HomeMy WebLinkAbout1963-03-27 232 1: Bozeman, Montana March 27, 1963 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, March 27, 1963 at 1:00 o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Connnissioner Morrow, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the I Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Comnlis" sioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Request Permission to Place Overhead Propane Tank at McClees Sheet Metal Walter Monforton and Floyd McPherson of the Montana Propane appeared to request that permission be granted to erect an above ground propane storage tank at the site of the McClees Sheet Metal located on the northeast corner of Mendenhall and North Wallace. Action was deferred until the next regular meet- ing to afford time for further consideration of the matter. Ice Removal from Street Curbs Mr. W. A. Rolfe appeared to discuss with the Commission the manner in which city equipment is used by the Street Department in removing ice from curbs. I Public Hearing Special Improvement District No. 427 This was the time and place set by Commission Resolution No. lU65 to hear protests to the creation of Special Improvement District No. 427. Affidavit of publica tion of No tice and the Clerk's Me iling Certifica te s ta ting tha t all pro" perty owners had been notified as required by law were presented. One protest representing 4.Ul% of the property within the boundaries of the proposed dist- rict was presented. The City Manager recommended that the protest filed be declared insufficient and the City Attorney instructed to prepare a resolution to create tne district. Commission Resolution No. 1066, entitled: COMMISSION RESOLUTION NO. 1066 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM1)ROVEMENT DISTRICT NO. 427 OF' THE CITY OF BOZEMAN FOR nIE PURPOSE OF CONSTRUCTING AND INSTALLING A PA VEMENT PROJECT ON NORTH TENTH AVENUE FROM BEALL STREET TO DURSTON ROAD IN SAID CITY. prepared by the City Attorney was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the protest be declared insuffi- cient and Commission Resolution No. 1066 be passed and adopted to create Special I Improvement District No. 427. The motion was carried by the fO.l1owing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. 233 Closing Purchase of Parking Lots During the regular Commission meeting he.ld March 13, 1963, it directed that options be exercised to complete the purchase of two parking .lots, and the fO.llowing claims were presented for approval: Claim No. 6U31 First National Bank, Bozeman, Montana $2,74.1.47 I (Escrow Agent K. J. Stimson and Jean McCay Stimson, Lots 13, 14, 15, 16 and 17, all in B.lock "Att of B.lack's Addition to the City of Bozeman.) C.laim No. 6U32 First Nationa.l Bank, Bozeman, Montana $1,373.18 (Escrow Agent for Trustees, Bozeman Lodge #18, AF & AM, Fract'.l. Lot 2, Lot 3 and West 19 feet of Lot 4 and east 11 feet of Lot 4, all of Lot 5, in B.lock "An of B.lBCk's Addition.) The City Manager reported the c.1aims had been prepared by the Director of Finance and, in concurrence with his recommendation, further recommended that the c.laims be approved and the Director of Finance directed to issue warrants in payment. It was moved by Commissioner Sedivy, seconded by Commis- sioner Morrow, that these claims for final payments as presented be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Paving & Storm Drainage One (1) Block on Arthur (Grand to Third) As the one block on Arthur Street between Grand and Third Avenues is the only unimproved block on Arthur Street in this area, it was deemed fitting that a special improvement district be formed to accomplish the construction of paving and drainage in the block. It was moved by Commissioner Sedivy, seconded by commissioner Morrow, that the City Attorney be prOVided with the necessary data and instructed to prepare a resolution of intention to create the district. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. I Extend City Limits to the West and South to Include MSC Property (320 Acres) The Acting President of Montana State College, as competent authority and as authorized and directed by the State Board of Education, has certified to the City a request for the annexation of some 32u acres of Montana State College .'. The City Manager advised the Commission that the extension of the City limits to incorporate the aforementioned land is essential to permit the Co~lege to obtain additional sewerage facilities and to participate in the construction and use of the proposed Westside sewer project. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the City Attorney be instructed to prepare the appropria te reso1u tion to accomplish the annexa tion of the area and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. VFW Poppy Sale May 18, 1963 A request from the Veterans of Foreign Wars to designate Saturday, May H3th, as "Poppy Day" and permit sa~e of the poppies on that day was read. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Request Circus Walk-up of Animals (Ring1ing-Barnum & Baily) I A request for permission to stage an animal circus wa~k-up from the Northern Pacific Depot to the Fieldhouse with a po~ice escort, in connection wlth the showing of the Ring~ing-Barnum & Bally Circus, July lOth and ~l th, was presented. It was moved by Commlssioner Morrow, seconded by Commissioner SediVY, that the request be granted and licensing of the show be in accordance with the Bozeman MunicipaL Code and in the same manner as in 196L. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow ti.nd Commissioner Sedivy; those voting No, none. Sale of Water Refunding Donds $1,010,000 - April 15th (Special Meeting) I The clerk of the City Commission presented a proposed form of notice of sale of $l,Olu,UOO Water System Refunding Revenue Bonds, Series B, calling for oral or wri tten bids for the purchase of such bonds to be submi tted to the City Commission at a special meeting to be heLd Monday, April 10, 1963, at l:UO o'c.Lock P.M. The form of notice was examined and found satisfactory. Comnissioner Sedivy moved, seconded by Commissioner Morrow, that the Clerk of the City Commission be directed to publish the notice forthwith in the Bozeman Daily Chronicle, at Bozeman, Montana, and in The Bond Buyer, at New York City, New York. The motion was carried by the following vote: those voting Aye be- ing Mayor Staudaher, Commissioner Sedivy and Commissioner Morrowp tnose voting No, none. Fire Department to Burn Unsuitable Residence at 305 N. Ida. (Training) It was reported that because of recent fire damage, the house located at 305 North Ida is unsui 'ta b.ie for oc cupanc y and tho. t .J. Vv. Ro th, the owner of the property, has indicated his desire for the Fire Department to permit and assist him in burning the house and, at the same time, afford the _depart- 236 ment an opportunity to conduct a fire-fighting cloass. It was moved by Commis- sioner Morrow, seconded by commissioner Sedivy, that it being in the public interest, subject to Mr. Roth's obtaining permission from residents of the strict supervision of the City Fire Department, and that Mr. Roth make formal I area, securing adaquate insurance coverage, conducting the burning under the application to the City for burning the house, that permission be granted to proceed as stipulated. ~be motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow, and Commissioner Sedivy; those voting No, none.
