HomeMy WebLinkAbout1963-09-18 Bozeman, Montana September 18, 1963 The Commission of the City of Bozeman met in regular session in the I Commission Room, City Hall Bui.lding, Wednesday, September 18, 1963 at 1:00 o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, Ass't. City Manager FrysLie, City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the .last regular session were read and it was moved by Commis. sioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Authority to Purchase Pipe cutter Large Sizes (10" to 24tt) The City Manager reported that tne City has a need for a pipe cutter to cut pipe of large dimensions and in order to avoid excessive costs of having such cuts made commerciallY requested that authority be granted to purchase I a cutter capable of cutting pipe from 10 to 24 inches in diameter at an approximate cost of $65u.Ou. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the pUrchase' of.. the pipe cutter as requested be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Bonn's Second Subdivision Approval of plat (East ~tory street) The proposed plat of Bonn's Second SubdiVISIon was placed before the Commission for consideration. A letter from the Bozeman City-County Planning Board, dated September 9, 1963, recommending approval of the plat was pre- sented. The City Manager stated that the plat satisfIed the provisions of the subdivision ordinance of the City and recommended the plat be approved. It was moved by CommiSSioner Morrow, seconded by Mayor Staudaher, that the City approve the plat and the City Manager as DIrector of Public Service be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, CommiSSioner Sedivy. License Bond LoraTIz Plumbing & Heating I In complianoe with Chapter 16.u4, the P~umbIng Code of the Bozeman MunicIpa~ Code, the pLumbing bond of Loranz P.lumbing & Heating, Helena, Montana, was presented. It was reported the Building Inspector had recom- bond mended acceptance of the bond. The/was approved as to form by the City Attorney and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bond be approved and accepted and the motion was carried 323 by the fOLlowing Aye and No vote: those voting Aye being Mayor Staudaher, ComMissioner Sedivy and Commissioner Morruw; those voting No, none. Bond Clerk of the Commission & Ass't. to the Director of Finance RenewaL of the annual bond of Clinton K. Wilson, CLerk of the City CommiS- sion and Ass't. to the Director of Finance of tne City of Bozeman, in the amount of $lb,vUO for a one-year period beginning August 1, 1963 and ending August 1, 1964 was presented. The bond was approved by the City Attorney and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Easement for Sewer Pipe Lines (New Rosary High School Property) The Commission was referred to the minutes of its meeting of January 31, 1962, whereby the City approved a layout scheme for water and sewer lines to serve the new Parochial High School. An easement prepared by Church author- ities to grant a right-of-way for the sewer lines across the Church property was presented. The City Attorney approved the easement as to form and in concurrence wi th the recommenda tion of the City Manager, it was moved by Com~issioner SediVY, seconded by Commissioner Morrow, that the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting I 324: No, non e . S.I.D., No. 432 Right-of-way (Walton Property) The Commission was referred to its proceedings of September 4, L963, and its directive to Ass't. City Manager l"ryslie as Right-Of-way Agent to offer a counter and final proposal in the amount of $5UO.UO to Roy and Jesse Walton in payment for their granting a right-of-wayacroos their property to permit construction of a portion of the trunk line sewer as proposed in Special Improvement District No. 432. A replY from Mr. Walton dated September 12, 1963 was presented which in effect rejected the City's final offer and further pressed his original proposal, which proposal had been considered by the CommiS- sion to be grossly excessive and unacceptable. The City Manager concurred with the Right-of-way Agent and the City Attorney in the belief the proposals of the City and Mr. Walton are so far apart that further negotiations would serve no purpose and that the construction of this critically needed project should not be unnecessarily delayed. It was moved by Commissioner Morrow, seconded by Commissioner SediVY, that, in accordance with the recommendation of the City Manager and the City Attorney, a right-of-way across the Walton property for the construction of the sanitary sewer pipe line in Special Improvement District No. 432 be declared a publiC necessity and that the City Attorney be instructed to immediately initiate condemnation proceedings to obtain this I I right-of-way and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Public Hearing Special Improvement District No. 433 I This was the time and place Bet by Commission Resolution No. I083 to hear protests to the creation of Special Improvement District No. 433. