HomeMy WebLinkAbout1963-06-19 .. 272 Bozeman, Montana June LV, lV63 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, June 19, i963 at i:UU o'ciock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, I City Manager Cutting, City Attorney Berg and the CLerk. The following proceedings were had: Minutes of tue .l.<:lst regular session were read and it was moved by Commis- sioner Borrow, seconded by Commissioner Sedivy, that the ~inutes be approved as read and the motion was carried by the following Aye and No vote: those vo ting Aye being Ma yor Staudaher, Commissioner Morrow and Commissi oner Sedivy; those voting No, none. Sub-Contract S.T.D., No. 424 An agreement between Lonp Construction Company of Billings, ~ontana and Sharp & Kearney of Bea verton, Oregon was presented. This agreement provided tha t S.harp & Kearney will perform concre te cU.rb and gutter and allied contract items as a sub-contractor on the contract awarded Long Construction Company for cons true tion in Special Improvemen t Dis tric t No. 424. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the sub-contract be approved and accepted subject to the provision that it be in compliance with all iegal requiremen ts of Montana law, and tha t the Ci ty Manager be direc ted I to notify the contracting parties of its action. 'ilie motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commis s ioner Sedivy and Commissioner Morrow; those voting No, none. Appointment of City Engineer Roman C. Fargo The Ci ty ~.~anager announced his appoin tmen t of Roman C. Pargo of Lewistown, Montana, as City Engineer to be effective as of July 1st, 1963, or at an earlier date if possibl.e. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Commission concur in the appointment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. City Census City Attorney's Opinion As requested, City Attorney Berg presented his written opinion regarding the authority of the City Commission to conduct a census in the City of Bozeman for the purpose of determining whether the population of the Ci ty noW exceeds 15,UUU, and would therefore, require, under the provisions of Section 11-3211, I Revised Codes of Montana, 1947, five instead of three City Commissioners. Followinp; a review of the City Attorney's opinion, the Commission directed Ci ty Hanna:er CU tting to correspond wi th the TIni ted Sta tes Bureau of Census as to the agency's availability to conduct an inierim census for the City at the earLiest possible date prior to 1970. J.C's. Drilling Holes in Sidewalks to Display American Flags Tom O'Brien, President of the local Junior Chamber of Commerce, appeared to report that its program to display American flags by attaching brackets to the parkinp, meter posts, as approved by Commission action on April 11, 1962, I is experiencing difficulty because of the location of some of the me ter pos ts. He requested permission be granted his organization to ins ta 11 sidewalk socke ts to improve the location of their flags where possible. 'l'he Ci ty lVJ.anager reco- mmended tha t the permission to install such sockets ~)e granted and it was moved v" by- Commissioner Sedivy, seconded by Commissioner Morrow, that the requester per- Y'"ission be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. J.C's. Discussion of Licensing of Carnival Tom O'Brien also discussed with the Commission the City's provisions and policies, particularly as to licensing, in connection with the proposed plan of the J.C's. to sponsor Siebrand Brothers Carnival within the City during July. Pending Mr. O'Brien's obtaining additional information on the matter, and at his request, action on the matter was deferred. J.C's. Municipal Bu31ding Program / It was reported by Tom O'BRien, President of the local J.C's., that 85% I of its membership had gone on record as favoring that organization extending to the City its full support and to render every possible assistance in any pro- f/ p08a18 to construct new building facilities10f the City's general offices and police and fire departments that may be recommended by the City Commission. Pe ti tion Improvement of South 19th Avenue as Extension of Hyalite Secondary Highway The Commission proceeded to examine a petition signed by some 89 individuals petitioning as fOllows: "We, the undersigned, respectfully reques t tha t the Hyali te secondary road, now planned to go to the intersection of College Ave. and 19th St. be continued due north to H1ghway 191, as part of the Secondary Road system:" Pending further study of the matter, no official action was taken. Sidwalks Charles R. Swart, R. D. McDonald During its meeting of May 29, 1963, the Commission completed its survey of Walks and Curbs within the City. The City ~anager presented two written protests requesting the Commission's reconsideration of its action as it per- tained to two properties as follows: I Name Loca tion Cha.rles R. Swart R. D. Lincoln To again review the sites, the meeting was recessed at 2:55 p.m. and a.r,:ain convened at 3:15 p.m. It was moved by Commissioner rv:orrow, seconded by Commissioner Sedivy, that the sidewalk replacement ordered to be made on the 273 274 premises at 324 S. Grand be deferred for a period of one year, and the side- walk ordered to be constructed at 119 W. LincOLn be rescinded; however, both ac tions to be sub jec t to further study and reconsidera tion in the future. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Charles H. Odegaard National Recreation Association CharLes H. Odegaard, Northw8st District Representative of the National Recreation Association, was introduced by City Recreational Director GLen White. ~~r. Odegaard commented on his observation of the City's recreational program and advised his organization would be pleased to assist the City in this program whenever called upon. Miscellaneous vlalks & Curbs (1963) Order to Repair and/or Construct The City Engineer office, under provisions and authority of Sections 11-\:16'1 and 11-2226, R. C. M., 19<W', and Chapter '.:J.36 of the Bozeman Municipal Code, relating to construction of WaLks and Curbs without formation of a Special Improvement District, submitted lts final recommendations in detail With refer- ence to needed repairs and new instalLation of walks and curbs in the City. The City Manarr,sr stated that, from time to time during the period specified, additional walks and curbs which require repair or new installation may be discovered and be added to the aforementioned recommendations, and recommended tha t the report be aclopted, and tha t the CLerk of the Commission be authorized and directed to advertise for bids for the work. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the final report as to the repair and ins talla tion of MisceLlaneous WaLk9! and Curb for 1963, incLuding those walks and curbs now or hereafter determined to require repair or new installa tion be and the same is hereby accepted, approved, adopted, ordered fiLed and that the Clerk of the Commission be authorized and directed to advertise for bids for this work for an opening date of July 10th, 1963. Said adopted report is hereby referred to and made a part of this minute entry by such adoption and reference for the purpose of designa ting and identi- fying the streets and avenues on which such new installations or repairs are to be made and such new installation or repairs are hereby ordered to be made under and pursuant to the provisions of Section 11-967 and 11-2226, R.C.M., 1947, and Chapter 9.36 of the Bozeman Municipal Code, and the City Manager is hereby instructed to give or cause to be given, to each owner or agent of such owner, or either, of the property along which such new installation or repair is to be macle, written or printed notice of such order, as required by the provisions of Section 11-2226, R.C.W., 1947, and Chapter 9.36 of the Bozeman Municipal. Code, and s1Jch new installations or repairs are hereby ordered to be made wi thin thirty days from the da te of such notice, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.
