The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, May 8, 1963 at l:OU o'clock p.m.

Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as
read and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those
voting No, none.
License and Permit Bond
Mannix Electric, Inc.
The Electrician's License and Permit bond of Mannix Electric, Inc. in the
amount of $5,OUU.UO, issued for the period ending May 26, 1964, and written by
the Western Surety Company as surety to the City of Bozeman was presented. The
instrument was approved as to form by the City Attorney, and it was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the bond be accepted
and filed and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy;
those voting No, none.

Authority to Travel
Miss Hileman (State Library ASRociation Convention)
It was reported that the State Library Association has scheduled a convention
to be heid ln Great Falis, May lUth to 12th, inclusive, and the City Manager reco-
mmended that Miss Margaret Hileman,. City Librarian, be authorized to attend the
convention and, it being in the pu}>lic interest, her expenses be paid from the
Library fund. It was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that Miss Hileman's travel be approved as recommended and the motion was
carried by the fOllowing Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Sedivy and Commissioner Morrow; those voting No, none.

Change Order No. One (1)
Due to the Milwaukee Railroad's refusal to permit the open cut method of
construction of the sanitary sewer line under its branch line track, Change Order
No. (1). to the plans and specifications of Special Improvement District No. 426
as prepared by consultant engineers Harold Hoskins and Associates, was placed
before the Commission. The City Manager reported there appeared to be no alter-

native but to concede to the Railroad's demand that the crossing be tunnelled
and sleeved at an increased cost of $l,Yti2.UO, and recommended that the order be
approved and the Water Supply and Pollution Control Agency be requested to increase
the Federal Grant for the project to meet this increased cost. It was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the change order be
approved as recommended and the Mayor and the Clerk of the Commission authorized
and directed to sign for the City. The motion was carried by the fOilowing

Emergency Ordinance No. 840
Sunset Hills Cemetery
The City Attorney, as instructed, had prepared an emergency ordinance to
establiSh security hours at the Sunset Hills Cemetery. Ordinance No. 840 was
presented, entitied:

AN ORDINANCE DECLARING THAT 'l'RE ENTRY BY ANY PERSON INTO
SUNSET HILLS CEMETERY WITHOUT WRITTEN PERMISSION OF THE
DIRECTOR OF PUBLIC SAFETY OF THE CITY OF BOZEMAN, MONTANA,
AT ANY TIME FROM ONE-HALF HOUR AFTER SUNSET TO ONE-HALF
HOUR BEFORE SUNRISE SHALL BE UN LA WFUL AND PUNISHABLE AS A
MISDElmEANOR AND DECLARING THAT AN EMERGENCY EXISTS AND
THIS ORDINANCE SHALL BECOME IMMEDIATELY EFFECTIVE UPON
THE PASSAGE AND ADOPTION BY THE COMNfISSION OF THE CITY OF
BOZEMAN, MONTANA.
The City Manager recommended that the ordinance be passed as an emergency
measure. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the City Commission does declare an emergency exists and that the ordi-
n8nce be passed and adopted to become immediately effective and tile motion was
carried by a unanimous vote. Those voting Aye being Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; those voting No, none.

It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the
reports be approved and ordered fiied and the motion was carried by the fOil.OW-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Morrow and Commissioner Sedivy; mose voting No, none.

The City Manager commented on the Ciaims and stated he had audited them and
found them to be true and iawful ciaims against ~e City of Bozeman and recom-
mended that they be approved and the Director of Finance directed to issue war-
rants in payment. After examination of the claims in detail and checlcing
against the claim register, it was moved by Commissioner Sedivy, seconded by
Commissioner Morrow, that all claims as presented be approved and motion was
carried by the following Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Sedivy and Commissioner Morrow; those voting No, None.
