The Commission of tile Cl ty of Bozeman met in regular session in the
Commission Room, City Hall Bui.Lding, Wednesday, October 23, 1963 at 1:00 o'clock
p.m. .Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow,
City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the
Clerlc.
The following proceedings were had:
Minutes of the .Last regular session were read and it was moved by Commis-
s ioner Morrow, se conded by Comrrtis sioner 3.edi vy, tha t the minutes be approved as
read and the motion was carri ed by the following Aye and No vote: those voting
Aye being Mayor staudaher, Commissioner Morrow and Commissioner Sedivy; those
voting No, none.
Plat of Pleasant Valley Subdivision ++ (Jack French)
The Commission was referred to its action of October ~, 1~63, regarding
Mr. ,Taele French IS presen ta tion of his proposed pIa t of land to be known as
Pleasan t Valley Subdi vlsion, and the Commiss ion's re turn of the proposed pia t
to the Bozeman Ci ty-County .P .Lanning Board for its recommenda tion to provide an
area for park recreation purposes.
The Ci ty Manager presented a letter addressed to the Commission from the
Secretary of the Bozeman Ci ty-County Planning Board, dated Oc.tober 2:Ii, 1963,
which set forth an extract of the minutes of the October 21, .L963, minutes of
that Board as follows:
"Ralph Aaker, speaking for the Commission of Galla tin County,
informed the board that Gal.Latin County desires all Park areas be
administered by the Ci ty of Bozeman so long as they are located
within the area of jurisdiction of the Planning Board. This posi-
tion is taken since the County feels the Cl ty is better equipped
through its Park Depar 'tr1en t to adminis ter ParKs. FOllowing the
reading of a letter from City Manager Oscar Cutting referring the
plat of Pleasant Valley Subdivision back to this board for action
on Park requirements it was moved by C. v. llenderson, seconded by
Harold Klumph that the Park requirements for ~leasant Valley
Subdivision be met either by deeding of land to the City or by
payment of equiva.Lent cash value to the City, whichever is deemed
by the City Commission to be most advisable. A preference for
deeding of land was inCluded in the motion. Motion carried."
Following a discussion of the matter and in concurrence with the reco-
mmendation of the city Manager, it was moved by Commissioner sedivy, seconded by
Commissioner Morrow, that, subject to Mr. French'S deeding land to the City of
Bozeman to provide for park requirements as approved by the City, the City approve
the plat and the City Manager as Director of Public Service be authorized to sign
for the City of Bozeman and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commis-
sioner Morrow; those voting No, none.

for the stipulated lump sum amount of $3,uOO.uo. The City's offer having been

In concurrence with the recommendation of the City Manager, it was moved
by Commissioner Morrow, seconded by Commissioner Sedivy, that Resolution No. llUl
be passed and adopted and the Mayor and the C.lerk of the Commission authorized
and directed to sign the deeds as provided in said resolution No. .lIUl, and said
deeds be delivered to Mr. Graf upon receipt of the sti~11ated payment. The
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Staudaher, Commissioner J.Vlorrow and Commissioner Sedivy; those voting
No, none.
Purchase of Copper Pipe
The City Manager reported the City is in need of a supply of copper pipe

Request for Driveway Exceeding 20'

The City Manager reported that V~. S. Stutsman had requested that he be
granted permission to construct a driveway in excess of 2u feet in width to pro-

Right-or-way Easements
Special Improvement District No. 432
Ass't. City Manager Frys~ie, acting as right-of-way agent for the city of
Bozeman, presented the fo~lowing easements, permits and deeds signed by the res-
pective property owners and granting rights-of-way for the construction of proposed
sanitary sewer lines in Special Improvement District No. 432, also, proper claims
for such payments for the right-Of-way as stipulated:

The Commission was informed the easements were drawn on tne standard form
which had been used for like transactions, however, in some instances minor alter-

a tions reflecting special considera tions had been made when demanded by those
grantors, and that the claims were in all cases in amounts of, or less than, the
maximum figures authorized to be offered by the Commission during its meetings
of December 12, 1~62 and January 16, 1963.
Right-of-way Agent Harold Fryslie assured the Commission that the above
easements if accepted by the Commission would provide a proper risht-of-way for
the major portion of the construction of the improvements contemplated for the
district, other than the right-Of-way across the Roy T. Walton property which is
now under condemnation proceedings as instructed by the Commission on September
25, 1963, and a portion of the line to be insta~led in Olive Street extended
between 11th and 15th Avenues.
The documents having been previously approved as to form by the Gi ty
Attorney and in concurrence with the recommendation of the City Manager, it was
moved by Commissioner Morrow, seconded by CommisSioner Sedivy, that the easements
be accepted and approved and the Mayor and the Cierk of the Commission authorized
and directed to sign the easements for the City of Bozeman, and that the cl-aims
for payment as filed be likewise approved. The motion was carried by the fOllow-
ing Aye and No vote: those voting Aye being Mayor Staudaher, CommisSioner
Morrow and Commissioner Sedivy; those voting No, none.

2.ue.U6u of the Bozeman Municipal Code. The motion was carried by the fOllow-
