HomeMy WebLinkAbout1964-05-13 Bozeman, Montana May 13, 1964 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, wVednesday, May 13, 1964 at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, I City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: As it was necessary that Mayor Morrow attend a special meeting of the City-County Health Board, Commissioner Sedivy served as Acting Mayor during Mayor Morrow's absence. Minutes of the last regular session were read and it was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, tha t the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. Purchase of Gravel I It was reported that the Street Department and the Cemetery Department have need for a supply of (5/8th) inch crushed gravel and the City Manager requested tha t he be granted authori ty to purchase 6uu cubic yards of the material at $1.25 per yard. It was moved by Acting Mayor Sedivy, seconded by Commissioner Langohr, that the authority for the purchase as requested be granted and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr: those voting No, none. Authori ty to Travel Montana Fire Department Association's Joint Meeting, Anaconda, 11-13 June It was reported that a joint meeting of the Montana Fire Department Associations is scheduled to be heLd in Anaconda, ll-L3, June, and that Fire Chief Huber had requested that Ass't. Fire Chief Hoey and Fireman Henry Wruck be granted the opportunity to attend the meeting. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded oy Acting Mayor Sedivy, that authority be granted to the above mentioned firemen to a ttend the meeting and, it being in the public interest, their expenses be paid out of the General fund. The motion was carried by the following Aye and No vote: those voting Aye being Acting I Mayor Sedivy and Commissioner Langohr; those voting No, none. Right-of-way Easement 13th to 15th, S.I.D. No. 432 Ass't. City Manager Fryslie, acting as right-of-way agent for the City of Bozeman, presented a right-Of-way ea~ement granted by DonaLd A. Corcoran, etux to provide a right-Of-way for the construction of a portion of the sewer line now under construction in Special Improvement District No. 432. The doc'umen t having been drawn on the Ci ty' s standard form and approved by the 451 line system of Special Improvement District No. 432, and that all costs of the connection to the main line would be paid by Mr. Niven. As the property '- 452 City Attorney, it was moved by Acting Mayor Sedivy, seconded by Commissioner Langohr, that the easement agreement be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign the easement for the City of Bozeman. The motion was carried by the following Aye and No vote: 'those voting Aye being Acting Mayor Sedivy and Commissioner Langohrj those voting Request for Sewer Connection to Property Outside City Limits - F. L. Niven 1 No, none. It was reported that F. L. Niven had requested permission to connect his residence situated on the north portion of Tract Nos. 5A, 5B and 5C of the Homesites Subdivision to the City of Bozeman, to the sanitary sewer trunk I is situated outside the present City limits, it was moved by Commissioner Langohr, seconded by Acting Mayor SediVY, that permission for the connection be granted subject to the landowner's payment of all costs of installation and a proportionate share of the construction costs of Special Improvement District No. 432, and Mr. Niven's entering into a formal agreement with the City that his respective property may be brought into the incorporated limits of the City without his opposition whenever such action is so requested by the City. The motion was carried by the fOLlowing Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. I Mayor Morrow appeared and marked pres2E~ at 1:40 p.m. Petition -- Special Improvement District (Lighting) -- New Westside District A petition signed by owners of properties in the subdiv:\.sions of West Park Manor, Maple Terrace and Kirk No.2, which requested that the City create a Special Improvement Lighting District in the area was presented. In con- currence with the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City Attorney be provided with the necessary data and instructed to prepare a resolution of intention to create the dist- rict. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. License Bond Curley-Naylor Electric Co. (Electrical) In compliance with Chapter 15 of the Bozeman Municipal Code, the elec trical bond of CurLey-Na ylor Elec tric Company, Billings, Montana, was I presented. The City Manager stated the Building Inspector had recommended approval of the bond and the City Attorney had approved the bond as to form. It was moved by Commissioner Langohr, seconded by Commissioner SediVY, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Report of Librarian (Billinf's Meeting) Miss Margaret Hileman reported on her attendance at the State Library Association's meeting heLd in Billings, on May 1st and 2nd. The report con- sisted of a resume of the meeting and her personal comments on the program. I She discussed with the Commission a number of phases of the work of a city librarian and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Miss