The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, July 1'7, 1963 at 1:00 o'clock
p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow,

Acting City Manager Fryslie, Acting City Attorney Angel and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by
Commissioner Morrow, seconded by Mayor Staudaher, that the minutes as read
be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner
Sedivy; those voting No, none.
State Gasoline Tax Refund Clai~
A claim for refund of State Gasoline Tax for gasoline used by the City
in the amount of $561.60 (9,360 gallons) was presented. Acting City Manager
Fryslie requested that he be authorized to sign and submit the claim on
behalf of the City. It was moved by Commissioner Sedivy, seconded by Commis-
sioner Morrow, that the authorization be granted and the motion was carried
by the fOllowing Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Sedivy and Commissioner Morrow; those voting No, none.
AAA Pedestrian Safety Citation for 1962
Presentation of Plaque

Dean Chaffin represent1ng the Amer1can Automobile Associat1on and the
Montana Safety Council appeared to present a plaque to the C1ty as the
Assoc1ation's award of a Pedestrian Safety Citation for 1962, commemorating
the City's seven-year record of not experiencing a Pedestrian Fatality in
seven out of the past ten-year Mtg
traffic during 1/JM per1od. Mr. Chaffin complimented the City and Police 7/~4/63
Department for an excellent safety record and it was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the C1ty express its appre-
ciation of having rece1ved the award. The motion was carried by the folLOW-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Morrow and Commissioner Sedivy; those voting No, none.
Partial Payment for West Side Sewer Planning
Harold Hoskins & Assoc.
Claim No. '1122, drawn on the Sewage Disposal System Revenue Fund in
the amount of $5,OOO.UO in favor of Harold Hoskins and Associates Was pre-
sented. The Acting City Manager stated the payment was for Engineering
Services in planning an Intercepter Sewer System to serve the recently
annexed Western environs of the City of Bozeman, and in the event tne pro-

ject progresses to construction, this amount will be considered a por.tion
of the engineering fee of Special Improvement District Nu. 432. The Acting
City Manager recommended that the claim be approved and in concurrence with
the recommendation it was moved by Commissioner Sedivy, seconded by Commis-
sioner Morrow, that the claim be approved and the Director of Finance dir-
ected to issue a warrant in payment. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; those voting No, none.
Business Areas street Lighting
Bozeman Chamber of Commerce

RichardLohmuller, chairman of the Chamber of Commerce Retail Committee,
and Gene Hamilton of the Montana Power appeared to discuss the Chamber's plan
for the improvement of street lighting in the city's business area.
Mr. Lohmuller presented a resolution of the Chamber, the general contents
being as follows:

3. That the following plan be followed:
a. Design and install new lighting first
from the east interchange on Highway
90 West on Main to North Seventh.
b. Second from Main street, north on 7th
to the north interchange of Highway 90.
c. Third Babcock street from Church west
to north 8th Ave.
d. Fourth, from 7th Ave west on Main to
the present city limits.
After a discussion of the plan, it was mutually agreed that the City
Commission should be provided petitions to indicate the attitude of the
owners of the property to be incorporated within the various proposed
Special Lighting Districts.

Bond & Contract
Tschache Brothers (W & C - 1963)
Performance bond and contract documents for the contract of Tschache
Brothers awarded July lU, 1963, for the construction of miscellaneous walks
and curbs Within the City of Bozeman for the year 1963, were presented. The
bond and contract were approved as to form by the Acting City Attorney, and
the Acting City Manager reported that the City has evidence the contractor is
adequately insured and recommended that the Mayor and the Clerk be authorized
to sign the contract for the City. It was moved by Commissioner Morrow, sec.
onded by Commissioner Sedivy, that the Mayor and the Clerk be authorized to
sign the contract for the City and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Morrow and Commissioner Sedivy; those voting No, none.
Sub-Contract (w & C, 1963)
A letter of request received from the prime contractor, Tschache

Brothers, tila t the Ci ty approve its sub-contrac ting the work for the con-
struction of Miscellaneous Walks and Curbs (1963) to Fulton and Overturf,
a partnership, was presented. The Acting City Manager recommended that the
action be approved. It was moved by Commissioner Sedivy, seconded by Commis.
sioner Morrow, that the sub-contracting of the work be approved subject to
the provision that it be in compliance With all legal requirements of Montana
law and the action would not relieve the prime contractor of its responsi-
bilities to the City. The motion was carried by the following Aye and No

Ordinance No. 841
(1963 - 1964), Salary Ordinance
Ordinance No. 841, the annual salary ordinance, covering salaries of
the heads of departments and employees who are direct appointees of the
Commission was presented, entitled:

AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, FIXING
THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY
MANAGER, THE HEADS OF DEPARTMENTS, AND THE EMPLOYEES
OF THE CITY COMMISSION AS REQUIRED BY LAW.
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy,
that the ordinance be passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor staudaher, Commis-
sioner Morrow and Commissioner Sedivy; those voting No, none.
Resolution for Purchase of Road Oil
A resolution authorizing the City Manager to purchase not to exceed
25,OUO gallons of road oil during the fiscal year July 1, 1963, to June 3U,
1964, for use by the Street department in repairing pavement and for seal-
ing certain sections of existing pavement within the City from the Montana
State Highway Department was presented as follows:

WHEREAS the City of Bozeman will have need during the
fiscal year, July 1, 1963 - June 3u, 1964, for road oils for
use in repairing streets and for sealing certain sections of
existing pavements within the City, and
WHEREAS the City of Bozeman does not have proper
facilities for handling and storing the needed quantities
of oils, and
WHEREAS The Montana State Highway Department does have
quantities of the required types of oils stored in Bozeman
from which it can supply the quantities needed for the City of
Bozeman,

NOW, THEREFORE, BE IT"RESOLVED:
That an emergency does exist relative to the pro-
curement of road oils by the City of Bozeman and the City
Manager is hereby author1zed to purchase stocks in storage
in Bozeman, approximately twenty-five thousand (25,000)
gallons of road oil, this to be purcnased from time to
time during the fiscal year, July 1, 1963 - June 30, 1964,
as needed by the City of Bozeman for repair and sealing of
existing pavements, and these quantities of road oils to
be purchased at cost plus normal handling charges.
Passed and adopted by the City Commission of Bozeman,
Montana, at a regular meeting of said Uommiasion held on the
17th day of July, 1963.

Door-to-door Solicitation
Bozeman Senior Hi Key Club
It was reported the Bozeman Senior Hi Key Club had requested permission
to conduct a door-to-door package candy sale during the period July 20th to
August 2vth. It was moved by Commissioner Morrow, seconded by Commissioner
Sedivy, that the permission be granted subject to the club's first reporting
its program to the local Chamber of Commerce. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Morrow and Commissioner SediVY; those voting No, none.
Request to Defer Repair of Sidewalk Granted
Pi Kappa Alpha
A letter from Pi Kappa Alpha AlumJni, Inc. was presented which requested
that as the fraternity is planning to construct in the near future a fraternity
house on Lots 7 thru ~G, inclusive, Block 46, Capitol Hill Addition, that the
repair order of the sidewalk adjacent to the property be postponed. In con-
currence with the Acting City Manager's recommendation, it was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that postponement of

the work as requested be approved and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy
and Commissioner Morrow; those voting No, none.
