HomeMy WebLinkAbout1963-09-25 328 Bozeman, Montana September 25, 1963 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, September 25, 1963 at 1:00 o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commis- sioner Morrow, seconded by Mayor Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. Call for Bids (I - 18", & 1 - 24", Valve) It was reported the Wa ter departmen t has need for one lS", and a 24", cast iron water valve to be installed in the City's main water transmission lines of those diameters in the vicinity of Spring Creek Road. The city Manager stated that the installation of the valves would permit repairs and additions to the water system in south areas of the City without interrupting the water supply to a major portion of the southside residential area and recommended the Clerk of the Commis sion be direc ted to issue a call for b ids for the. valves. It was moved by Mayor Staudaher, seconded by Commissioner Morrow, that the purchase of the valves be authorized and the Clerk of the Commission directed to issue a call for bids for the purchase. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and commissioner Morrow; tLose voting No, none. Ordinance No. 843 Condemnation Walton Property As directed by the City Commission, September 18th, 1963, the City Attorney presented for its consideration Ordinance No. 843, declaring the necessity of acquiring an easement across property of Roy T. Walton for the purpose of constructing and maintaining a sewer pipe line for ~pecial Improve- ment District No. 432; declaring that said easement cannot be acquired by purchase; directing the City Attorney to commence proceedings to obtain the necessary right-of-way by condemnation and declaring that an emergency exists . effec ti ve and that the ordinance become immediately ~,t~~,p upon passage and two-thirds (Correction - by /.~~ .J.-/li.ld:r;'l;)~i affirma ti ve vo te cjt ~Xl-/,np~,fi/jJf'" 0 e ORDINANCE NO. 843 - AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE TAKING OF PRIVATE PROPERTY FOR THE PURPOSE OF ESTABLISHING, CONSTRUCTING AND MAIN- TAINING A SEWER FOR THE USE OF THE INHABITANTS OF THE CITY OF BOZEMAN, DECLARING THE NECESSITY OF STlCH TAKING AND DIRECTING, AUTHORIZING AND EMPOWERING THE CITY ATTORNEY OF THE CITY OF BOZEMAN, MONTANA TO COMMENCE CONDEMNATION l'ROCEEDINGS THEREPOR, AND DECLARING THAT AN EMERGENCY EXISTS AND THAT THIS ORDINANCE SHALL BECOME IMMEDIATELY EFFECTIVE UPON ADOPTION. Naval Industrial Development Program Paul Wylie, Chairman Paul Wylie, Managing Director of the Executive Committee for the 1964, Naval Industrial Development Clinic, appeared before the Commission and presented a description and an outline of the program to be conducted in Bozeman, July 22nd thru July 24th, 19S4. Federal Grant Westside Sanitary Sewer Truhk Line ($50.370.00) The Commission was referred to its action of September 4th, 1~63, exyress- its wil.Lingness to accept wi thou t aPI,eal a determina tion of eligibl1i ty by the Water Pollution Control Agency for federal participation under the program of "Federal Grants for Sewage Trea tment", in the accomplishmen t of the proposed construction of sanitary sewer outfall lines in Special Improvement District No. 432, commonly known as the "Westside Sewer Project". A grant offer in the amount of $50,37U.uO having been made and as a procedural requirement for its acceptance, Resolution No. lU90 was presented, entitled: COMMISSION RESOLUTION NO. 1090 A RESOLUTION OF THE CITY COMMISSION OF TIIE CITY OP BOZE- MAN, MONTANA, AUTHORIZING FRED M. STAUDAFTER AS MAYOR OF THE CITY OF BOZEMAN TO ACCEPT THE OFFER OF A FEDERAL GRANT BY THE UNITED STATES OF AMERICA, PUBLIC HEALTH SERVICE, TO PARTICIPATE IN THE AMOUNT OF' $50,370.00 IN THE COST OF THE CONSTRUCTION OF INTERCEPTOR. SEWERS TO SERVE THE WEST AREAS, AND F1:JRTHER AUTHORIZING THE MAYOR OF THE CITY OF BOZEMAN, MONTANA, TO MAKE THE ASSURANCES REQUIRED BY THE SURGEON GENERAL OF THE PUBLIC HEALTH SERVICE AS A CO}IDITION TO SAID FEDERAL GRANT It was moved by Commissioner Morrow, seconded by Mayor Staudaher, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. Retirement Fire Chief William Penttila A letter dated September 9, 1963 addressed to the City Manager by Fire Chief William ~enttila was read in which he stated that being now eligible by law, he desires to be placed on retirement and requested such action be taken effective October L, L963. The City Manager then read his letter in reply to Mr. Penttila which in essence commended him for the excellence of his department and for his outstanding service to the City and the co~munity and informed Mr. Penttila his retirement is reluctantly approved as requested. Mayor Staudaher and the City Commission further praised and commended Mr. Penttile and it was moved by Mayor Staudaher, seconded by Commissioner Morrow, that the . retirement of Mr. Penttila and the action of the Manager be approved and the motion was carried by the fOlLOWing Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. 