The Commission of the City Qf Bozeman met "in regular session 1n the
Commission Room, City Hall Building, We~nesday, October 31. 1962 at 1:00
o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commie- I

sioner Morrow, City Manager Cutting, Ass't. City Manager Fryslle, City
Attorney Berg and the Clerk.
Tbe following proceedings were had:
Minutes of the last regular session were read and it was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be
approved as read and the motion was oarried by the fOllowing Aye and No
vo te : those voting Aye being Mayor Staudaher, commissioner Sedivy and
Commissioner Morrow; those voting No, none.

was moved by Commissioner Morrow, seconded by Commissioner Sedivy, tha t the
minu tes be approved 'as read and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and
Commissioner Sedivy; those voting No, none.
Sewer Improvement Projeots -- SID No's. 425 and 426, Right of way Easements
Right-of-way easements for the sewer trunk lines of SID No's. 425 and 426
bearing the signatures of the property owners were presented as fOl.lows: I

The City Manager stated the easemen ts were drawn on the standard form
which had been used for like transactions ot the City and reoommended that
the easements be accepted and approved. The documen ts were a pproved as to
form by the City Attorney and it was moved by Commissioner Sedivy, seconded
by Commissioner Morrow, that the easements be accepted and approved and the
Mayor and the Clerk of the Commission be authorized and directed to sign the
easements for the City of Bozeman and the motion was carried by the following
Aye and No vote: those voting Aye being Jlayor Staudaher, Commissioner Sedivy
and Commissioner Morrow; those voting No, none.

Poli tical Parad'e -- Republican Party, Sat., Nov. 3rd, 5:00 P.M. . ,
It was reported tha t the local committee of the Republican party had I
requested permission to stage a parade on Main street at 5:00 O'Clock p.m.
on November 3rd, and it was moved by Commissioner Sedivy, seconded by Commis-
sioner Morrow, that permission be granted and the motion was carried by the .
fOllowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Sedivy and Commissioner Morrow; those voting No, none.
SID No. 425 -- Submission of "Part Bit Offer & Aoceptance Federal Grant for
Trunk Sewer Line

The Commission was referred to its Resolution No. lu43A, which authorized
Mayor Staudaher to accept the offer of a Federal grant to p$rticipate in the
cons truc tion of the sewer trunk line to serve the property 1na.orpora ted in special
Improvement District No. 425. "Part B-Supplementa1 Project Information" of the
City's acceptance of the Federal grant ot funds was placed before the Commission

Agency. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the document be approved and submitted and the Mayor and the Clerk be author-
ized and directed to sign for the City and the motion was carried by the folLOW-

and Commissioner Morrow; those voting No, none.
SID No. 426 -- Submission of "Part Bn Offer & Acceptance Federal Grant for
Trunk Sewer Line
The Commission was referred to its Resolution No. 1056, which authorized
Mayor Staudaher to accept the offer of a Federal grant to participate in the
construction of the sewer trunk line to serVe the property incorporated in Spe-
cial Improvement District No. 426. "Part a-Supplemental Project Information" of
the City's acceptance of the Federal grant of funds was placed before the COImlla-
sion for approval of the form prior to its submission to the Water Pollution
Control Agency. It was moved by Commissioner Morrow, seconded by Commissioner
Sedivy, that the dOCUMent be approved and submitted and the Mayor and the Clerk
I be authorized and directed to sign for the City and the motion was carried by
the following Aye and No vote: those voting Aye being Kayor Staudaher, Commis-
sioner Morrow and Commissioner Sedivy; those voting No, none.
Petition for Paving South Tracy & One Block on Cleveland
A petition requesting that a Speoial Improvement District be oreated for the
purpose of paving Cleveland Stree t from Willson to Traoy Avenues and Traoy from a
point 15U feet north of Cleveland to a point in line with the south line of Spring
Deil Addition was placed before the Commission. Following the recommendation of
the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that action on the matter be deferred to permit a study as to the feasi-
bility of extending the l~its of the proposal to include the remainder of South
Tracy Avenue and other streets in the area. The motion was oarried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy

An easement to prOVide 8 crossing of the Milwaukee track for Garfield Street
I was placed before the Commission. In concurrence with the City Manager and the
City Attorney, it was moved by Commissioner Morrow, seconded by Commissioner
. Sedivy, that action on the matter be tabled to permit further study of the legal-
ity of the easement provisions. The motion was oarried by the following Aye and
No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow andCommis-
sioner Sedivy; those voting No, none.

Resolution No. 1057 -.. Intention to Vacate a Portion of South Tracy Avenue
A resolution decJ.aring it to be the intention ot the Coaunission to vacate
that portion of South Tracy Avenue within the University Subdivision tram the
South line of 'East GarfieJ.d Street to the south.-.line of the University Sub-

A RESOLUTION OF THE CUMMISSION OF '!HE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE
ALL OF THAT PORTION OF SOUTH TRACY A VENUE FROM THE SOUTH LINE
OF EAST GARFIELD STREET TO THE SOUTH LINE OF THE UNIVERSITY
SUBDIVISION IN THE CITY OF BOZEMAN, MONTANA.
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that
the resolution be passed and adopted and November 7, 1962 be set as the date tor
public hearing of any objection to the action. The mo tion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, commissioner
Sedivy and Commissioner Morrow; those voting ~o, none.
Fund Drives & House..to-house Canvassing
The City Manager and Chietof Police Saunde.rs reported to the Commission
that difficulties are steadily increasing due to unathorized house-to-house
canvasses and their means ot identifioation. The Ci.ty Manager WIlS instruoted to
notify b)" letter the organizations within the City tnat for proper clearance of
their projects, they should first contaot the City before placlng~elr pr~ma
in motion. I
SIn No. 425 ..- Righ~ot-way (Sande Property)
Tbe Commission was intormed that a proper right-ot-way has not been secured
to permit construction of the trunK sewer line through the property ot Vernon
S. &ande for the improvements to be provided tor Special lmprovement District
No. 425. It was moved by Commissioner Sedivy, seconded by CommisslonerMorrow,
that the City Attorney be directed to negotiate with Mr. Sande in regard to his
granting an easement to provide the right-at-way. The motion was carried by the

following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Sedivy and Commissioner Morrow; those voting No, none.
Adjournment
There being no further business to come before the Commission at this
time it was moved by Comm:tssloner Morrow, seconded by Commissioner Sedivy, that
the meeting adjourn. The motion was carried by the to1lowing Aye and No vote:
