The Commission of The City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, JUly 1st, l~64 at l:OU o'clock
p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City
Manager Cutting, Ass't. City Manager Fryslle, City Attorney Berg and the Clerk.
Mayor Morrow opened the meeting with a prayer and the fOLlowing proceed-
ings were had:
Minutes of tne last regular session were read and it was moved by Commis-
sioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved
as read and the motion was carried by the fOilowing Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr;
those voting No, none.
Bids for S.I.D., No. 437
This was the time and place set for the opening of bids for construction of
the improvements scheduled for Special Improvement D:1strict No. 437. The aff:1davlt
of pubLication of "Notice to Bidders" was presented.
It Was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that
the bids on file on SpeciaL Improvement District No. 437 be opened and read and
the motion was carried by the fOllowing Aye and No vote: those voting Aye being
Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting
No, none.
The bids were then opened and read as follows:

Following the recommendation of the C:1ty Manager, the bids were referred to
the engineering consultant firm retained by the City for the district and the City
Engineer to check the bids in detail, to prepare the fimu tabuia tions and to
ascertain the lowest and best bid for the construction of the improvements.

This Was the time and place set for the opening of bids for construction
of the improvements schedULed for Special Improvement District No. 438. The
affidavit of publication of nNotice to Bidders" was presented.

Municipal League Meeting
It was reported the Montana Municipal League has scheduled a meeting of its
Executive and its LegiSLative Committees to be held in Helena, July 2nd, and it
was requested that Mayor Morrow and City Manager Cutting as respective members
of those committees be authorized to attend the meetings. It was moved by
Commissioner SediVY, secondep. by Commissioner Langohr, that the authorization to
attend the meetin!!s be approved and, it being in the publiC interest, the expenses
incurred be paid from the GeneraL fund. The 1't'otion was carried by the fO,uowlng
Aye and No vote: those voting Aye being Mayor Morrow, Connnlssioner Sedivy tind
Commissioner Langohr; those voting No, none.
Resolution No. 1127 (Au thoriz :tnr Sa Ie of Bonds for W:unicipal Building Facility)
The City Manager presented a form of notice of sale of Municipal. BuiLding
Bonds which was examined and approved, and ordered pLaced on file with the Clerk
of the Commission.
Commissioner Langohr introduced the fOLLowing resolution and moved its
adoption:
RESOLUTION NO. 1127
BE IT RESOLVED by the City Commission of The City of Bozeman,
Montana, thHt the City issue its $475,uvU Municipal Building Bonds in
accordance with authority conferred by the voters at the Special City
Election heLd June 2, 1964. Said bonds shall be issued for the purpose
of erecting, furnishing and equipping a municipal bui~ding facility
to house city administrative offices and the police and fire department,
shall bear interest at the maximum rate of 6% per annum, Sha~L be dated
as of the 1st day of July or January next preceding their date of
deLivery, and shaLL be payabLe over a period of 2u years. They may be
redeemed in full, at the option of the City, on any interest payment
date from and after LV years from the date of issue. They shall be
executed by the signatures of the Mayor and the Director of Finance,
attest~d by the Clerk of the Commission, and sealed with the official.
corporHte seal of the City, and the appurtenant coupons shall be

executed by printed or lithographed facsimi~es of the signatures of
the same officers. Preference shall be given to amortization bonds,
but in case it shall be found advantageous to issue bonds in serial
form, they shall be in the denomination of $L,UUU e~ch. The form of
notice of sale of said bonds on file with the Clerk of the Commis-
sion is hereby adopted.

BE IT FURTHER RESOLVED that it is inadvisable to proceed
immediateLY with the sale of said bonds, and the date, time and place
of sale shall therefore be fixed by further resolution of this
Commission.
The motion for the adoption of the foregoing resolution was duly seconded
by Commissioner Sedivy, and upon vote being taken thereon, the fOllowing voted
Aye: Mayor Morrow, Connnissioner Langohr and Commissioner Sedivy and the fOllow-
ing voted NO: ~
Whereupon said resolution was declared duly passed by a majority of the whole
number of members of the Commission, and the Mayor being present affixed his
signature thereto in approval thereof and the CLerk of the City Commission
attested his signature thereto.
Investment of City Water FUnds
It was reported by the Director of Finance that approximately $5u,uuO.uO
of City Water funds currentlY invested are to mature in the near future and an
additionaL $25,vuO.uv has become availabLe for investment and he requested
authority to invest the total sum of approximately $75,ouu.uv in shorty-term
U.S. Treasury billa for a period of 180 days, or six months. The City Manager
concurred in the request and it was moved by Commissioner Sedivy, seconded by
Commissioner Langohr, that the investment as requested be approved and the
motion was carried by the fOLlOWing Aye and No vote: those voting Aye being

SID No. 437
Award of Contract
The eng'neers h~ving compLeted their check of the extensions and final
tabuLation of all bids submitted, re~ommended that Utility Builders, Inc.,
Great FaLLS, Montana, be awarded the contract for the construction of the water
mains in Special Improvement District No. 437, on the basis of the firm's bid
of $71,982.69 as being the lowest and best bid submitted. It was moved by
Commissioner Langohr, seconded by Commissioner SediVY, that, subject to the sale
of the bonds of the district, UtiLity Builders, Inc. be awarded the contract for

the construction in Special Improvement District No. 437 as recommended on the
basis of its low bid of $71,982.69, and the bid security of the unsuccessful
bidders be returned. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Morrow, CommiSSioner Langohr and Commissioner
Sedivy; those voting No, none.
SID No. 438
Award of Contract

The engineers having completed their check of the ex~ensions and finsl
tabulation of a.U bids submitted, recommended thatUti:Lity Builders, Inc.,
Great Falls, Montana, be awarded the contract for the construction of the sewer
mains in Special Improvement District No. 438, on th~t.-basis of the firm's bid
of $e,l4u.6i as being the lowest and best bid submitted. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that, subject to the sale
of the bonds of the district, Utility BUilders, Inc. be awarded the contract for

the construction in SpeciaL Improvement District No. 438 as recommended on
the basis of its low bid of $ti,l4v.6l, and the bid seourity of the unsuccess.

Adjournment
There being no further business to come before the Commission at this
