The Commission of The City of Bozeman met in regular session in the
Commis s ion Room, City Ha 11 Building, Wednesda y, June 10 th, 1964 at 1: 00
o'cLock p.m. Present were Mayor Morrow, Commissioner Sedivy, City Manager
Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk.
Mayor Morrow opened the meeting with a prayer and the following pro-
ceedings were had:
Minutes of the last regular session were read and it was moved by
Commissioner Sedivy, seconded by Mayor Morrow, that the minutes as read be
approved and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Morrow and Commissioner Sedivy; those voting No, none.
Approval of Plat and Acceptance of Deed
Graf's Second Subdivision
The plat of Graf's Second Subdivision was presented. A deed to the City
of 2.71 acres of land bordering on High~Bnd Drive in lieu of the owner of the
property dedicatinIT an area within the addition for park puposes also accompanied
the plat. It was reported the plat had been approved by the City-County
PlanninF~ Board on March 2, 1964. After discus8ion, it was moved by Mayor
Morrow, seconded by Commissioner Sedivy, that, subject to the platter's addition
of a proper certificote making reference to provision for park areas and sub-
mission of evidence of ownership, the Mayor and the Commission sign the Certi-
ficate of Approval of annexation as provided in Section Ll-4Ul, RCM, 1947,
and the City Manager as Director of l"ubLic Service be authorized to sign the
certificate of approval of the pLat for the City. The motion was carried by
the following Aye and No vote: those voting Aye being Mayor Morrok and
Commissioner Sedivy; those voting No, none.
Canvass Vote
City Special Election (Municipal Building Facility)
(June 2, 1964)
In conformity with Section lL-23~2, Revised Codes of Montana, the Clerk
of the City Commission presented the ret11rns of the special election held in
and for the City on June 2, 1964, to vote upon the question of issuing bonds
of the City, together with proofS of the due call, notices and holding of said
election, all of which were examined, approved and ordered fiLed.
Thereupon Commissioner Sedivy introduced the following resolution and
moved its adoption:
RESOLUTION NO. 1122
BE IT RESOL \TED by the City Commi ss ion of 'l'he Ci ty of Bozeman, iV!on tans,
as fOllows:
1. This Commission does hereby find, determine and decLare
that the special eLection held in and for said Ci ty on June 2, 1964,
to vote upon the question of issuing city municipal building bonds
was in all respect8 duly and legally called, he~d and conducted, and
returns thereof have been made and filed in accordance with law.
2. That al~, but only, the duly re~istered electors
of said City whose names appear upon the last completed. assessment
roll for stDte and county taxe~' as taxpayers upon property within
the City were permitted to vote thereat, and that the total of the
votf~s cast on the bond cnlostion or proposItion submitted at said
e~ection was as follows:

3. The question of issuing said bonds is hereby declared
to have carried by more than the reouisi te ma jori ty, and this
Commission is hereby authorized to proce,c,d, and shall proceed, with
the issuance of said bonds.

this 10th day of June, 1964.

The motion for the adoption of the foregoing resohltion was duly seconded
by Mayor Morrow, and upon vote being taken thereon, the fOllowing voted Aye:
Mayor Morrow and Commissioner Sedivy
and the fOlloWing voted NO: None.
whereupon said resolution was decLared duly passed by a majority of the
whole number of members of the Commission, and the Mayor being present affixed
his signature thereto in approval thereof and the CLerk of the City Comrrission
attested his signature thereto.
Absence of Comm;ssioner Langohr
It was reported that Commissioner Langohr's absence from the meeting was
due to the death of a member of his famiLY. In compliance with Section

2.U8.U6U of the Bozeman Municipal Code, it was moved by Mayor Morrow, seconded
by Commissioner Sedivy, that ComMissioner Langohr's absence be authorlzed and
the motion was carried by the fOllowing Aye and No vote: those voting Aye
being Mayor Morrow and Commissioner Sedivy; those voting No, none.
Tri-County Je's - Three Forks Rodeo (Ticket Bonth, ~lne 20th)
It was reported that tbe Tri-CouY';ty ,TC's of 'I'hree }'orks, Montana, had
renuested permission to conduct an advance sale of ticket2. on ,Ttlne 2uth, at
a location on Main Street, on a pony to be given away during its rodeo to be
held ,J1Jly 18th and 19th a t Three Forks. In concurr'ence wi th the recommenda tion
of the City Manager that, a suitabLe location be first approved by the police
and the property owner, it was moved by Commissioner Sedivy, seconded by
Ma yor Morrow, tha tau thoriza tion to condue t the sale be D;ran ted as reques ted.
The motion was carried by the following Aye and No vote: those voting Aye
being Mayor Morrow, and 00mmissioner Sedivy; those voting Nc), none.
Request
Lions' Club Sponsorship of Carnival

