HomeMy WebLinkAbout1963-12-18 388 Bozeman, Mon tans December 18, 1963 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, December 18, 1963 at 1:00 o'clook p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commis- I sioner Morrow, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk. Mayor Staudaher opened the meeting with a prayer and the following pro- ceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the minutes as read be approved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Final Acceptance SID Nos. 425 & 426 (Sewers) The Commission was referred to its meeting of November 27, 1963, and the discussion of the Oi ty' s final acceptance of the contract.~ work and settle- ment of the over-run of the contract time by Haggerty-Messmer Company in its completion of the sewers constructed in Special Improvement Districts 425 and 426. The Ci ty Manager sta ted tha t he, the Ci ty Engineer and the Ci ty Attorney had given considerable study to the project and were now prepared to make the following recommendations in regard to the completion of this contract work: 1) That the contract work be finally accepted based upon the certificates of completion as submitted by the Consultant Engineers. 2) That in addition to the contract time extension of 34 days as recommended by the Consultant Engineers, the contract time be further extended 20 days for adverse weather conditions in June and further extended an additional Iv days for additional work required in crossing U.S. Highway No. 10, for a total extension of 64 days, or a net over-run of the contract time totaling 82 days. 3} That the excess engineering for the 82 days over-run of the contract time be charged to th~ contractor and the resultant amount, not to exceed $50.UO per day, be withheld from the amount due the contractor in final settlement. I 4) That a claim of the ConSUltant Engineers for excess engineering be approved for the final 92 days of the construction period and in an amount not to exceed $5U.UO per day; the ten day exteftslon period for crossing U.S. Highway No. 10 being a proper charge to Special Improvement District No. 425. 5) That the liquidated damage proviSion of the contract for over-run of the time limit be waived. 6) That 50% of the damage claim of David Vaughn, filed against this contract in the amount of $325.UO, as approved by the Commission 6 November 1963, be charged to the contractor as his responsibility. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, I that the City accept the contract work performed by Haggerty-Messmer Company in Special Improvement Districts 425 and 426 and app!y the oontract penalty provisions in accordance with the foregoing recommendations and the motion 389 was oarried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Mid-Montana Life Insurance Association Discussion of City License I Mr. H. M. Reid and John Brooksma, representatives of the Mid-Montana Life Underwriters, appeared to discuss recent changes in Montana State Law and its application to the licensing of life insurance agents by cities and towns. After discussion, the Commission informed them the matter would be taken under advisement after referral to the City Attorney for further study. Civil Defense (Board of Gallatin: County Commissioners) The Board of Gallatin County Commissioners appeared to discuss the pro- gress of the civil defense program in Gallatin County and the possibility of the hiring of a part-time director to carryon and expedite the program as originally pl~nned. The Commission requested the County Board to make a fur- ther determin~tion of the availability of a director and at what cost. The matter was ta~led for the present. Discussion of Fire at City Landfill Dump Allen D. Aksamit , . Mr. Allen D. Aksamit, the proprietor of a trailer court which is located on land lying north of the City limits and south of the present site of the City's landfill dump, appeared and registered his complaint about the unpleasant copditions in the area caused by a fire burning at the dump. The City Manager informed Mr. Aksamit that the fire had been caused by someone other than City personnel and that the City had, as yet, been unsuccessful in its attempt to extinguish the fire as it was burning under the landfill and its intense heat made it impossible to lesson its progress by the use of water; however, Mr. Aksamit was assured that the City is using every means to remedy the situation. I Police Department Confirmation: Donald E. Strang Harold J. Veltkamp Letters of confirmation from Chief of Police Saunders, stating that I Donald E. Strang and Harold J. Veltkamp had completed their six months period of probation as police officers and recommending that they be confirmed as regular members of the Police Department were presented. The City Manager concurred in the recommendation of the Police Chief and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the appointment of Donald E. Strang as a regular member of the Bozeman Police Department as of November 30, 1963, and that of Harold J.Veltkamp as of December 1, 1963 be confirmed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those vpting No, none. Examination of Depository Bonds The Commission proceeded to examine the Custodian's Reoeipts for Depository Bonds held by the Direotor of Finance as security for City funds deposited in Bozeman banks. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the securities be approved and a list thereof 390 be set forth in full in the minutes of this meeting and the mot10n was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. In concurrence with the recommendations of the City Manager, it was moved by Commissioner Sedivy, seconded by Commis. sioner Morrow, that the above applications be approved and the Director of Finance be directed to issue licenses in accordance therewith and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Appointment of Appraiser of City Owned Property (S.M. West) The Commission was referred to its action of October 2, 1963, which declared the General Services Administration's counter offer in the amount of $63,610.UO be declared unrealistic and unacceptable for the purchase of the City owned parking lots located in a portion of Block "An, Blacks Addition, and stated the the City's original offer in the amount of 1179,340.00 would stand. As the General Services Administration has turned the matter over to the Department of Justice for adjudication in the Federal courts, the City Attorney requested that he be provided with the services of an independent profeSSional land appraiser and requested that S. M. West of Billings, Montana be retained by the City to assist him in his presentation of the City's case in the Federal court. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the services of Mr. West be retained on the basis of Mr. West's letter offer dated December 11, 1963 and the motion was carried by the fOllOWing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Approval of Location of Proposed Kirkwood Baptist Church (N. 15th & W. Beall) A plat to indicate the proposed site of the Kirkwood Baptist Church to be located at the northwest corner of the intersection of North Fifteenth Avenue and West Beall Street was presented. The City Manager stated the City= County Planning Board had approved the location and recommended the City like- wise approve the location for the construction of the church subject to its complianoe with the "A" Residence Zone provisions of Chapter l7.U8, Zoning, of the Bozeman Municipal Code. It was moved by CommiSSioner Morrow, seconded by Commissioner Sedivy, that approval of the site as recommended b. approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. License Bonds George Wellhouser (Plumbing, Gas Fitter and Electrician) In compliance with Chapters 15 and 16 of the Bozeman Munioipal Code, the plumbing, gas fitter and electrical bonds of George Wellhouser, Manhattan, Montana were presented for approval. The City Manager reported that the Building Inspector had approved the concern and recommended that the bonds be approved. The City Attorney approved the bonds as to form and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bonds be I I I I 392 approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; Seventh & Main Conoco Dri veways I those voting No, none. The City Manager presented a sketch of a proposed rearrangement of the driveways leading in to the Continental Oil Company's service station at Seventh Avenue and Main Street and reported that the company requested an additional curb cut on Seventh Avenue adjacent to the ailey. After discussion, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the placement of the additional curb cut be denied. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Reports The following reports were presented: Cashier Cemetery The City Manager commented on the reports and recommended their seconded by Commissioner Morrow, approval. It was moved by Commissioner Sedivy,/that the reports be approved Director of Public Service and ordered filed and the motion was carried by the follOWing aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner I Morrow; those voting No, none.
