Services for the Path to the M Trails, Open Space and Parks Bond Project

RECOMMENDATION: Approve Amendment No. 1 to Task Order No. 6 of the Master Task
Order Agreement between the City of Bozeman and DOWL, LLC (“Contractor”) for an amount
not to exceed $44,746 total ($9,272 in addition to the previously approved amount of $35,474),
and authorize the City Manager to sign the Amendment (Attachment A).
BACKGROUND: On October 28,
2013, Commission approved Resolution 4484, which
authorized the allocation of $600,000 from Trails, Open Space and Park Bond Funds for the
Construction of a Pathway to the “M” and Drinking Horse Mountain and Authorized the City
Manager to enter into a Match Agreement with the U.S. Department of Transportation’s Federal
Land Access Program. The Contractor was hired to perform professional and technical services
for the acquisition of right of way, easements and real property to allow for the construction of
various street and utilities improvements to be constructed by the City. The Contractor has staff
certified in state and federal right-of-way acquisition processes, which City staff are not currently
qualified to perform.
Two easement agreements have been executed and a third agreement is being formulated. The
third property owner has requested that a new fence be installed to replace the existing fence,
which will be removed with construction of the trail in the proposed easement. This required
creation of a Memorandum of Understanding with the property owner, in addition to the typical
easement agreement documents. This particular property owner is a part-time resident and
communicates through his lawyer, which requires additional time and effort on the part of the
Contractor. The additional amount to be added to Task Order No. 6 is $9,272, for a new total of
$44,746.

The full contract amount will be included as part of the City’s match to the Federal Lands Access
Program grant. A line item amount of $150,000 has been designated for right-of-way acquisition
in the project budget. No additional funds are required.
UNRESOLVED ISSUES: Final design will proceed following the completion of negotiations
to secure the anticipated right-of-way and easements for the Trail to the M Project.
ALTERNATIVES: Per Commission.
FISCAL EFFECTS: The contract amount will be included as part of the City’s match to the
Federal Lands Access Program grant. No additional funds are required to be allocated.
