HomeMy WebLinkAbout1962-10-24 164 Bozeman, Montana Oc tober 24, 1962 The Commission of the City of Bozeman met in regular session in the Commis- sion Room, City Hall Bui~ding, Wednesday, October 24th, 1962 at 1:00 orclock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, Assrt. City Manager Fryslie, Acting City Attorney Angel I and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vo te : those voting Aye being Mayor Staudaher, commissioner Sedivy and Commissioner Morrow; those voting No, none. Bids for S.I.D., Nors. 425 and 426 -- East & South Trunk Lines This was the time and place set for the opening of bids for construction of sewer trunk lines in Special Improvement District No.rs 425 and 426. The affidavi ts of publica tion of "Notice to Bidders'" were presented. All bidders were informed by the City Manager that the awarding of the contracts would be contingent upon the saie of the bonds of each individual district, the securing of adequate rights of way to lay the lines, and approval of "Part B-Suppiemental Project Information" of the City's acceptance of the Federal grant of funds by the Water Pollution I Control Agency of the U.S. Public Health Service. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids on Special Improvement District No. 425 be opened and read and the motion was carried by the following A"J6 and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. P=l U) U) -< H H H 166 Following the recommendation of the City Manager, the bids were referred to the engineering consultant firm retained by the City for the districts and the City Engineer to check the bids in detail, to prepare the final tabUlations and to ascertain the lowest and best bids for the construction of the improvements for each district. I Parking Meters -- Purchase The City Manager requested that in order to continue the Cityrs program to replace the older model parking meters, he be authorized to purchase 24 new meters from the Rockwell Company at a net cost of $41.33. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the purchase of the new parking meters as requested be authorized and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Authority to Travel -- Meetings of the Executive and Legislative Committees of Municipal League It was reported that meetings of the Executive and Legislative Committees of the Montana Municipal League are SCheduled to be held in Great Falls, Octover 25th. The City Manager requested that Mayor Staudaher and he, as members of the committees, be authorized to attend the meetings and that, it being in the public interest, the travel expenses incurred be paid from the General fund. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t, the national Cuban crisis permitting, this authorization for travel as requested be t granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Authority to Travel -- FBI Conference It was reported that the Federal Bureau of Investigation has scheduled a conference for police officers to be held in Great Falls, October 25th, and the City Manager requested that Chief of Police Saunders be authorized to attend the conference. It was moved by Commissioner Morrow, seconded by Commissioner Sedi vy, tha t , the national Cuban crisis permitting, the request be gra.nted and the t, it being in the public interest, the travel expenses incurred by paid from the General fund. The motion was carried by the following Aye and No vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and Commis- sioner Sedivy; those voting No, none. Authority to Travel -_. Meeting of State Fire Marshall It was reported that the State Fire Marshall has scheduled a meeting to I discuss matters pertaining to his office and city fire departments of Montana. The City Manager concurred in the recommendation of the Fire Chief that Assrt. Fire Chief Huber be authorized to attend the meeting. It was moved by Connnis- sioner Sedivy, seconded by Commissioner Morrow, tha t, the national Cuban crisis permitting, that Assrt. Fire Chief Huber be delegated to attend the meeting and tha t , it being in the public in teres t, the expenses incurred be paid from the 167 General fund. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Bond & Contract, S.I.D., No. 424 -- (Pavement, Schedu Ie No.2) The contract documents for construction of the Pavement improvement, I (Schedule No. Two), of Special Improvement District No. 424, as awarded to Long Construction Company, were presented." The contract and bond were approved as to form by Acting Ci ty Attorney Angel and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Mayor and the Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Applications for Abatement of Garbage Assessments -- (Denied) Applications for abatement of the 1962, garbage assessment filed by Paul K. Dudley, 825 So. Black Avenue, and M. P. LaPalme, 8U3 North Black Avenue, were placed before the Commission. The City Manager and the Assrt. City Manager commented on the status of the applications and recommended that in accordance with the provisions of Chapter 5.20 of the Bozeman Municipal Code, the aba te- ments must necessarily be denied. