439, on
the basis of the firmt bid of $l3,73Z.00 as being the lowest and best bid submitted. It was
moved by Acting Mayor Sedivy, seconded by Commissioner Langohr, that, subject to the sale of the
bonds of the district, Utility Builders, Inc. be awarded the contract for the construction in
Special Improvement District No. 439 as recommended on the basis of its low bid of $13,732.00,
and the bid security of the unseccessful bidder be returned. The motion was carried by the
following Aye and No vote, those voting Aye being Acting Mayor Sedivy and Commissioner Langohr,
those voting No, none.
SID No. 1+40 -- Award of ConLrc'lct
The engineers having completed their check of the extensions and final tabulations of all
bids submitted, recommended that Utility Builders, Inc., Great Falls, Montana, be awarded the con-
tract for the construction of the water mains in Special Improvement District No. 440, on the
basis of the firm's bid of $15,144.25 as being the lowest and best bid submitted. It was moved
by Commissioner Langohr, seconded by Acting Mayor Sedivy, that, subject to the sale of the
bonds of the district, Utility Builders, Inc. be awarded the contract for the construction in
Special Improvement District No. 440 as recommended on the basis of its low bid of $15,144.25,
and the bid security of the unsuccessful bidder be returned. The motion was carried by the
following Aye and No vote, those voting Aye being Acting Mayor Sedivy and Commissioner Langohr
those voting No, none.

There being no further business to come before the Commission at this time it was moved by
Acting Mayor Sedivy, seconded by Commissioner Langohr that the meeting adjourn. The motion
