The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, July lOth, 1963 at 1:00 o'clock

p.m. Present were Mayor staudaher, Commissioner Sedivy, Commissioner Morrow,
City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the
Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Comnds.

rected be approved and the motion was carried by the following Aye and No vote:

Award of Bid
Street Sweeper
Following the City's opening of bids on June 26, lY63, for the purchase
of a new street sweeper and the sale of its used Elgin Street King Sweeper, the
awarding of the bids was deferred for the purpose to provide time for study of
all bids in the interests of the City. The City Manager reported that the
Street department and other City officials had completed an analysis of the bids
and thm; in the interests of the City, the award for the purchase of the new
sweeper should be made to Hail.Perry Machinery Company on the basis of its bid
of $14,429.00 and its offer to purchase the old unit for $4,500.UO. It was
moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids
for both units be awarded to Hall.Perry Machinery Company and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.

Re.Advertise for Bids Special Improvement District No. 429
A petition bearing signatures of 100 % of the property owners of the pro.
perty incorporated in Special Improvement District No. 429, petitioning that
the City immediateiy re.advertise for construction bids for the improvements of
that district was placed before the Commission. It was moved by Mayor Staudaher,
seconded by Commissioner Morrow, that the Clerk of the Commission be directed
to publish a "Call for Bids" on the proposed improvements for Special Improve-
ment District No. 429, for an opening date of July 31, 1963. The motion was
carried by the following Aye and No vote: those voting Aye being Mayor

Bonds for S.I.D., No. 429
Bonds of Special Improvement District No. 429 must be sold to provide
for financing the proposed construction in the project. It was moved by Commis-
sioner Morrow, seconded by Mayor Staudaher, that the Clerk of the Commission be
directed to advertise for bids for the sale of bonds of this district in the
approximate amount of $40,000.UO, to be received August 7th, 1963, and the
motion was carried by the following Aye and No vote: those voting Aye being

Bids for Misc. W & C, 1963
This was the time and place set for the opening of bids for construction
of Misc. W & C for 1~63. Affidavit of publication of Notice was presented and
it was moved by Commissioner Morrow, seconded by Mayor Staudaner, that the bids
filed with the Clerk be opened and read and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner
Morrow; those voting No, none.

The bid was then referred to the City Engineer for study and his
reconnnendation.
Purchase of Sewer Rods
The City Manager reported that the City is in need of sewer rods and
requested that he be granted authority to purchase 235, 39"x5/l6th" rod, at
an approximate cost of $600.00. It was moved by Mayor Staudaher, seconded by
Commissioner Morrow, that authority to purchase the aforementioned be approved
and the motion was carried by the following Aye and No vote: those voting Aye

being Mayor Staudaher and Commissioner Morrow; those voting No, none.
Examination of Depository Bonds
The Commission proceeded to examine the Custodian's Receipts for
Depository Bonds held by the Director of Finance as security for City funds
deposited in Bozeman banks. It was moved by Commissioner Morrow, seconded by
Mayor Staudaher, that the securities be approved and a list thereof be set
forth in full in the minutes of this meeting and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher and Commis-
sioner Morrow; those voting No, none.

This is to certify that we, the Commission of The City of Bozeman in compliance
with the provisions of Section 16-2618 R. C. M., 1947 have this day examined
the receipts of the Federal Reserve Bank of Minneapolis, and the National Bank
of Commerce, Seattle, Washington, for the Depository Bonds held by the Director
of Finance as security for the deposit of City of Bozeman funds held by the
several banks of Bozeman and find them to be as above stated, and are hereby
accepted and approved.

Extension of Runway (Gallatin Field)
Formal Application for Funds
The Commission was referred to its action of July 3, 1963, regarding
the submission of an application to the Montana Aeronautics Commission to
request an additional interest free loan in the amount of $4,000.00 to accom-
plish the extension of the runway at Gallatin Field. The City Attorney stated
that he would rely on Section 1-81'7, R.C.M., 1947, as the City's authority to
complete the formal application for the foregoing loan and authorizing the
Mayor and the Clerk of the Commission to sign for the City in compliance with
the previous authority as granted on July 3rd, 1963. The application was
duly execu ted on tha t basis.
Award of Contract (w & C, 1963)
The City Engineer having completed his study of the bid for construction
of W & C (1963) submitted by Tschache Brothers reported that the bid in the
amount of $2,757.UO, although, approximately 3.2% above the engineer's esti-
mate, appeared to be in the best interest of the City and recommended that
Tschache Brothers be awarded the contract. The City Manager concurred in the
recommendation of the City Engineer and it was moved by Mayor Staudaher, sec-
onded by Commissioner Morrow; that the bid be awarded as recommended and the
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Staudaher and Commissioner Morrow; those voting No, none.

Report of Fire Chief
Fire Department Conference (Glasgow)
Fire Chief Penttila reported on his attendance at the First Annual
~
Montana Firemen's Conference held in.Glasgow, June 6th thru the 8th. His
report consisted of a resume of the program, its attendance and the values
derived by the City in having representatives at such meetings.
Building Movers Bond
(Cotton House Moving Co., Helena, Montana)
In accordance with the provisions of Ordinance No. 785, the Building

Movers Bond, No. B-2026l5, issued by The Standard Accident Insurance Company
as surety on Cottons' House Moving of Helena, Montana, to the City of Bozeman,
in the amount of $2,000.UO was presented. It was reported the Building Inspector
had recommended that the bond be approved and it having been approved as to form
by the City Attorney, it was moved by Commissioner Morrow, seconded by Mayor
Staudaher, that the bond be accepted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner
Morrow; those voting No, none.

After commenting on the reports, the City Manager recommended tneir
approval. It was moved by Mayor Staudaher, seconded by Commissioner Morrow,
that the reports be approved and ordered filed. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher and Commis-
sioner Morrow; those voting No, none.

Create Special Improvement District to Provide Drainage and
Paving for Portion of Spring Creek Drive "
A petition signed by owners of approximately 80% of the property affected

within the proposed district requesting the creation of a special improvement
district to provide drainage and the paving of Spring Creek Drive from Spring
Creek Road to the south line of Thompson Addition No.3, and a portion of
Highland Court was presented.
In concurrence with the recommendation of the City Manager, it was moved
by Commissioner Morrow, seconded by Mayor Staudaher, that the City Attorney be
provided with the necessary data and instructed to prepare a resolution of
intention to create the district. The motion was carried by the following Aye
and No vote: those voting Aye being Mayor Staudaher and Commissioner Morrow;
those voting No, none.
