The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, September 4, 1963 at 1:00
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner SediVY, seconded by Commissioner Morrow, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow;
those voting No, none.
Propsed Revision of Plumbing Code (BMC - 16.04)
In the process of revising Chapter ~6.04, the ~lumbing Code of the
Bozeman Municipal Code, City Building Inspector Barrick had at an earlier
date met with local plumbers in order that they could comment on the proposed
revision and make known their recommendations. At their request, a group of
local plumbers appeared to further discuss the matter with City officials.
Some of this group proposed that, as incorporated in the Western ~lumbing
Officials Uniform ~lumbing Code, the City appoint a board to consist of two
master plumbers, two journeyman plumbers and one member at ~arge to sit as a
board of appeals or arbitration and recommend changes in the ordinance from

time to time. After discussion of the proposaL and other aspects of the code,
the matter was tabled pending further meetings to be attended by City officials
and the local plumbers for further study of the proposed code revision.
S.I.D., No. 432, Westside Sewer
Reduction of Federal Grant
The Commission was referred to its action of February 27, 1963, and
its filing of an application for a grant of Federal funds in the amount of
$73, U23 .00, "Federal Grants for Sewage Trea tmen t", to ass is t in the accompll-
shment of the proposed construction of sewer trunk lines planned for Special
Improvement District No. 432. It was reported by the City Manager the City
had been advised by the Denver Regional Office of the Federal Water Pollution
Contro~ Agency that only a portion of the proposed project would be eligible
for Federal participation which at 30% would permit approvaL of a grant in an
approximate amount of $5U,UUO.uu, rather than the amount originally requested,
and further advised the City had the right of appeal to the Washington, D. C.,
office. Frank Hoey and T. J. Haggerty, owners of large portions of the
privatelY owned land included in the district, appeared to discuss the matter
of an appeal and expressed their desire to accept the grant offer without
further appeal and the Manager reported other major property owners, including
Montana State College, had been contacted and expressed their desire to accept
the grant offer and proceed with the propsed project. On that basis, the

City Commission instructed that the Denver office be informed the determination
of that office would be accepted.
?urchase of Cast Iron Pipe
The City Manager reported tne City is in need of a supply of 6" cast iron
pipe and requested authority to purchase approximately 40u' at an approximate
cost of $99U.uu. It was moved by Commissioner Morrow, seconded by Commissioner
Sedivy, that the purchase be approved and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Morrow and Commissioner Sedivy; those voting No, none.
Continuation Certificate Montana Power Co.
The continuation certificate for the renewal of the gas fitters license
bond of the Montana Power Company was presented. It was reported the Building
Inspector had approved the continuation of the bond and after approval of the
certificate as to form by the City Attorney, it was moved by Commissioner
Sedivy, seconded by Commissioner Morrow, that the certificate be approved and
the motion was carried by the following Aye and No "v-ote : those voting Aye
being Mayor Staudaher, :Commissioner Sedivy, and Commissiorrer Morrow; those
voting No, none.
Continuation Certificate Geo. Norman
The continuation certifioate for the renewai of the electrician's bond
of George Norman, Belgrade, Montana, was presented. It was reported the
Building Inspector had approved the continuation of the bond and after approval
of the certificate as to form by tne City Attorney, it was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the certificate be approved and
the motion was carried by the fol~uwing Aye and No vote: those voting Aye
being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those
voting No, none.
S.I.D., No. 432 Right-of-way (Walton Property)
The Commission was informed that Roy and Jesse Walton have made a counter
proposal to ttIe City for granting a 30'x549.6' right-of-way across their pro-
perty to permit construction of a portion of the trunk line sewer as proposed
in Speoial Improvement District No. 432 at a rate of payment of $10.00 per foot
on center line plus some additional amount for other damages. ~he Commission
and the Oi ty Manager concurred the t this proposal contempla ting a payment in
excess of $5,5UO.uO is grossly excessive and unacceptable and the Commission
instructed that the City offer e oounter proposal, or offer, of $50u.00 for
the right-of-way easement to inolude predetermined damages and Without connection
privileges and that the WaltonB be advised this is the City's final offer and
unless accepted within ten (10) days from date of notice, condemnation action
will of necessity be taken. It was moved by Commissioner Sedivy, seconded by
Commissioner Morrow, that Ass't. City Manager Fryslie as Right-of-way agent be
directed to offer the aforementioned proposal to the Waltons and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.

this time, it was moved by Commissioner Morrow, seconded by Commissioner
