The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, October 2, 1963 at 1:00
o'clock p.m. Present were Mayor Staudaher, Commissioner SediVY, Commis-
sioner Morrow, City Manager Cutting, Ass't. City Manager Fryslie, City
Attorney Berg and the Clerk.
The following proceedings were had:
Minutes of the Last regular session were read and it was moved by
Commissioner SediVY, seconded by Commissioner Morrow, that the minutes as
corrected be approved and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commis-
sioner Morrow; those voting No, none.
Mayor's Prayer Breakfast
Oc tober 7, 1963
Gilbert Lee representing the Oommittee for the Mayor's Prayer Breakfast,
October 7th, appeared at the meeting to present complimentary tickets for the
breakfast to members of the Commission, the City Manager and Ass't. City
Vlanager.
UNICEF Fund Drive

Mrs. Harry McNeal, as requested, appeared to discuss the request of the
local Christian World Relations Committee of United ChurCh Women for permission
to stage its annual UNICEF' drive in Bozeman on the evening of October 3lst,
with the Commj_ssion and reported the October 31st date had been set by the
national committee of the organization on a nation wide basis and since all
literature for the drive was already printed for Halloween night it would be
difficult to se.lect another date for the drive. Th-e City rt.G\r1eo.ger stated that
under these circumstances he would recommend the Ci-ty grant permi~sion to
hold the drive as reqlJested for this year only. It was moved by Commissioner
Morrow, seconded by Commiss ioner Sedivy, the t permis sion to hold the drive be
granted as recommended by th~ City Manager, and that Mrs. McNeal be requested
to ask the organization to select a date other than Halloween in the future.
The motion was carried by the following Aye and No vote: those voting Aye
being Mayor staudaher, Commissioner Morrow and Commissioner Sedivy; those
voting No, none.
Bozeman High School Key Club

At the request of the Commission, ~~.,~_ Vvelch, Kiwanis CluD sponsor
for the Bozeman Senior High Key Club, and Dave Madden, preSident of the club,
appeared to discuss the club's request to schedule a packaged candy sale dur-
ing the period, Uct. 1, thru Oct. 19th, and its annual canned goods pickup on
Halloween night. Mr. 'vwelch and Mr. Madden explained the purposes and opera tions
of the programs, and stated the candy for their sale was already ordered. They
agreed, however, tlleir canned 700ds solicitation could be held on November 7 or
8, in view of Commission opposition to such activities being held on Halloween

night. It was moved by Comf11.issloner Sedivy, seconded by Comrnissloner Morrow,
that permission to hold the candy sale as requested be granted, and for the
canned goods pickup to be heLd the first week in November. The motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.
The Commission expressed its desire to caution all organizations that
while fund drives and collections are in general noteworthy, undue frequency
of such programs pres'.nts problems to the Ci ty, aRd cause confusion when held
on Halloween night and lead to general public dissatisfaction.
Resolution No. 1091 -- Assessing Garbage Collection & Disposal (1963)
This was the time and place set for hearIng on Levying assessment for
the collection and disposal of garbage for the year 1963 in the amount of
$60,967.17. Affidavit of publication of Notice was presented. No one was
present to protest and no written protests having been fiLed, Resolution
No. lU9L, as presented and provisionaLly passed at the meeting of September
25, 1963, was presented for final passage. It was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the resolution be finally passed
and adopted and the motion was carried by the following Aye and No vote:

Resolution No. 1092 Assessing Noxious Weeds (1963)
This was the time and pLace set for hearing oh levying assessment for

of *516.20. Affidavit of publication of Notice was presented. No one was
present to protest and no written protests having been filed, Resolution
No. lU92, as presented and provisionally passed at the meeting of September
25, 1963, was presented for final passage. It was moved by Commissioner
Sedivy, seconded by Commissioner Morrow, that the resolution be finally passed
and adopted and the f11otion was carried by the following Aye and No vote:

to Fire Chief of Bozeman, effective Uctober 1, 1963, to fill the vacancy

Counter-off/from GSA for Ci ty Owned Parking Lots
($63,610.00)
On August 28, 1~63, the Commission in answer to the General Services
..administration's request set a value of $17g,34u.vv, on the City owned parking
lots located in BLoCk "A", B~acks Addition, on the site chosen by the Federal
government for its proposed new federa~ bui~ding and postoffice, and designated
Mayul' ::)talFlaher as the official representative to make the offer. ,A letter

from the Genera~ Services Administration dated September 25th, 1963 was pre-
sented advising that the City's above offer was unacceptable, made a counter
offer in the the amount of $63,6iU.UU and suggested that unless the City accept
this offer by November 7th, 1963, the ma tter would be referred to the Department
of Justice and adjudicated in the Federal. courts. During a discussion of the
matter, it was pointed out that since no new information in regard to plans for
the federal building had been received and it being apparen t the General
Services Administration has no desire to discuss the matter, the City has no
basis on which to consider any reduction of its original offer. It was moved
by Commissioner Sedivy, seconded by Commissioner Morrow, that the counte'r offer

Resolution No. 1097
Contract to Secure Payment for Open Space Grant ($3,210.00)

The Commission was referred to its actions of June 27, 1962, and March 20,
1963, regarding its application for a Federal Grant to assist the City in pur-
chasing the property known as the "OLd Country Club" for "Open Space" land
acquisition. As a procedural requirement to accept a grant in the amount of
$3,210.uO as approved by the Federal agency, Resolution No. 1097 was presented,

Travel
City Managers's Convention
Denver, Colo.
The City Manager reported the International City Managers' Association
Convention is schedUled to be held in Denver, Colorado, October 13th thru the
17th, and stated that since the press of current City business made his absence
undes1r~able, requested that Ass't. City Manager Fryslie be authorized to

represent the City at the meeting. It was moved by Commissioner Sedivy,
seconded by Commissioner Morrow, that Ass 't. City Manager Pryslie be author-
ized to attend the meeting and, it being in the public interest, his expenses
be paid from the General fund. The motion was carried by the following Aye
and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and
"Fire Prevention Week"
