HomeMy WebLinkAbout1964-01-08 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Frysiie, City Attorney Berg and the Clerk. Reverend H. R. Anderson, Jr. of the First ~resbyterian Church opened the meeting with a prayer and the following proceedings were had: Minutes of the reorganization meeting held January 6, 1964, at 10:00 1 398 Bozeman, Montana January 8, 1964 The Commission of the City of Bozeman met in regular session in the Commission Room, Ci ty Hall Building, Wednesday, January 8, 1964 at 1 :00 o'clock A.M. were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion WaS carried by the following Aye and No vote: those voting Aye being Mayor Morrow, commissioner Sedivy and commissioner Langohr; those voting No, none. Right-of-way Easements Special Improvement District No. 432 Ass't. City Manager Fryslie, acting as right-of-way agent for the City of Bozeman, presented the following easements signed by the respective pro- perty owners and granting rights-of-way for the construction of proposed sanitary sewer lines in Special Improvement District No. 432, also, proper claims for such payments for the rights"'of-way as stipulated: Name ~ount of Claim J. Hallesy, et ux $232.00 232.00 ,I The Commission was informed the easements were drawn on the standard form used for this project and the claims were in amounts of, or less than, the maximum figures authorized to be offered by the Commission during its meetings of December 12, 1962 and January 16, 1963. The documents having been approved as to form by the City Attorney and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the easements be accepted and approved and the Mayor and the Clerk of the Commission authorized and directed to sign the easements for the City of Bozeman, and that the claims for payment as predetermined damages be likewise approved. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Additional Engineering Costs Long Construction Co. (SID No. 424) It was reported by City Attorney Berg that Mr. James Felt of Long Construction Companw, Billings, Montana, had verbalLY proposed to him that in lieu of arbitration a committee of two composed of Mr. Felt represent- ing Long Construction Company and Ct ty Attornf3Y Berg repr-esentlng The Ci ty I. of Bozeman, be authorized to examtne all facts regarding the assessment of "- additional engineerinp; cost in the performance of the contract of Long - Construction Company pertaining to Special Improvement District No. 424, - /' '. <. and that the unanimous findings of this Committee be conc~uaive upon both parties, but that if the Committee is unable to agree upon the findings the matter would then revert to arbitration as provided by the contract. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that this proposal be taken under advisement by the Commission until January 29, 1964. The motion was carried by the following Aye and No vote: those I voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Complaint Fire at City Landfill Dump (Allen D. Aksamit) The Commission was referred to its meeting of December 18, 1963, and Mr. Allen D. Aksamit's appearance to register his complaint in regard to the unpleasant conditions cuased by fire burning in the Oity's landfilL dump. The City Manager presented a letter addressed to the Mayor from Mr. Aksamit's legal counsel to again register his complaint about the fire. The City Manager again informed the Commission tha t the use of wa ter to extinguish the fire is not considered feasible but positive steps to stop the fire have continued and City crews have already reduced the area of the fire by more than one~ half. He also called attention to the fact that considerabLe smoke seen in the area eminates from sources other than the fire at the dump. He again I emphasized tha t the fire a t the Ci ty dump was not the result of negligence or neglect by the Ci ty. The Commission directed the Ci ty Manager to inform Mr. Aksamit's attorney that methods to extinguish the fire already success- fully in progress will continue as rapidLY as pocsible without jeapoardizins the City equipment until the fire is stopped. Repor ts The following reports were presented: Disposal Plant Operator Librarian Fire Chief 31m ting Rinks Building Inspector The City Manager commented on the reports and recommended their approval. Police Judge Cashier PoLice Chief (Dec. & Annual) Director of ~ublic Service It was moved by Commissioner Langohr, seconded by CommIssioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the fOLlOWing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that all claims as presented be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and vommissioner Langohr; those voting No, none.
