The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, July 31, 1963 at 1:00 o'clock

p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow,
City Manager Cutting, Ass't. City Manager Fryslie, Acting City Attorney Angel
and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Morrow, seconded by Commissioner Sedivy, that the minutes as read be
approved and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner
Sedivy; those voting No, none.
Minutes of the Special Meeting held July 30, 1963 were read and it was
moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes
as read be approved and the motion was carried bY' the foLLowing Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner
Morrow; those voting No, none.

Board of Adjustment
Denials of Appeals of Kirke Frantz
Kirke Frantz appeared before the Commission to discuss the matter of
the Board of Adjustment's twice denial of his appeal to secure a building
permit to construct a building on the northeast corner of Ninth Avenue and

Main. Mr. Frantz was referred to the provisions of Section l7.UB.480 of the
Bozeman Municipal Code as it applies to the powers of the Board of Adjustment
and to proper appeal procedure. The possibility of rezoning in this area was
also discussed, however, the fact that "spot" zoning is considered to be
illegal was again mentioned.
Bids for S.l.D. No. 429 (Paving and Drainage)
This was the time and place set for the opening of bids for the construction
of pa vemen t and drainage improvemen ts in Special. Improvement Dis tric t No. 429.
The affidavit of publication of "Notice to Bidders" was presented. It was moved
by Commissioner Morrow, seconded by Commissioner SediVY, that the bids be opened
and read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy;
those voting No, none.
The bids were then opened and read as follows:

Following the recommendation of the City Manager, the bids were referred

to the engineers to check the bids in detail, prepare a tabulation of the bids
received, ascertain the Lowest and best bid, and make recommendations as to
the awarding of the contract.
Proclamation "Go Western Week"
(August 4-10)

Jaycee President Tom O'Brien appeared to present a suggested proclamation
whereby Mayor Staudaher would designate the week of August 4-lv, as "Go Western
Week" and suggest to all residents of the area to follow the tradi tion of the
"Old West" by wearing western apparel. In concurrence with the approval of
Mayor Staudaher, it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that issuing the suggested prOCLamation by Mayor Staudaher be approved
and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those
vo ting No, none.
JC Rodeo Parade
Augns t 10, 1963
It was moved by Comm:tssioner Morrow, seconded by Comm:i.ssioner Sedivy,
that the City grant perml.saion to the Jaycees to stage its Rodeo Parade at
Ll:vO o'clock A.M., August Ivth, 1963. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Morrow and Commissioner Sedivy; those voting No, none.

JC Report on Seibrands Carnival
I
Tom O'Brien, President of the Jaycees, reported the organization in
connection with its sponsorship of Seibrands Carnival had realized a net
profit of $704.VO.
Bonds for City Officials
Renewal of annual bonds of the following persons in the amounts and for
a one year term beginning on the dates shown opposite their respective names
were presented:

The bonds were approved as to form by the City Attorney's office and it
was roved by Comrr'1ssioner Sedivy, seconded by Commissioner Morrow, that the
bonds be approved, accepted and ordered filed and the motion was car~led by
the following Aye and No vote: those voting Aye being Mayor Staudaher,
Comm:!,ssioner Sedivy and Commissioner Morrow; those voting No, none.

SID No. 429 Engineer's Tabulation of Bids
As directed, city Engineer R. C. Fargo and Wayne H. Dean representing
Harold Hoskins and Associates, the engineering consultant firm retained by
the City to perform the engineering services on SpeciaL Improvement District
No. 429, reported they had checked the extentions of all bids submitted and
had prepared a tabuLation of the bids. Mr. Dean stated that the bid of the
Long Construction Company in the amount of $34,935.10 is the Lowest bid and
approximately 13.8% above the engineer's estimate of $30,689.65. The total

estimated cost of the project would therefore exceed the amount of $35,UUU.uO
as set forth in ReSOl.1Jtion No. lU6d, the estimated amount necessary to cover ')
all costs for the construction of tne improvements by approximately 13.Y5%.
Mr. Fargo and Mr. Dean concurred in a recommendation that al.l bids be rejected.
Foll.owing a discussion of l.egal aspects of the case, after consulting
with property owners present and in concurrence with the recommendation of
the City Manager, it was moved by Co~~issioner Morrow, seconded by Commis-
sioner Sedivy, that the matter be tabled until the next regular meeting. The
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Staudaher, Commissioner Morrow and CommiSSioner Sedivy; those voting
No, none.
Reconstitution of Bozeman City-County Planning Board

In conformity with recent State legislation, the City Manager reported
that it is now necessary to reconstitute the local Bozeman City-County
Planning Board. In concurrence with the recommendation of the Board, Mayor
Staudaher announced his appointment of City Members to the Board as follows:

It was moved by CommiSSioner Sedivy, seconded by Commissioner Morrow,
that the Commission approve the action of Mayor Staudaher. The motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.
Curb Openings
The City Manager reported that City policy in the past has granted 10 foot
curb cuts for single drives and 20 foot cuts for double drives in both commercial
and residential areas, but now it appears the policy is not suitable for com-
mercial establishments. He recommended that the granting of curb cuts for
drives in residential areas remain the same, that curb cuts in commercial
areas be governed by the standards recommended by the American Association of
State Highway Official.s, and that any requests for openings in excess of these
figures be brought before the 60mmission for consideration. It was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the recommendation

Reinvestment -- SDS }und ($26,000)
The Director of Finance reported that $26,000 of SDS Fund investments
are maturing August 8, 1963, and requested authority to reinvest the amount
in U. S. Treasury Bills. In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow~

Appropriation Ordinance No. 842
Provisionally Passed
~he City Manager reviewed the proposed budget for the fiscal year ending
June 30th, 1964, and Ordinance No. 842 was presented, entitled:

It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the Ordinance be provisionally adopted and August 7th, 1963 be set as
the date for public hearing and the motion Was carried by the fOllowing Aye
and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and
Commissioner Morrow; those voting No, None.
Adjournment
There being no further business to come before the Commission at this
time, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy,
that the meeting adjourn. The motion was carried by the following Aye and
