The Commission of The City of Bozeman met in regular session in the Commis-
sion Room, City HaLl Bui.Lding, Wednesday, August 5, L\164 at L:UO o'CLOCk p.m.
Present were Mayor Morrow, Commissioner Langohr, City Man!:iger Cutting, Ass't. City
Manager FrysLie, City Attorney Berg and the Clerk.
Mayor Morrow opened the meeting with a prayer and the following proceedings
were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Langohr, seconded by Mayor Morrow, that the minutes as read be approved
and the rlOtion was carried by the following Aye and No vote: those voting Aye
being Mayor Morrow and Commissioner Langohr; those voting No, none.

Maple Terrace Subdivision)
Mr. Frank Hoey appeared before the Commission to present his written request

that the City create a special improvement dj.strict to accomplish paving, curb-
ing and s torm dr~tinar;e in tlis Maple Terrace Subd:i.visl on. In concurrence wi th the
recommendation of the City Manager, it was moved by Mayor Morrow, seconded by
Commissioner Langohr, that the City Attorney be provided with the necessary data
and instructed to prepare a resolution of intention to create the district. The
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Morrow and Commissioner Langohr; those voting No, none.
Sale of Bonds Special Improvement District No. 439
This WdS tne ~ime and pLace set for the sale of bonds of Jpecial Improvement
District No. 439. The affidavit of publication of notice of sale of the bonds
was presented and tne City Manager stated that bonds of the district would be
sold in the total amount of $16,OOO.uO.
It was moved by Commissioner Langohr, seconded by Mayor Morrow, that the
City proceed with the sale of the bonds and the motion was carried by the fOllow-
ing Aye and No vote: those voting Aye being Mayor Morrow and Commissioner Sedivy;
those voting No, none.
No sealed bids were on file and the following bidders who appeared to bid
orally on the issue nualified by deposi ting wi th the Clerk of the Commission the
necessary bid security:

Trust Company, and the bid security of the unsuccessful bidders be returned. The

This was the time and place set for the sale of bonds of Special Improvement
District No. 440. The affidavit of pubLication of notice of sa~e of the bonds was
presented and the City Manager stated that bonds of the district wouLd be sole in the

It was moved by Commissioner Langohr, seconded by Mayor Morrow, that the City
proceed with the sale of the bonds and the motion was carried by the following Aye

Examination of ~epository Bonds
The Commission proceeded to examine the CustodiBn's Receipts for Depository
Bonds held by the Director of Finance as security for City funds deposited in Bozeman
banks. It was moved by Commissioner Lan~ohr, seconded by Mayor Morrow, that the
securities be approved and a list thereof be set fortn in full in the minutes of this

Bozeman City-County Planning Board
Mayor Morrow 1:tnnounced his re-appointment of Myron Westlake and the appoint-
ment of Carl Beyer to replace Frank Messmer, who had req1J.ested thl:J.t he be repLaced,
to the Bozeman City-County PLanning Board for terms ending June 3U, IlJ66. It
was moved by Commissioner Langohr, that the Comnission approve the action of

Connect Residence at 704 North Seventeenth Avenue to Sewer Main on Durston Road
(Joseph J. Gutsoski)
It was reported that Joseph .J. Gutsoski had requested permission to connect
the sewer serving his home Located at 704 North seventeenth Avenue to the City
Sewer main located on Durston Road. In concurrence with the recommendation of
the City Manager, it was moved by Mayor Morrow, seconded by Commissioner
Langohr, that permission to connect to the City Sewer System be granted but, as
the residence is located outside the City limits, subject to Mr. Gutsoski's
entering into a written agreement with the City that he will make payment of
all costs of installation, payment of an amount of money equal to the pro-
portionate cost borne by property within SpeciaL Improvement District No. 432
as computed on an arca basis to the aforementioned district, and this his
respective property May be brought into the incorporated limits of the City
without opposition whenever such action is so requested by the City. The

Dokken-Nelson Funeral Services, Inc. Proposal to purchase City operated
parking lot at South Willson and West Babcock
The inquiry of Dokken-Nelson Funeral Services, Inc. as to the possibility
of its acquiring the "LinfieLd" property occuppied by the City operated park-
ing Lot at the corner of South WiLLson Avenue and West BabCOCk Street was pre-
sented. Action on tne request was tabLed.