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all pro- perty owners had been notified as required by law were presented. One written protest representing approximately 6% of the property within the boundaries of the proposed district was presented. No one appeared to verbally protest the creation or the extent of the district and the City Manager recommended that the protest filed be declared insufficient and the City Attorney instructed to pre- pare a resolution to create the district. Commission Resolution No. 1U87, enti tied: COMMISSION RESOLUTION NO. 1087 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 433 OF' THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON NORTH NINTH AVENUE FROM THE SOUTH STREET LINE OF WEST BEALL STREET TO THE SOUTH LINE OF DURSTON ROAD, ALSO FROM THE EAST LINE OF ELEVENTH AVENUE NORTH TO THE CENTER LINE OF SEVENTH AVENUE NORTH. I prepared by the City Attorney was presented. It was moved by Commissioner Sedivy, seconded by Commissioner MOrrow, that the protest be declared insuffi- cient and Commission Resolution No. 1087 be passed and adopted to create Special Improvement District No. 433. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Public Hearing Special Improvement District No. 434 This was the time and place set by Commission Resolution No. 1084 to hear protests to the creation of Special Improvement District No. 434. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all pro- perty owners had been notified as required by law were presented. No written protests were on file and no one appeared to verbally protest the creation or exten t of the dis trlc t. The City Manager recommended that the City Attorney be instructed to pre- pare a resolution to create the district. Commission Resolution No. 1088, entitled: I COMMISSION RESOLUTION NO. lu88 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEIffiNT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 434 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SPRING CREEK DRIVE FROM THE SOlJTH LINE OF THOMPSON ADDITION NUMBER THREE (C6ntinued on Page No. 326) 325 COMMISSION RESOLUTION NO. luS9 I 326 TO THE INTERSECTION WITH THE EXTENSION WITH THE WEST LINE OF LOT ONE, BLOCK FOUR OF SAID ADDITION, ALSO THE ACCESS DRIVE BETWEEN SPRING CREEK DRIVE AND SPRING CREEK ROAD, ALSO A PORTION OF HIGHLAND COURT FROM SPRING CREEK DRIVE TO A LINE 166.25 FEET WESTERLY THEREFROM. prepared by the City Attorney was presented. It was moved by ,Commissioner Morrow, seconded by Commissioner SediVY, that Commission Reso~ution No. 1088 I be passed and adopted to create Special I~provement District No. 434. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Public HearIng special Improvement District No. 436 This was the time and place set by Commission Resolution No. 1085 to hear protests to the creation of Special Improvement District No. 436. Affidavit of publication of Notice and the C~erk's Mailing Certificate stating that all property owners had been notified as required by law were presented. No written protests were on file and no one appeared to verb- ally protest the creation or extent of the district. The Ci ty Manager further exphdned tha t as a result of the cres. tion of Special Improvement District No. 433 for the construction of pavement on these streets, these we ter pipe lines should be ins ta ~led before paving and also to serve this rapidly developing area and recommended that the City Attorney be instructed to prepare a resolution to create the district. Commission Resolution No. luS9, entitled: A RESOLUTION OF THE CITY COMMISSION OF TIill CITY OF BOZE~ffiN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPRO,mMENT DISTRICT NO. 436 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A WATER MAIN ON NORTH NINTH AVENUE BETWEEN BEALL STREET AND DURSTON ROAD, SAID WI~TER MAIN TO BE EIGHT (s) INCHES AND OF CAST IRON, AND TO INSTALL A SIX (6) INCH CAST IRON WATER MAIN ON WEST VILl.I~RD BETWEEN NINTH AVENUE AND SEVENTH A VENUE AND ALSO TO INSTALL WATER SERVICE LINES TO ALL LOTS WITHIN THE DISTRICT. prepared by the City Attorney was presented. Following that explanation it was then moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t Resolution No. lU89 be passed and adopted to create Special Improvement District No. 436. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Reports for Month of August The following reports for the month of August, were presented: Director of Public Service Ceme tery Water Collector I The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being 327 I Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.