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the abatements be denied, however, tha t , in the t event adjustments are deemed proper, they be considered. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commis- sioner Sedivy and Commissioner Morrow; those voting No, none. Vernon S. Sande ...- Complaint as to Use of Land for Improper Dumping Mr. Vernon S. Sande appeared before the Commission to register his complaint that an area adjacent to the Milwaukee Railroad and the Southwest corner of his property was now being used for improper dumping purposes. After discussion of this situation and assurances made by the City Commission that immediate steps would be taken to correct this dumping condition, Mr. Sande stated that such action would be satisfactory to him and right-of-way negotiation could continue for granting an easement for the construction of the sanitary trunk sewer line across his property to serve Special Improvement District No. 425. Sheriff's Posse -- Sound Truck on City Streets It was reported the local Sheriff's Posse had requested permission to use a sound truck on City streets to advertise the rodeo it is sponsoring October 24-27. The City Manager proposed that the organization be cautioned to use the I unit with discretion as to the volume of sound and recommended the request be granted. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request be granted as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. 168 Report of Director of Finance The September report of the Director of Finance was presented. The City Manager commented on the report and recommended that it be approved. It was moved by Commissioner Sedivy, seconded by commissioner Morrow, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and I Commissioner Morrow; those voting No, none. SID No.' s 425 and 426 -... Award of Contracts As direc ted, Mr. Dean and City Engineer 1iquin had checked the extensions of all bids submitted, prepared the final tabulations and recommended that Haggerty-Messmer Company, Bozeman, Montana, be awarded the contract for the construction of the sewer trunk line in Special Improvement District No. 425, the firmrs bid of $72,5.L9.80 under Bid Group No.2, being the lowest and best bid submitted. It was moved by Commissioner Morrow, seconded by Commissioner Sedi vy, tha t, subject to the sale of the bonds of the district, the securing of adequate rights of way to .lay the lines and approval of "Part B-Supplemental projec t Informa tion" of the Ci tyr s acceptance of the Federal grant of funds by the Water Pollution Control Agency of the U.S. Public Health Service, Haggerty- - Messmer Company be awarded the contract for the construction in Special Improve- mend District No. 425, and the bid security of the unsuccessful bidders be returned. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; I those voting No, none. Mr. Dean and City Engineer Liquin, also, recommended that Haggerty-Messmer Company, Bozeman, Montana, be awarded the contract for the construction of the sewer tTIlnk line in Special Improvement District No. 426, the firmrs bid of $53,294.70 under Bid Group No.2, being the lowest and best bid submitted. It was moved by Commissioner Sedivy, seconded by commissioner Morrow, tha t , sub- ject to the sa.Le of the bonds of the district, the securing of adequate rights of way to lay the lines and approva.L of "Part B-Supplementa1 Project Information" of the City's acceptance of the Federal grant of funds by the Water Pollution Control Agency of the U.S. Public Health Service, Haggerty-Messmer Company be awarded the contract for the construction in Special Improvement District No. 426, and the bid security of the unsuccessful bidders be returned. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. The engineers then referred the Commission to the alternates incorporated I in the plans and specifications for the districts and recommended ~he use of Asbestor-Cernent Pipe due to water and soil conditions. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the use of Asbestos-Cement Pipe be specified for the construction of the trunk lines in Special Improvement District No. 425, as set forth in Alternate Nors. One ( 1) and Two (2) under Bid Group Number Two (2), and the motion was carried 169 by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the use of Asbestos-Cement Pipe be specified for the construction of the trunk lines in Special Improvement District No. 426, as set forth in Alternate No. Three I (3) under Bid Group Number Two (2), and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Report -- Attendance at Building Officials Conference, San Diego, California City Building Inspector Barrick reported on his attendance at the Building Officials Conference conducted at San Diego, California, October 1st thru the 5th. His report consisted of a resume of the program, its attendance and the values derived by the City in having representatives at such meetings. He was commended for his report which was approved. Adjournment -- There being no further business to come before the Commlssion at this time it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the meeting adjourn.