330 Mayor Staudaher concluded by presenting Mr. Penttila with an engraved "Key to the City" as a token of appreciation for his splendid record., Travel -- Montana Municipal League Meeting It was reported the Montana Municipal League has scheduled its annual meeting of officers and members to be held in Billings, Sept. 26 thru the 28th. It was moved by Mayor Staudaher, that Commissioner Morrow and City Manager Cutting be delegated to attend the meeting and, it being in the public interest, the expenses incurred be paid from the General fund. The motion was seconded by Commissioner Morrow, and carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. New Parking Restrictions Clevelande, Eighth and College Ci ty Manager Cutting announced too t he and Police Chief Sa1..mders had in conjunction with Montana State College Officials conducted a survey of traffic conditions in the immediate area of the College and all being in agreement stated that with the approval of the Commission and effective immediateLY, the followingadditional parking restrictions would be ordered: Parking on the north side of Cleveland Street from Sixth To Eighth Avenues, prohibited; Parking on the west side of Eighth Avenue from Harrison Street to College Street, and on both sides of College Street from Eighth Avenue to Eleventh Avenue prohibited between the hours of 2:00 A.M. and 7:00 A.M. It was moved by Commissioner Morrow, seconded by Mayor Staudaher, that the additional parking restrictions be approved and authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. Reouest Parade (Bozeman Senior High S.chool) It was reported the Student Body of the Bozeman Senior High School had requested permission to stage a Homecoming Day Parade at lU:OO o'clock A.M., on September 28th, on Main street. It was moved by Mayor Staudaher, seconded by Commissioner lli'lorrow, tha t permission to stage the parade be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher and Commissioner Morrow; those voting No, none. ., .m. ) Commissioner Sediv eared and marked resent at meetin Request for Fund Drive (UNICEF) The written request from the Chairman of the local Christian World Relations Committee of United Church Women for permission to stage its annual UNICEF drive in Bozeman, on the evening of October 31st, was presented. After discussion, it was moved by Commissioner Sedivy, seconded by Comnlissioner Morrow, that the city Manager corresponde with Mrs. Harry ~cNeal, the Chairman, to ascertain if the organization would be agreeable to select another date than other tfip October 31st, and not within five (5) days before or after that date. The motion was carried by the following Aye and No vote; those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. I I I Direotor of Finance's Report for August, 1963 The August report of the Director of Finance was presented. The City Manager commented on the report and recommended its approval. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the report be approved and ordered filed and the motion was carried by the following Aye I and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow, and Commissioner Sedivy; those voting No, none. Reques t to hold Packaged Candy Sale and Collec tion of Canned Goods - _ Bozeman High School Key Club The written request of the Bozeman High SchoOl Key Club for permission to stage a packaged oandy sale, Oct. 1, thru Oct. 19th, and to schedule ita program for the cOllection of canned goods on October 3lst, was presented. After discussion, it was moved by Commissioner Sedi vy, seconded by Commissioner Morrow, that the City Manager be directed to request that representatives of the club and one member of the sponsoring organization, the Kiwanis, meet with the Commission to durther discuss the reyuests. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commis- sioner Sedivy and Commissioner Morrow; those voting No, none. Claim for New Street Sweeper A cIa im filed by Ha 11- Perry Machinery Co., reques ting paymen t for the new City street sweeper in the amount of $8,929.uO, the bid price, as awarded I July lU, 1~63, was presented. The City Manager recommended that the cIa im be apl-lroved and the Direc tor of Finance directed to issue a warrant for final and fuLl paymen t. It was moved by CommiSSioner Morrow, seconded by Commis- s10ner Sedivy, that the claim be approved and payment made as recommended.
