The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, Deoember 11, 1963 at 1:00 o'clock
p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow,
City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berk and
the Clerk.
Reverend Paul A. Krebill, Presbyterian Campus Pastor, opened the meet-
ing with a prayer and the following proceedings were had:
Minutes of.the last regular session were read and it was moved by Commis-
sioner Morrow, seconded. by 'Commissioner Sedivy, that the minutes as read be

approved and the motion Was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy;
those voting No, none.
Hearing
Long Construction
Company
During the regular Commission meeting heid on November 2u, 1963,
Overrun of Contract Time on SID No. 424
Mr. James Felt, acting as the attorney for Long Construction Company, was notl-
, ..
fied that, at his-request, an informal hearing would be conducted by the City
Commission on December 11, 1963, to bring out faats in regard to the overrun
of the contract time limit on Special Improvement District No. 424, and relating
to the performance of the Long Construction Company on its current City con-
tracts. The City Manager introduced written reports addressed to the City
Commission and the City Engineer prepared by Harold Hoskins and Associates,
the consultant engineers retained by the City for the project in question,
which set forth numerous deficiencies of the contractor in the conduct of the

work under this contract, including a continued lack of competent superviSion,
diversion of forces, equipment, and materials to private work, and failure to
meet speoifioations on work aocomplished. The Engineers recommended that the

City of Bozeman partially accept the improvements of Special Improvement
District No. 424 pending completion of the work next summer, that no extension
of time be granted Long Construction Company fot'the completion of the paving
improvements of the district and that funds to ensure completion of the work
and to pay costs of excess engineering be retained until final settlement is
made. Mr. F. L. Oliver, General Superintendent of Long'Construction Company,
ooun tered that his company had been seriously handioapped in toe carrying out
of its construction operations because of the late completion of the storm
drainage contract in the district and presented other_-informa,tion from the
company's progress schedule whioh he believed would fUlly jU,stify a ma ter1al

extension of the time limit by the Commission and that his company should not
be penalized for the late completion. The City ~anager concurred in both the
findings and recommendations of the Engineers and it was accordingly moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the City partially
accept the contract work and release all of the retained contract earnings on
Special TImprovement District No. 424 to Long Construction Company, excepting

the following amounts:

The motion was carried by the following Aye and No vote: those voting
Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those

Presentation of Street Light Award, Housekeepers Club (Request for Street Light)
Mrs. George Buttleman, President, Mrs. P. L. Nielsen, Treasurer, and Mrs.
Thomas Morgan, State Offioer, of the Bozeman Housekeepers Club, appeared before
the Commission to request that an additional street light be placed on Buttonwood
Avenue, or in the southwest corner of Bogart Park if the City deemed it more
."" advisable. They, also, presented the club's check in the amount of $100.UO as
a contribution to assist in the maintenance of the light, as a part of the
Club's "Better Street Lighting for the City" program. In accepting the gift,
Mayor Staudaher commented that the check represented the fourth such contri~
bution by the CLub in this highly commendable program. It was moved by Commis-
sioner Sedivy, seconded by Commissioner Morrow, that theglft to the City be

accepted and the City's appreciation noted. The motion was carried by the

Sedivy and Commissioner Morrow; those voting No, none.

Rejection of Bids by Long Construotion Company (District Nos. 427, 428, and 433)
Acting upon information supplied to the City Commission by Harold Hoskins
and Assooiates, the consultant engineer retained by the City to perform the
engineering services on its Special Improvement Districts, by the City Engineer
and by the City Manager, it was moved by Commissioner Morrow, seconded by
Commissioner SediVY, that under the right reserved by the City to reject any
or all bids in the interest of the City, the individual bids of Long Construction
Company submitted under Group I for Special Improvement District Nos. 427, 428
and 433 be rejected because of Long Construction Company's delinquency in its
performance of former oontracts with the City of Bozeman. The motion was carried
by the following Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Morrow and Commissioner Sedivy; those voting No, none.
Contract Awards of Special Improvement District Nos. 427, 428, 430, 431, 433
and 434 (Paving)
The City Commission was referred to its action of November 2u, 1963 and
its tabling of the awarding of the oontracts for Special Improvement District
Nos. 427, 428, 430, 431, 433 and 434 (Paving) until this meeting. The City
Manager reiterated that he ooncurred in the recommendation of Consultant
Engineers Harold Hoskins and Associates and the City Engineer, that the contraots
for the proposed improvements in Special Improvement Distriot Nos. 427, 428, 430,
431, 433 and 434 be awarded to Robertson & Blossom of Great Falis on the basis
of its total base bid, Group I I, of $207,502.15, being the lowest total base bid
submitted, and in recongnition of the oombination on Group II bids, solicited
by the City in its "Call for Bids" and submitted in good faith by Robertson &

Blossom of Great Fails, Montana.
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that
the contract for construction of the improvements in the following districts ee
awarded to Robertson & Blossom, Great Falis, Montana, on the basis of that
company's bid under Group II, in the following amounts:

Delegl!ltion
Request for Feasibility Survey for Utility Air Strip
Guy Sperry, Manager of the local Chamber of Commerce, and Wayns EdsaLl as
representatives of a group of local aviators appeared to request that the City
request the Montana Aeronautics Commission to conduct a reasibili ty survey for
a utiiity air strip in the ~ediate vicinity of Bozeman. Mr. Edsall spoke
on the local interests and benefits of the airstrip. The City Manager reported
information obtained at a recent meeting with Mr. Lynch of the State Board and
advised that the Montana Aeronautios Commission would be agreeable to make
such a survey without cost to the City, upon the City's request. It was moved
by Commissioner Sedivy, seconded by Commissioner Morrow, that subject to the
approval of the local Gallatin Field Board the City would favor requesting
the feaSibility survey by the Aeronautics Commission. The motion was carried
by the following Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Sedivy and Commissioner ~rrow; those voting No, none.

General Services Administration
Proposed Lease of Parking Lots to
Ci ty of Bozeman
The City Manager presented a proposed lease from the General Services
Adminstration offering to lease the area now used by the City in its operation
of City parking lots located in a portion of Block "A", Blacks Addition, or
part of the site chosen by the Federal government for its proposed federal
building and postoffice, for $50.00 per month for a period of time ending
May 31, 1964. Action on the ma tter was tabled until a la ter da te pending
receipt of additional information.

Adjournment
There being no further business to come before the Commission at this
time it was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the meeting adjourn and the motion was carried by the following Aye and

Commissioner Morrow; those voting No, none.
