The Commission of The City of Bozeman met in regular session in the
Commission Rooml City Hall Buildingl Wednesday, April 22, 1964 at 1:00 o'clock
p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr,
City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and
the Clerk.
Mayor Morrow opened the meeting With a prayer and the following pro-
ceedings were had:
Minutes of the last regular session were read and it was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes as
read and corrected be approved and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Morrowl Commissioner Sedivy
and Commissioner Langohr; those voting No, none.
Objec tion
Construction of Factory Prefabricated Homes in New Hyallte
View Subdivision
A group of residents and/or owners of property in the New Hyalite View

Subdivision and of an area adjacent to the subdivision and outside the City
limits appeared before the Commission to object to construction of "factory- v
prefabricated type dwellings" within the subdivision, or specifically the
type of structure discussed by Mr. J. W. Tschache and the Commission during
the Commission meeting of April 15, 1964. Mr. Emmett R. Holekamp, as spokes-
man for the group, presented a petition bearing forty-four (44), signatures
of residents and/or owners of property in the subdivision which, in brief,
requested,
". . . the undersigned respectively request of this
Commission that it require all future structures
wi thin NEW HYALITE SUBDIVISION to comply s tric tly
with the ordinances of said city and statutes of the
S ta te of Mon tana; and
that said CommiSSion take all possible and pro-
per means to prevent the erection of said units, even
to the extent of re-zoning; and
that said Commission prohibit the erection of
said units; and. . .n

The petition was accompanied by a written objection to the structures
which was signed by nine (g) persons who reside outside the City limits and
adjacent to the south boundary of the subdivision. After discussion, Mayor
Morrow and the City Manager assured the group that in every instance when
applications for building permits for structures to be erected within the
City of Bozeman, are filed, not until it is first ascertained that the
structure is in strict compliance with the Bozeman Municipal Codel Is a
building permit issued. However, in the event an application for a build-
ing permit is disapproved, the applicant is privileged to appeal to the
City's Board of Adjustment and to the Courts for further consideration.

Proposed SID No. 435 -- Extent of' District (Geo. P. Sikonia)
Mr. Geo. ~. 3ikonia appeared bef'ore the Commission to object to the
inclusion of' his property on North Broadway Avenue within the boundaries of'
proposed Special Improvement District No. 435, paving and drainage in the

northeast section of' Bozeman. He demanded that the paving of' North Broadway
Avenue adjacent to his Lots in Block 491 Northe~ ~acif'ic Addition, be deleted
f'rom the district. Mr. Sikonia was inf'ormed that action on a proposed reso-

lution of' intention to create the district had been tabled to allow time f'or
f'urther study and that he would be inf'ormed of' any action pertaining to the
creation of' the subject district, in compliance with the law as it applies
to the formation of' special improvement districts.
Public Hearing -- Special Improvement District No. 437
This was the time and place set by Commission Resolution No. 1113 to
hear protests, if any, to the creation of Special Improvement District No. 437.
Affidavit of publication of Notice and the Clerkts Mailing Certif'icate
stating that all property owners had been notified as required by law were
presented. No written protests were on file and no one appeared to verbally
protest the creation or extent of the district. The City Manager recommended
that the City Attorney be instructed to prepare a resolution to create the
district.

prepared by the City Attorney was presented. It was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that Commission Resolution No. 1115
be passed and adopted to create Special Improvement District No. 4371 and
Harold Hoskins and Associate~ be authorized and requested to perrorm the
engineering service ror carrying out the contemplated construction. The motion
was carried by the rollowing Aye and No vote: those voting Aye being Mayor
Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none.
State Examiner's Report Audit of the City or Bozeman
The report of the annual examination of the records of the City made by
the State Examiner was placed before the Commission. The City Manager reviewed
the comments of the Examiner which appeared in the report and said the Examiner
had in addtion been very complimentary of Bozeman's City Administration. It
was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
City Attorney be instructed to make an appropriate repiy to the Examiner and
the motion was carried by the rollowing Aye and No vote: those voting Aye
being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those
voting No, none.
Report on Park & Recreation Conference Billings 12-15 April
City Recreation Director White reported on his attendance and that of
City Park Superintendent Cloninger and Chairman of the Park Recreation Board
Parker at the (1964) Northwest Park and Recreation Roundup held in Billingsl
April 12th thru the 15th. Mr. White reported that approximately three hundred
representatives from throughout the Northwest attended the meeting and several
or the speakers were officers in the National Recreation Association of the
United States. He enumerated and commented on the programs and added that
Bozeman's representatives were rewarded for their attendance in having received
an ample amount of worth-while inrormation as it applies to the operation and
financing of public parks, recreational facilities and planned programs. It
was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that
Mr. White's report be accepted and he be complimented for the completeness
of his report. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner
Sedivy; those voting NOI none.
Street Widening for Federal Building
The City Manager reported he had received information through
Norman J. Hamill and Associates, the designer of the new federal building in
Bozeman, that the General Services Administration is agreeabie to constructing
new sidewalk and intregal curb and gutter on the rour sides of the building
site in such a manner as to provide a widening of the pavement approximately
five feet (5')1 on all four streets around that block. Arter discussion and
on the recommendation of the City Manager, it was moved by Commissioner
SediVY, seconded by Commissioner Langohr, thatl subject to final approval of
the plan by the General Service Administration, the proposal to widen the

streets as described and to reconstruct that portion of the street pavement
involved at City expense be approved and Harold Hoskins and Associates be
authorized and requested to perform the engineering services for the
project. ~he motion was carried by the following Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr;

Adjournment
There being no further business to come before the Commission at this
time it was moved by Commissioner Sedivy, seconded by Commissioner Langohr,
