Present were Mayor Staudaher, Com- missioner Sedivy, Commissioner Morrow, City Manager Cutting, City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it'iJaS moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carr1.ed by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Com- missioner Sedivy; those voting No, none. The Commission dispensed with the reading of the minutes of the Special Commission Meeting held on June 20th, 1963. Lc:gi on Housing Rental -- SID No. Lf24 Howard Erwin, Manager of the Bozeman American Legion Veteranst Housing Project, appeared before the Commission to discuss that project's participating with the City in the payment of the assess- ments against the property upon which the housing is located and assessed to provide payment for the improvements for the construction of Special Improvement District No. 42l;. Following a mutual agreement between the City Commission and Mr. Erwin, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the rental of the property be increased $1)0 per month effective November 1, 1963. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Public Hearinn; -- Special Improvement DistrL:t No. 432. This was the time Bnd place set by Commission Resolution No. 1078 to hear protests to the creation of Speical Improvement District No. 432. Affidavit of publication of Notice and the Clerkt s Mailing Certific'1te stating that all property owners had be'3D notified as required by law were presented. The Commission was informed that no written protests to th- creation of the . district were on file and no one appeared to verbally protest the action. The City Manager re- commended that the district be created and the City Attorney instructed to preparr~ a resolution to create the district. Commission Resolution No. 1080, entitled: ~ COMMISSION RESOLUTION NO. 1QgQ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT NO. 432 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN OUTFALL FOR THE PRUPOSE OF CONSTRUCTING AND INSTALLING AN OUTFALL SEWER FROM BLOCK 3, ROYAL VISTA ADDITION TO THE CITY OF BOZEMAN TO POINTS OF INTERSECTION WITH EXISTING SANITARY SEWERS AND SEPTIC SYSTEMS WITHIN THE CONFINES OF MONTANA STATE COLLEGE. prepa.red by the City Attorney was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that Commission Resolution No. 10SO.be passed and adopted to create Special Improvment District No. 432 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow$ those voting No, none. 277 278 Bid Opening New street Sweeper ,ulcl Sale of Old Sweeper This was the time and place set for opening bids for the purchase of a new street sweeper and the sale of the City's used Elgin Street King sweeper. The affidavit of the publication of the "Call for Bids" were presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. In concurrence with the request of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the awarding of the bid be deferred for a period of at least one week. The motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher, CommiBsioner Morrow and Commissioner Sedivy; those voting No, none. 429 Bids for S. I.D.. No's. 427, 428/430 and 431 (Paving and Storm Drainage) This was the time and place set for the opening of bids for the construction of pavement and 429 drainage improvements in Special Improvement District No's. 427, 42BJ'430 and 431. The affidavits of the individula publication of "Notice to Bidders" for each district were presented. It was moved by Commissioner MoriVow, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Si~ins Subdivision ~ - Approval of Plat The proposed plat of the Simkins Subdivision was placed before the Commission and the City Manager presented a letter received from the Bozeman City-County Planning Board stating that the Board had approved the plat as of June 19, 1963, subject to the condition that it be shown on the Plat that in case the North and South road is not continued through to Durston Road on the North then a 100 foot in diameter Cul-De-Sac must be provided at the north termination of this road on this tract. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the plat be accepted and approved subject to the recommendations of the Bozeman City-County Planning Board, and the City Manager acting as Director of Public Service be authorized and directed to sign the plat for the City and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the plat be accepted and approved subject to the recommendations of the Bozeman City-County Planning Board, and the City Manager acting as Director of Public Service be authorized and directed to sign the plat for the City. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. " JClii'2.l:L~.2...-=-":"_._Qv;r'h3;.sL0.t cc;t S_~:'n2 Tom O'Brien, President of the Bozeman Junior Chamber of Commerce, appeared to request that his organization be granted permission to suspend overhead signs across the Main Street and North Seventh Avenue entrances to the City to advertise its annual rodeo. Mr. O'Brien was referred to a like action of the Commission on July 18, 1962, and the City Manager recommended that the City grant permission to suspend the signs in conformity with the sign ordinance. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that permission to place the signs as recom- mended be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. "JC Hodeo -- (1963) Mr. O'Brien also requested thcx the Junior Chamber of Commerce be granted permission to place a ticket sales booth at the Rialto Threatre for the period July 29th thru August lOth, in connection with its annual rodeo. The City Manager recommended that the request be granted provided the organ- ization receives like per.nission from the property owner. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the 279 280 following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Com- missioner Morrow, those voting No, none. License Fw, -- Carniva~~n_so~~d by Junior Cha.mber of Cofl!l.!.~~ The matter as to the license fee to be charged the Junior Chamber of Commerce in connection with its sponsorship Siebrand Brothers Carnival during the period July 15th thru the 18th was again I' discussed. After it Was mutal1y agreed, it was moved by Commissioner Sedivy, seconded by Com- missioner Morrow, that, in view of Mr. O'Brien's statement thetthe club's share of the proceeds of the show will be donated to charitable purposes, the license fee for the period be set at $200.00, and the Junior Chamber of Commerce bear the expenses of special policing of the area. B(:;dr License fo 1963 -- Hi.h)b' s Food Center to East Main Shoppill!-~ Center A letter of application accompanied by a $5.00 transfer fee which requested that Heeb's Food Center be granted permission to transfer its 1963 Beer license to a new location at the East Main Shopping Center was presented. As the transfer appeared to be in order it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the transfer of the license be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy, and Commissioner Morrow, those voting No, none. A request from the Bozeman Civitan Service Club to conduct a U.S. Flag "Kit" sale on July 3, from 10:00 A.M. to 5:00 P.M. in front of the Buttret and Penny stores was presented. The City Manager recommended that permission to condu~t the sale be granted provided like permission be granted from the store managers. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that permission to conduct the sale as recommended be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow and those voting No, none. Thomas representing Harold Hoskins and Associates, the engineering consultant firm retained by the City to perform the engineering services on Special Improvement District No.'s 427 to 431, inclusive, had checked the extentions of all bids submitted and prepared the final tabulations. Mr. Thomas stated that the lowest bids were approximately 17% over and above the engineer's estimates and recommended that the City reject all bids on all districts. The City Manager concurred in the recommendation of the engineer, and recommended that all bids received for the construction of the improvement for Special Improvement District No's. 427, 428, 429, 430 and 431 be rejected and "Calls for Bids" be readvertised at a later date calling for a completion date in 1964. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that all bids for the construction of Special Improvement District NO's. 427, 428, 429, 430 and 431 be rejected as recommended and the motion was carried. by the following Aye and No vote: Those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow, those voting I No, none. No's. /27. to 1131. inclusive Due to the necessity of rejecting all bids received for the construction of Special Improve- ment District No's. 427, 428, 429, 430 and 431, it was moved by Commissioner Morrow, seconded by Mayor Staudaher, that the bond sales scheduled for the aforementioned districts to be held July 9th, 1963, be cancelled. The motion was carried by the following Aye and No vote; those voting Aye being Mayor Staudaher and Commissioner Morrow, those voting No, none. AlleIl..,J. To~ -- Donation. of Work (Swimming Pool) The Commission was informed that Allen J. Torpey had by letter notified that the masonry repair work he had performed at the swimming pool this year could be considered as a donation to the City's Recreational Program.
