SUBJECT: Resolution No. 4780 - Amending the City’s Annual Budget for
Water Fund, Wastewater Fund, and Street Maintenance Fund
Appropriations for the Fiscal Year Ending June 30, 2017 to include
the Purchase of Property at 801 North Rouse Avenue

RECOMMENDATION: Approve Resolution No. 4780 - Amending the City’s Annual
Budget for Water Fund, Wastewater Fund, and Street Maintenance Fund Appropriations for the
Fiscal Year Ending June 30, 2017 to include the Purchase of Property at 801 North Rouse
Avenue.
BACKGROUND: ** This item provides budgetary support for Resolution 4773 - purchase
property located at 801 N. Rouse Avenue. More project details can be found in the Commission
Memo for the purchase resolution. **
This fall, the approved Capital Improvement Plans contained item PW04 – Purchase of Property
at 801 N Rouse Avenue. The item was scheduled in Fiscal Year 18, with a total estimated cost
of $300,000. The costs were proposed to be split between the Water, Wastewater and Street
Maintenance Fund.

In working with representatives of the property owner, we would like to move forward with the
purchase in the current fiscal year. We propose amending the FY17 Budget to include the total
estimated project cost, which will cover the property purchase and securing the site and/or
demolition of the structure on the site after it is in city ownership.
UNRESOLVED ISSUES: Costs for demolition of the structure and securing the site have not
been finalized at this point. We intend to work within the budgeted amounts.
ALTERNATIVES: Do not proceed with the purchase; Arrange purchase to occur on or
after July 1, 2017 (in fiscal year 2018); or others, as suggested by the City Commission.
FISCAL EFFECTS: The Fiscal Year 17 (current) budget will be amended to increase
expenditures in the Water Fund, Wastewater Fund, and Street Maintenance Fund by $100,000
each, totaling $300,000. Existing cash-on-hand in each fund is available to support the purchase.
Note: We were planning for deficits in the Street Maintenance Fund capital plan in FY17 &
FY18. However, we have cash available due to changes in the street reconstruction projects
(specifically, West Olive being replaced by East Olive.)

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
AMENDING THE CITY’S ANNUAL BUDGET FOR WATER FUND, WASTEWATER FUND,
AND STREET MAINTENANCE FUND APPROPRIATIONS FOR THE FISCAL YEAR ENDING
JUNE 30, 2017 TO INCLUDE THE PURCHASE OF PROPERTY AT 801 N ROUSE.
WHEREAS, the City Commission did, on the 20th
day of June, 2016, after due and proper legal
notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2016-2017 (Fiscal Year
2017); and
WHEREAS, Property Purchase at the corner of Rouse and Aspen (PW04) streets was listed for
funding in Fiscal Year 2018 in the most-recently adopted Capital Improvement Plan; and
WHEREAS, the need to move the Property Purchase at the corner of Rouse and Aspen (PW04)
item from Fiscal Year 2018 to Fiscal Year 2017 exists; and
WHEREAS, the City Commission did, on the 27th day of February, 2017, after due and proper
legal notice, conduct a public hearing on proposed amending the municipal budget.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, to wit:
Section 1 – Appropriation Changes
The City Commission of the City of Bozeman, Montana, does hereby authorize the following
changes to expenditures:

Additions: This project and amount is added to the FY17 budget.
Water Fund – Property Purchase (PW04) $100,000
Wastewater Fund – Property Purchase (PW04) $100,000
Street Maintenance Fund – Property Purchase (PW04) $100,000
Total Appropriations Changes: $300,000
Section 2 – Use of Cash on Hand in the Water, Wastewater, and Street Maintenance Funds
The increased appropriation will be funded with cash on hand in the Water, Wastewater, and
Street Maintenance Funds.
Section 3
Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full force
and effect on July 1, 2016.
Section 4
That should it be found by any court of competent jurisdiction that any section, clause, portion,
sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations,
that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all
other portions, sections, words, clauses, phrases, or paragraphs of this document shall remain in full force
and effect.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 27th day of February, 2017.
