HomeMy WebLinkAbout1963-05-01 252 Boz eman , Mon tana May 1, 1963 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, May I, 1963 at 1:0v o'clock p.m. Present were Mayor Staudaner, Commissioner Sedivy, Commissioner Morrow, Minutes of the Las't regular seSSion were read and it was moved by Commis- sioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved I Acting City Manager Frysiie, City Attorney Berg and the Clerk. The following proceedings were had: as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaner, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Requests White Cane Sale and Broom Sale (Lions) It was reported the Lady Lions have requested permission to conduct a "Whi te Cane Sale" in the business district on May 4th, and the Lions Club per- mission to conduct the "Annual Broom Sale" from door to door during the period May 1st to the lOth. It was moved by Commissioner Sedivy, seconded by Commis- sioner Morrow, that permission to conduct the sales as requested be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those vo'ting No, none. Cancellation of Electrical Bond (Shane Electric) I A request from the Standard Accident Insurance CompHny thHt the Electrical Contractor's License Bond No. 9l6u93 of Thomas P. Shane, dba Shane Electric, be cancelled was presented. The Acting City Manager reported Shane Electric had ceased to operate as a business as of February 20, 1963, and that the City Building Inspector had reported the concern had now completed all work within the Ci ty which would appl~T to the bond. FOllowing the Recommenda tion of the Acting Ci ty Manager, it was moved by Commissioner Morrow, seconded by commis'" sioner Sedivy, that the release of the bond be approved effective as of May 6, 1963, and the Mayor and the Clerk of the Commission be authorized and directed to sign the company's standard form of release. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commis~ sioner Morrow and Comnissioner Sedivy; those voting No, none. New Building Facilities for the City (Peti tion) In accordance with instructions from the City Commission, the Acting City Manager presented a draft form of a petition to be circulated within the City to secure necessary Signatures of quaLified taxpayers so an election might be caLled pLacing two propositions before the voters for issuing general obiiga- I' tion bonds to provide funds for new City Building Facilities. One question to be on issuing bonds for a City Office Building and a second question to be on issuing bonds for a City Police-Fire Building. Following a discussion of the program, it was moved by Commissioner Sedivy, seconded by CommiSSioner Morrow, 253 tha t ac tion on this ma tter be deferred for one week, or more, to allow the Commissioners to review the building program in more detail. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Stdudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Sunset Hills Cemetery Code Amendmen t Proposed by Ceme ter~r Board I The written request of the Cemetery Board that the Bozeman Municipal Code be amended to establish security hours at the Sunset Hills Cemetery was pre- sented. It was moved by Commissioner Morrow, seconded by Cow~issioner Sedivy, that, due to the recent and repeated vandaiism and destruction of property witn- in the Cemetery, an emergency exists and the City Attorney assisted by the Chief of Police be instructed to prepare an emergency ordinance to provide that unauthor- ized persons who enter the Cemetery between tne hours of' one-naif (~) hour after sunset and one-half (It) hour before sunup shuil be deemed guilty of a misdemeanor. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Resolution No. 1077 F~tend City Limits (MSC Property, 320 acres) During the regUlar session of the City Commission heLd on April 3rd, 1963, the Commission reguLarly passed and adopted Commission Resolution No. lU'/l, I declaring its intention to extend the boundaries of the City limits to include 32U acres of Montana State College property. The affidavit of pubLication of the Notice was presented. Commission Resolution No. LO'I'I, entitled: COMMISSION RESOLUTION NU. 10'/7 A RESOLUTION OF THE COMMISSION OF 'l'RE Crl'Y OF BOZEMAN EXTENDING THE BOTJNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTA IN 'l'RACT OF LAND OWNED BY THE STATE OF MONTANA FOR THE USE AND BENEFI'l' OF MONTANA STATE COLLEGE, WITHIN Tm~ CUR.l:-'ORA'l'E LB~ITS OF THE CITY OF BOZEMAN. was presented. Following the recommendations of the City Attorney and the--Acting City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the resolution be passed and adopted and the motlon was carried by the fOLlowing Aye and No vote: those voting Aye belng Mayor Staudaher, Connnissioner Sedivy and Commissioner Morrow; those votlng No, none. Sanitary Sewer Trunk Line (To Serve Area North of Huffine Lane and East of 23rd Ave., and MSC Property) I The Commission was referred to its action of September 26, 1962, pertaining to the creation of a speCial improvement district for the purpose of construct- ing 8 s8ni tary sewer trunk line to serve an area commonly known as the "Westslde". Due to the recent annexation of Montana State COllege provertyand the College's request that the vroposed district be extended, the Acting City Manager requested that new boundaries for maximum participation In the project be ascertained and the City Attorney be directed to prepare a resolution of intention to create the 254: district. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the foregoing action as recommended be approved and initiated. Reports The following reports for the month of April, 1963, were presented: Building Inspector Fire Chief Librarian Police Judge Disposal P~ant Operator Ci ty-Coun ty Health Officer ( Quar'terly). After comment on the reports by the Acting City Manager, it was moved by Comrrdssioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Adjournment There being no further business to come before the Commission at this time it was moved by Commiss ioner Morrow, seconded by Commis s ioner Sedivy, tha t the mee ting ad,j ourn.