Hileman be complimented on her presentation of a very interesting and complete report. the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Mayor Wilson, Belgrade, Montana Daylight Savings Time Mayor Wilson of Belgrade, Montana, appeared and informed the Commission that the Belgrade City Council had passed a resoLution to adopt Daylight Savings Time during the summer months of 1964, subject to the City of Bozeman's taking like action on the matter. Mayor Wilson was informed that Bozeman's Ordinance No. 844 to establish the time change for the current summer season had been passed and is in full force and effect. Report of Building Inspector, Missoula Meeting of Electrical Inspectors The City Manager announced that City building Inspector Barrick had been 1 elected as president of the Montana Chapter of the International Association of Electrical Inspectors and Bozeman had been chosen for the site of the 1965, meeting. Mr. Barrick reported on the recent meeting conducted by the chapter in Missoula, May 1st and 2nd. His report consisted of a resume of the meeting and his personal comments on the activities and organization of the association and in particular in regard to information of newly deveLoped electrical products presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Mr. Barrick be compLimented on his excellent report and that it be accepted. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Authority to Re-invest Operational Funds It was reported that the Director of Finance had requested permission to re-invest various maturing investments as follows: s/ $150,000.00 - 30 days b/ $15U,000.00 - 60 days I In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Director of Finance be authorized to re-invest the funds in Federal securities as requested and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, CommiSSioner Sedivy and Commissioner Langohr; those voting No, none. 453 The City Manager reauested that he be granted vacation leave of absence from May 17 to the 24th, incLusive, and that Harold A. Fryslie, Ass'~ City Manager, be designated to perform the duties of City Manager during the period. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reouest for leave be granted and Mr. Fryslie designated as Acting City Manager during the period stated, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Sewer SID Graf's Rearrangement of Block 6, Kirk's Second Subdivision The City Manager presented the written renuest of Eugene Graf, Jr., which requested that the City initiate proceedings to provide sewer lines for his property pLatted as Grafts Rearrangement of Block 6, Kirk's Second Subdivision. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Attorney be provided with the necessary data and instructed to prepare a resolution of intention to create the district. The motion was carried by the following Aye and No vote: those voting Aye being Mayor 1 45'4: Request (Bozeman's Centennial Replica of "Troop B, U.S. Seventh Cavalary, 1876") It was reported a request had been made to grant Bozeman's Centennial Replica of "Troop B, U.S. Seventh Cavalry, 1876", permission to parade on Main Street from Broadway to Buttrey's, on Saturday, May 16th, at 10:00 a.m. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that permission to stage the parade as requested be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor I Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Vacation Ci ty Manager (17-24 May) Morrow, Commissioner Langohr and Commissioner S.edivy; those voting No, none. S.I.D. No. 436 Acceptance of Contract and Final Payment to Contractor The certificate of the engineer on Special Improvement District No. 436, Harold Hoskins & Associates, stating the construction of the water lines in the district had been completed in accordance with the terms and spec ifica tions of the con trac t by the con trac tor, Cave Cons true tion, Inc., and recommending that the City accept and approve the project as completed was placed before the Commission. The City Manager stated that he and the City Engineer concurred in the recommendation of the consultant engineer, and the City Manager informed the Commission that a determination had been made that all known and vailid claims against the contractor resulting from the construction were paid and all records of the project completed. The City Manager placed before the Commission a cLaim in the amount of $6,555.33 I which represented final payment to the contractor. It was moved by Commis- sioner Sedivy, seconded by Commissioner Langohr, that, in concurrence with the foregoing recommendations, the contract work on Special Improvement District No. 436 be approved and accepted as completed and the Director of Finance be authorized to issue a warrant in the amount of $6,555.33 for final payment to Cave Construction, Inc. 'l'he motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner I Sedivy and Commissioner Langohr; those voting No, none. Reports The following reports were presented: Water Collector Building Inspector Cemetery Cashier The City Manager commented on each report and recommended their approval. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, 1 that the meeting adjourn.