It was reported the Lions' Club had requested permission to sponsor the
Inland Empire Shows at the fair gro'tmds during ,July 7-11, incLusive, and it
was moved by Mayor HIorrow, seconded by Commissioner Sedivy, that, in view of
the fact that net proceeds of the club's share of the proceeds of the Show
will be donated to charitable purposes, the normal license fee would be
reauired for the carnival with the understDnding that 2b% WOll1d be subject to
reflmd to the club when it is ascertained the area used by the show is cleaned
in a satisfactory manner and the cLub to bear the expenS8S of the special

vote: those voting Aye being Mayor Morrow and Commissioner Sedivy; those

Plans & Specifications SID Nos. 437 and 438
The individual plans and specifications coverjng the proposed improve-
ments in SpeciaL Improvement District No. 437 and Special Improvement District
No. 438 prepared by Harold Hoskins and Associates, supervising engineers, were
placed before the Commission. rlbe Ci ty Manager and the Ci ty Engineer recom-
mended that the plans and specifications, as presented, be approved. It was
moved by Commissioner Sedivy, seconded by Mayor Morrow, that the Commission
approve the plans and specifications and the C1.erk of the Commission directed
to publish a "Call for Bids" for the construction of the improi'ements of each
district for an opening da te of .July 1., 1.964. rl'he motion w as carried by the
foll.owing Aye and No vote: those voting Aye being Mayor Morrow and Commis-
sioner Sedivy; those voting No, none.
Bonds for Special Improvement District Nos. 437 and 438
Bonds of Special Improvement District No. 437 and Special Improvement
District No. 438 must be sold to provide for the financing of the proposed
construction of the projects. It was moved by Mayor Morrow, seconded by
Commiss ioner Sedivy, tha t the Clerk of the Comrrission be direc ted to advertise
for bids for the sale of the bonds of Special Improvemen t Dis tric t No. 437 in
the amount of &P8b,OOu.uu and for Special Improvement District No. 43b in the
amount of $11,OUO.00, to be received .JuLY H, L904. 'the motion was carried by
the folLOWing Aye and No vote: those voting Aye being Mayor l'vlorrow and

License Bond Mannix Electr~c, Inc. (Electrical)
In compliciTIce w:i th Chapter L5 of the Bozeman Municipal Code, the elec trl-
cal bond of Mannix Electric, Inc., Bozeman, was presented. The City Manager
stated the BuLlding Inspector bad recommended apyrovaL of the bond and the
Ci ty Attorney hlold approved it as to form. It was moved by Commissioner Sedivy,
seconded by Mayor Morrow, that the bond be approved and the motion was carried
by the fOLlOWing Aye and No vote: those vo'cing Aye being Mayor Morrow and
Commissioner Sedivy; those voting No, none.
License Bond Ben Hespen (Electrical)
In compliance wi th i...-hapter 15 of the Bozeman l~!unic ip8 1 Code, the e le c tri-
cal bond of Ben tlespen, Bel-grade, Montana, was presented. The City Manager
stated the Building Inspector had recommended approval of the bond and the
City Attorney had approved it as to form. It was moved by Mayor Morrow,
seconded by CommissIoner Sedivy, that the bond be approved and the motion was
carried by the foll.owing Aye and No vote: those voting Aye being Mayor
Morrow and Commissioner Sedivy; those voting No, none.

Police Chief Saunders to Idaho Police Academy
It was reported tha t :Chief of .Police Vern s,aunders nad been reques ted
to appear at the Idaho Police Academy, to be held in .Pocatello, 1daho, June
21-23, as a gues t lec turer. In concnrY'ence wi th the recommenda tion of the
City Manager, it was moved by Mayor Morrow, seconded by Commissioner Sedivy,
that Chief 0aunders be authorized to attend the academy and that, it being
in the public interest, his expenses be paid from the General fund. 'I'he
motion was carried by the following Aye and No votel those voting Aye being

American Muncipa 1 As socia tion Con~Ten tion
Miami Beach, Florida
It was announced that the American Municipal Association has scheduled
its convention to be held in Miami Beach, Florida, J'uly 25-29, and the City

Manager recommended that Mayor Morrow be delegated to represent the City.
It was moved by Commissioner Sedi vy, seconded by Mayor Morrow, tha t Mayor
Morrow be authorized to attend the meeting and, it being in the pubLic interest,
the expenses incurred be charged to the General fund. ~he motion was carried

approved, an application for federal participation in the change order be
approved and the Mayor and the Clerk of the Commission be authorized and

Additional Claims for May
The following claims Nos. 103U8 to 10344, inclusive, were presented on
the various funds as follows:
The City Manager commented on the claims and stated he had audited them
and fOlJnd them to be true and lawful claims against the City of Bozeman and
recommended that they be approved and the Director of Finance directed to
issue warrants in payment. After examination of the claims in detail and
checking against the claim register, it was moved by Commlssioner SediVY,
seconded by Mayor Morrow, that all claims as presented be approved and the
motion was carried by the following Aye and No vote: those vo;;ng Aye being
Mayor Morrow and Commissioner Sedivy; those voting No, none.
