The Commission 'of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, January 22, 1964 at 1:00

o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner
Langohr, City Manager Cutting, Ass't. City Manager FrysLie, City Attorney Berg
and the Clerk.
Reverend John J. Hamilton of the College Heights Baptist Church opened
the meeting with a prayer and the following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy;
those voting No, none.
Request for Shut-down Order
SIn No. 432, Haggerty-Messmpr r~.
A letter of request that the Commission issue a shut-down order to the
oontractor, Haggerty-Messmer Co., on its contract for the construction work
on Special Improvement District No. 432, was presented in which the contractor

cited four conditions considered by him to be obstacles to performing the work
at this time. The City Manager again called attention to the critical need
for completion of this project at the earliest possible date and the fact that
some work could be accomplished during this period. Mr. T. G. Haggerty,
representing the contractor, further explained reasons for requesting the
shut-down order, answered questions of the Commission and staff and assured
the Commission of the Contractor's intention to begin work as soon as possible
and to complete the project in accordance with the work schedule aubmitted
with their letter and within the contract time. The City Manager then, in
recognition of points raised by the contractor and the pending right-of-way
condemnation suit, recommended granting the requested shut-down order but onLy
to February 15, 1964. It was moved by Commissioner Sedivy, seconded by Commis-
sioner Langohr, that, the requested shut-down order be granted for the period
of January 22, to February 15, 1964, both dates to be inclusive and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor
Morrow, ComMissioner Sedivy and ~ommission Morrow; those voting No, none.
Petitltion
Water Main on Beall Street from 15th to 20th Avenues

A petition requesting that the City create a special improvement district
for the purpose of constructing a water main on Beall Street from 15th to 20th
Avenues was placed before the Commission. Pre-preliminary sketches of draw-
ings indicating the location of the proposed project were also presented. It
was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
petition be acknowledged as received and the matter be tabLed for further
consideration when plats including the property inVOLved are recorded and
that the petitioners be advised as to the necessary steps to be folLowed before
the Commission can act upon the request. The motion was carried by the follOW-
ing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy

their property to the City's sewer system at 1102 West Babcock Street and at
their own expense. As these specific properties are outside the City limits,
it was moved by ComMissioner Langohr, seconded by Commissioner Sedivy, that
permission for the connections be granted subject to the landowners' payment
of all costs of installation and their entering into a formal agreement with

Request for Sewer Connection to Property Outside City Limits
& Clive R. Harston)

It was reported that Eldon Conser, 1110 West Babcock street, and Clive
R. Harston, 1108 West Babcock Street, had requested permission to connect
the City that their respective properties may be brought into the incorporated
limits of the City without opposition whenever such action is so requested by
the City. The motion was carried by. the following Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy;
those voting No, none.
Purchase of Sewer Rods
The City Manager reported that the City is in need of sewer rods and
requested that he be granted authority to pruchase 23U, 39"x5/16th" rod, at
an approximate cost of $600.00. It was moved by Commissioner Sedivy, seconded

by Commissioner Langohr, that authority to purchase the rods be approved and
the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting
Authorization to Invest Parking Meter Funds
in Government Securities
Approximately $63,610.00

The Commission was referred to its proceedings during its regular session
held on October 2, 1963, and the General Services Administation's offer in the

amount of $63,610.00, to purchase the City owned parking lots in Block "A",
BlackS Addition. Upon the City's refusal to accept that offer, condemnation
proceedings had been instituted in the Federal District Court on November 14,
1963 and accordingly, General Services Administration had deposited their
offer in the amount of $63,610.UO with the Court on that date pending adjudi-
cation of the case. A petition for the release of these funds to the City was
submitted to the Court as soon as assurance was given the funds could be with-
drawn without prejudice ,to the City's case, and payment was received by the

City on January 21, 1964. Authorization was requested by the City Manager for
the investment of the funds in tJ.S. Government Securities by the Director of
Finance. It was moved by Commissioner Langohr, seconded by Commissioner
Sedivy, that this investment in the approximate amount of $63,610.00 be author-
ized in accordance with Section 16-2618 RCM, 1947. The motion was carried

Excess Engineering Claims (Harold Hoskins & Associates) SID Nos. 425 & 426
The Commission was referred to its action of December 18, 1963, in the
m.a tter of penalizing the contractor, Haggerty-Messmer Co., for the overrun of
the contract time in its completion of its contract work on Special Improve-

ment District No's. 425 and 426.
The following claims were then presented:

and the City Manager stated the claims were in amounts and in accordance with
the penalty provisions as stipulated in the above mentioned action for excess
engineering costs and recommended that the claims be approved. It WaS moved
by Commissioner Sedivy, seconded by Commi8sioner Langohr, that the claims be
approved and the Director of Finance directed to issue warrants in payment.
The motion was carried by the following Aye and No vote: those voting Aye
being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those
voting No, none.
Authority to Invest Operational Funds not Immediately Needed
The City Manager reported that $150,000.00 of operational funds are now
on deposit that are not immediately needed to meet current operational expenses,
and the Director of Finance had requested authority to invest the funds in

Upon the City Manager's recommendation it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the investment of the funds as
outlined be approved and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commis-
s10ner Sedivy; those voting No, none.
Report for December
Director of Finance
The December, 1963 report of the Director of Finance was presented.
After commenting on the report, the City Manager recommended its approval.
It was moved by CommiSSioner Sedivy, seconded by Commissioner Langohr, that
the report be approved and ordered filed and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Morrow, 6ommissioner
Sedivy and Commissioner Langohr; those voting No, none.

There being no further business to come before the Commission at this
time it was moved by Commissioner Sedivy, seconded by Commissioner Langohr,
that the meeting adjourn and the motion was carried by the following Aye and
