The Commission of The City of Bozeman met in reguLar session in the Commis-
sion Room, City HaLl BUiLding, Wednesday, JULY 8, L\:I64 at l:vu O'CLOCk p.m.
Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City
Man~ger Cutting, Ass't. City Manager FrysLie, City Attvrney Berg and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the fOllowing
proceedings were had:
Minutes of the SpeciaL Meeting of June 29th, the Special Meeting of
June 30th, and the regular meeting held JUly L, L964 were read and it was moved
by Commissioner Langohr, seconded by Commissioner Sedivy, that the minutes as
read be ~pproved and the motion was carried by the fOllowing Aye and No vote:
those voting Aye being Mayor Morrow, CommiSSioner Langohr and Commissioner
Sedivy; those voting No, none.
Corcoran's Rearrangment of Blocks 3, 4, 5 & 6, West Side Addition
The proposed pLat of Corcoran's Rearrangement of BLocks 3, 4, b & 6 of the
West Side Addition was pLaced before the Commission for consideration. A letter
from the Bozeman City-County ~J.anning Board stated that Board had approved the
plat as of July 6, 1964, but recommended that an examination be made for the
need for cul-de-sacs at tne dead-ends of the streets and avenues of the pL~t.
After discussion and in concurrence witil the recommendation of the City N~nager,
it Was moved by Commissioner Sedivy, seconded by CommiSSioner Langohr, that the
plat be accepted and approved, the City Manager be directed to sign the plat as
the Director of Public Service and the requirement for turn-arounds be waived.
The motion was carried by the fOllOWing Aye and No vote: those voting Aye being
Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting
No, none.
Sale of Bonds
Special Improvement District No. 437
This was the time and place set for the BaJ.e of bonds of Special Improve-
ment District No. 437. The affidavit of publication of notice of sale of the
bonds was presented.
The City Manager stated that bonds of Special Improvement Distict No. 437
would be sold in the total amount of $85,UOO.uu, and the bonds WOuLd be dated
August L, L964.
It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that
the City proceed with the sale of the bonds and the motion was carried by the
fOllowing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner
Langohr and Commissioner Sedivy; those voting No, none.
The foLLOWing bidders who appeared to bid oraLly on the issue qualified
by deposi ting with the Clerk of the Commission the necessary bid securi ty:

Following the recommendation of the Director of Finance, concurred in by
the Cl ty Manager, it was moved by Commissioner Sedi vy, seconded by Commissioner
Langohr, that the bid of the security Bank & Trust Co., Bozeman, Montana, being
the lowest and best bid submitted, the sale of the bonds be awarded to the
Security Bank & Trust Company, and the bid security of the unsuccessful bidders
be returned. The motion was carried by the fOLlowing Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr;
those voting No, none.
Sale of Bonds of Special Improvement District No. 438
This was the time and pl.ace set for the saLe of bonds of Special. Improve-
ment District No. 438. Affidavit of publication of noti~e of saLe of the bonds
was presented.
The City Manager stated that bonds of Special improvement District No. 438
would be sold in the totl:l.L amount of ~l.v,UUO.uo, and would be dated August 1,
L964. It was moved by Commissioner Langohr, seconded by Commissioner SediVY,
tha t the City proceed wi th the saLe of the bonds. The motion was carried by the

There were no seaLed bids on file for the purchase of the bonds and the

Guy Sperry, Manager of the local Chamber of Commerce, appeared to pre-
sent to the Commission the results of the POlL of the members of the Chamber

Commissioner Sedivy, seconded by Commissioner Langohr, that the report be
acknowledged and placed on file. The motion was carried by the fOllowing Aye

In compLiance with Chapter 15 of the Bozeman MunicipaL Code, the eLectrlca~
bond of WaLter .1;'. KelLison, Bozeman, was presented. The City Manager stated
the Building Inspector had recommended approvaL of the bond and the City Attorney
had approved the bond as to form. It was moved by Commissioner Langohr, seconded

The contract documents for construction of Special Improvement District
Nos. 437 and 438, as awarded to Utili ty Builders, Inc., Grea t FaLLS, Montana,
on July 1, 1964, were presented. The contracts and bonds were approved as to
form by the City Attorney and it was moved by Commissioner Sedivy, seconded by
Commissioner .L..angohr, that the Ml:lyor and the Clerk of the CommiSSion be author-
ized to sign the contracts for the ~ity of Bozeman and the cLerk directed to
return the bid securities to the contrac~or. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner
Sedivy and Commissioner Langohrj those voting No, none.

Plans and specificatlonscovering the proposed improvements in Special
Improvement District No. 439 prepared by Harold Hoskins and Associates, super-
vising engineers, were placed before the City COMMission. The City Manager and
the City Engineer recommended that the plans and specifications, as presented,
be approved. It was moved by Commissioner Lengohr, seconded by Commissioner
Sedivy, that the pLans and specifications be approved and the CLerk of the
Commission directed to publish a "CaLL for Bids" for the construction of the
improvements for the district for an opening date of July 29, 1964, and to
advertise for bids for the sale of the bonds of the district in the amount of
$l~,UOO.ou, to be received August 5, 1964. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner
Langohr and Commissioner Sedivy; those voting No, none.

The City Manager reported the Water Department has need for a suPPlY of
six (6), 6" cast iron water vaLves and sleeves and requested authorization to
place an order for the aforementioned in the total approximate amount of $8Uu.uu.
It was moved by Commissioner Langohr, seconded by Commissioner SediVY, that ~he
purchase be authorized and the motion was carried by the fOllowing Aye and No
vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner
Sedivy; those voting No, none.
Continuation Certificate of Bond -- Harrington's Home Appliances (Electrical)
In compLiance with Chapter 15 of the Bozeman MunicipaL Code, tne continu-
ation certificate of the electricaL bond of Harrington's Home ApPLiances,
Bozeman, was presented. Tne City Manager reported the Building Inspector had
recommended the continuation of the bond and the City Attorney had approved the
certificate as to form. It was moved by Commissioner Sedivy, seconded by
Commissioner Langohr, that the certificate of continuation of the bond be
approved and the motion was carried by the fOLlowing Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr;

Plans and specifications covering the proposed improvements in SpeciaL

The City Manager commented on the claims and stated he had audited them
and found them to be true and lawfuL cLaims against the City of Bozeman and
recommended that they be approved and the Director of Finance directed to issue
warrants in payment. After examination of the cLaims in detail and checking
against the the claim register, it was moved by Commissioner Sedivy, seconded
by Commissioner Langohr, that a~L claims as presented be approved and the
motion was carried by the fOi1owing Aye and No vote: those voting Aye being
Mayor Morrow, Commissioner Sedivy and Commissioner ~anghor; those voting
No, none.

There being no further business to come before the Commission at this
