HomeMy WebLinkAbout1963-11-20 I Bozeman, Montana November 20, 1963 The Commission or the City or Bozeman met in regular_ session in the Commis- sion Room, City Hall Building, Wednesday, November 2u, 1963 at 1:00 otclockp.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, Asstt. City Manager Fryslie, City Attorney Berg and the Clerk. Reverend Lawrence A. Nelson of the First Baptist Church opened the meet- ing with a prayer and the rollowing proceedings were had: Minutes or the last regular session were read and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the t:'ollowing Aye and No vote: those voting Aye being Mayor Staudaher, CommiSSioner Morrow and Commissioner.Sedivy; those voting No, none. Opening of Bids -- Water Department Backhoe This was the time and place as advertised to open the bids on file for the Cityts purchase or a new backhoe for use by the Water department. Affidavit of the "Notice of Call for Bids" was presented and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bids be opened and read as. follows: I Name of Bidder Gallatin Equipment Co. Owenhouse Her<:l.are 00. Amount of Base Bid less trade-in $2,697.10 Manufaoturer John Deere International 4,990.00 5,645.00 3,740.00 Industrial Equip. Co. Western Construction and Equipmen t Co. .The bids were referred to the Water Superintendent and the City Engineer Clark Case for tabulation and recommendation as to the award of the purchase. Discussion -- Awarding of Contraots (s.r.D., Nots. 427, 428, 430, 431, 433, and 434) I Bids opened on November 13, 1963 ror proposed paving and storm drainage in Special Improvement Districts Nots. 427, 428, 430. 431, 433 and 434 were again brought before the Commission for consideration ot contract award. Consul tant Engineers Harold Hoskins. and AssoFia tes presented their recom- mendation, ooncurred in by -the City Engineer, that the contract tor the proposed improvements be awarded to Robertson & Blos8om of Great Falls on the basis ot their total base bid, Group II, or $207,502.15, being the lowest total base bid submitted. The City Manager concurred in the recommendation of the Engineers and in recognition ot the combination on Group II bids, solicited by the City in its Call tor Bids and submitted in good faith by the lOW bidder, Robertson & Blossom. The Manager pointed out that the recommended action would necessitate the refeotion or Group I bids of the Long Construotion Company for DistrIct Nots. 427, 428 and 433, such rejection be a right reserved by the Commission 8S advertised and could be based upon the Long Construotlon Companyts unralthfulness and disregard of the public interest in earrying out the work 369 370 they now have under contract with the City and as further-evidenoed by it's failure to submi t bids for these projects under Group II as l"equestedby the City. Also, Mr. Robertson of Robertson Blossom had verbally appealed to the City Commission ofr it's consideration of his firm's bid on Group II,because his firm submitted bids under Group I only to meet prooedural requirements of the bid call and they would be seriously handicapped it forced to accept Felt CMtg. 11/27/63) a partial award under ei ther group. Mr. Jame8 .,.,;t>>~, Attorney, stating to the Commission he was acting as the legal representative of the Long Construction Company, protested the recommended action, as being a serious charge against that company and, in essence, requested additional time to per- mit the preparation and presentation of' properdetense. FO.Llowing a discussion Felt .. (Mt~. 11/27/63) of the matter in which Mr. ;~~t~J, City Officials ~nd also Mr. James Robertson of the Robertson & Blossom Company took part, Mayor Staudaher announced that consideration of the award of the contract for Special Improvement Distriots No's: 427, 428, 430, 431, 433 and 4134 would be oontinued at the regular meeting of the City Commission to be held at ItOO otclock p.m. on December 11, 1963, (Mt . 11/27/63) - - - - - -- I~in~ a hearrn~ by the Commis~ion of facts relatin~ to the performance by Lon~ Construction Company of current City contracts. I Agreement to Come into City (Sewer Connection -- Ray Hill property) An agreement exeouted by H. Ray Hill and Hazel M. Hill, husband and Wife, to the atfect that in return for permission to connect dwellings erected and to be erected upon their property located at 115 South Eleventh Avenue, U.36 acres looated in the NEiswt, Section 12, Twp. 2 South ot Range 5 East, M.P.M., to the City's water and sewer systems, they would agree and consent to include the property within the city limits when requested by the City was plaoed before the Commission. In concurrence wi th the recommenda tion ot the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the City accept the agreement and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. I Discussion Acceptance of Sewer Projects (SID No's. 425 & 426) During the Commission meeting of November 6, 1963, consideration of the final aoceptance of the East and South Side Sewer Projeots, SID No's. 425 and 426, was deterred to this date. Following a discussion ot the overrun ot the contract time limit on these proj.ots and possible extensions of the time limit and the assessment ot penalties, and at the request of T. G. Haggerty of the Haggerty-Messmer Company, action on the matter was again tabled until November 27th, 1963. I Utility Air Strip Gallatin Small Business Association The written request ot the Ga~latin Small Business Association that the City construct a utility air strip within the immediate vioinity ot Bozeman was placed betore the Commission., Atter discussin; it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the City Manager reply by letter to the association that the Commission favored such a project, however, because 1 of a lack of tunds favorable consideration ot such a project could not be given in the 1Dnnedia te future. '!he motion was oarried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissloner Sedivy and Commis- sioner Morrow; those voting No, ,~one. Agreement with Forest Service -- Mystic Lake Dam & Reservoir A cooperative agreement between the Forest Service, the Bozeman Creek Reservoir Co_, and the City ot Bozeman, which had been approved by the Forest Service on February lU, 196u, providing tor the repair and maintenance of the Mystic Lake Dam and Reservoir and other matters pertaining to that project was plaoed before the Commission. The City Manager advised the Commission that the stipulated repairs ot the dam had been accomplished during 196U, and the remainder of the agreement was in aocordance with standard Qperating regula- tions within the National Forest. It was moved by Commissioner Morrow, sec. onded by Commissioner Sedivy, that the agreement be approved and the Mayor and the Clerk ot the Commission be authorized and directed to Sign tor the City. The motion was carried by the fOllowing Aye and No vote: those voting Aye I being Mayor Staudaher, CommiSSioner Morrow and Commissioner Sedivy; those voting No, none. Bond &: Contraot S.I.D., No. 432 (Release of Bid Security) The oontraot documents for construction of Special Improvement Distriot No. 432, as provisionally awarded to Haggerty-Messmer Company were presented. The contraot and bond were approved as to form by the City Attorney and the Commission was advised that the oontractor had exeouted the contract documents and the performance bond. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the execution ot the contract and bond by the contractor be approved and the Clerk of the Commission be authorized to return the bid security to Haggerty-Messmer Company_ The motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Reports The following reports were plaoed before the Commission: Director ot Public Servioe Director of Finanoe I Atter oo~enting on the reports, the City Manager recommended that the reports be approved. It was moved by Commissioner Morrow, seconded by COmmis- sioner SediVY, that the reports be approved and ordered tiled. The motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, tha,t the meeting ,adjourn and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.
