City Manager Fryslle, City Attorney Berg and the Clerk. Reverend Monroe J. Wilcox of thePirst Methodist Church opened the meet- ing with a prayer and the following proceedings were had: Minutes of the last regular session were read and it was mo~ed by Commis. sioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Bids forS.I.D., No. 432 -- Westside Sewer This was the time and p~ace set tor receiving bids tor construction of the sewer lines to be constructed in Special ~provement District No. 432. Affi- ~ davi t of publica tion of "Noti~~" to Bidders~ was presented. Ten sealed bids on this project were on fiie. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids be opened and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudahe~, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Affidavits of publication of the individuaJ. "Notice to Bidders" tor each separate district were pre- sented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids for each district be opened and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Annual Meeting of Middle Creek Water Users' Association Notice has been received of the annual meeting of the Middle Creek Water Users' Assooia tion to be heJ.d November 18th, 1963. It was moved by Commis- sioner Morrow, seoonded by Commissioner Sedivy, that Ass't. City Manager FrysJ.ie be appointed as the offical representative of the City of Bozeman at this mee ting and be authorized to vote the stock of the Ci ty of Bozeman and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. 366 I Civitan Club Frui t Cake Sale (jl/lentally Retarded Children) The written request of the Civitan Club for permIssion to conduct a frui t cake sale .on No'vember 20th, as' a benefit tor mentally re tardedchildren was presented. I Muscular Dystrophy Fund Drive The wri tten request of Mrs. Ramona Mahlaff, Chairman of the Muscular Dystrophy Drive in Bozeman, that the Rainbow Girls and DeMo!ay Boys of the City be permitted to conduct their -annual house to house march or drive against Muscular Dystrophy, on the night of Wednesday, November 13th. at 6:00 p.m. was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that permiss10n to conduct the drive be granted and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor staudaher, Comm18sione~ Sedivy and Commissioner Morrow; those voting No, none. Right-or-way Easements -- Special Improvement District No. 432 Ass't. City Manager Frys!ie, acting as right-of-way agent for the City of Bozeman, presented the tollowing easements signed by the respective pro- perty owners and granting rights-of-way for the oonstruotion of proposed sani- tary sewer lines in Special Improvement District No. 432, also, proper cJ.a~s tor suoh payments for the right-or-way as stipulated: Name - Hazel M. and H. Kenck and Dorothy Kenck, and Wi!l!.m J. and Anna Sutter Maurice L. and Clara Eldridge Amount of' Claim (None) INOne) 149.00 149.00 $262.34 $232.00 I The Commission was informed the easements were drawn on-.the standard form I which had been used for like t'ransactions, however, in some 1natances minor alter- ations reflecting special considerations had been made. when. .demanded by those grantors, and that the claims were in all cases in amounts of, or .Less than, the maximum figures authorized to be offered by the Commission during its meetings of December 12, 1962 and January 16, 1963. The documents having been approved as to form by the City Attorney and in concurrence wi th the recommendation of the Oi ty Manager, it was moved by Commis- sioner Morrow, seconded by CommiSSioner Sedivy, that the easements be accepted and approved and the Mayor and the Clerk of the Commisslon authorized and dir- ected to sign the easements for the City of Bozeman, and thbt the claims for payment as filed be likewise approved. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commlssioner Sedivy; those voting No, none. ClaIm -- Annual Assessment for S.I.D., No. 424 (New City Yards) A clalm in the amount of $2,108.05 was presented to authorize the DIrector of Finance to pay the annualspeeSd &asessment for Special Improve- ment District No. 424 on all of block 29, except lots One (1) and Two (2), and all of block 30 In Imes additions, or the property known as the new city yards. It was moved by Commissioner Sedivy, seconded by CommiSSioner Morrow, that the claim be approved and the Direotor of Finance directed to issue a warrant In payment. The motion was oarried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow, I those voting No, none. Reports The following reports were presented: Cemetery We ter Collec tor The City Manager oommented on the reports and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the tol1owing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. SID No. 432 Award of Contract I The engineers having completed their oheok of the extensions and final tabulation of all bids submitted, recommended that Haggerty-Messmer Company, Bozeman, Montana, be awarded the oontract for 'tttft"oonstruotion ot the sewer lines ~\ ,.; in Special ]mprovement Distriot No. 432, the firm's base bid of $190,816.80 be- ing the lowest and best bId submitted, also, the City Manager in conourrenoe with the engineers recommended the award and that clay pipe be used In the con- struction of all lInes. It was moved by Commissioner Morrow, seconded by Commis- sioner Sedivy, that, subject to: (1) the sale ot the bonds of the dlstiot, (2) the securing ot adequate rights-ot-way to lay the lines and (3) the priop approval of the Water Pol!ution Control Agency of the U.S. Pub!ic Health SerVice, 367 368 Haggerty-Mes smer Company be awarded the con trae t for . the-construction .1n Special Improvement District No. 432 a. recommended" on the baats of. t"ttJIt#/tIF/~'/tIfftlr/t its low base bid of $190,816.80, and the bid security of the unsuccessful bidders be returned. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; SID No. 436 Award of Contract I those voting No, none. The engineers having completed their check of the extensions and final tabulation of all bids submitted, recommended that Cave Construction Company, Great Falls, Montana, be awarded the contract for the construction of the water mains in Special Improvement District No. 436, on the basis of the firm's ~id of t19,914.15 as being the lowest. and best bid submitted. It was moved by Commissioner Morrow, seconded by Commissioner SediVY, that, subject to the sale of the bonds of the district, Cave Construction Company be awarded the contract tor the construction in Special Improvement District No. 436 as recommended on the basis of its low bid of t19,914.15, and. the bid security of the unsuccess. ful bidders be returned. The motion was carried by the follOWing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Awarding of Contracts Deferred -- SID No's. 427, 428, 430, 431, 433 and 434 Pending a turther study of the bids submitted tor the construction of the improvements proposed for Special Improvement District No's. 427, 428, 430, 431, 433 and 434, and receipt of recommendations of the engineers, theeward ot contracts was deterred until the next regular meeting ot the Commission. I Adjournment There being no further business to come before the Commission at this time it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. ~~ 15 Mayo.. .
