HomeMy WebLinkAbout1962-11-21 182 Bozeman, Mon tana November 21, 1962 The Commission of the City of Bozeman met 1n regular session in the Commission Room, City Hall Building, Wednesday, November 21, 1962 at 1:00 otolook p.m. Present were Mayor Staudaher, Commissioner Sedivy, City Manager Cutting, Asstt. City Manager Fryslie, City Attorney Berg and the Clerk. I The following prooeedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded by Mayor Staudaher, that the minutes as read and correoted be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Sedivy; those voting No, none. Commissioner Morrow's Absence -- Approved In oomplianoe with Chapter 2.UH of the Bozeman Municipal Oode, it was moved by Mayor Staudaher, seoonded by Commissioner Sedivy, that Commissioner Morrow's absence from the meeting be considered as authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Sedivy; thos e vo ting No, none. Authority to Collect Clothing for Needy Boys -- Bozeman Firefighters Assoc. As a means of identifying its program, the Bozeman Firefighters Assooiation requested authorization to stage a drive to collect clothing to be distributed to needy youngsters both looally and at the Yellowstone Bo18 I Ranoh where the assooiation is sponsoring a boy. It was moved by CODDllissioner Sedivy, seoonded by Mayor Staudaher, that authorization to oonduct the program be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Sedivy; those voting No, none. Fulfillment of Park Requirements -- Grafts First Subdivision On April 26, 1961, the City approved and accepted the final plat of Grafts First Subdivision. The City Manager reported that through oversight the min- ute entry of that action did not record provisions made by the platter to pro- vide land for park purposes as required. The Commission was also referred to a letter from the platter and to a Bargain and Sale Deed to transfer title to the City the following tract offered to fulfill this requirement: Lots One (1) Two (2), Three (3), Seventeen (17) and Eighteen (18) of Block A, Meadowlark Subdivision. It was moved by Mayor Staudaher, seconded by Commissioner Sedivy, that this deed be accepted as fulfilling the park requirement ot Grafts First Subdivision and the motion was carried by the following Aye and No vote: I those voting Aye being Mayor Staudaher and Commissioner Morrow; those voting No, none. SIn No. 425 -... Easement (Right-of-way across Sande Property) The Commission was referred to its action ot November 14th, 1962, which pertained to the securing of a proper right-of-way aoross the property of 183 Vernon S. Sande to permit the construction of the improvements for Special Improvement District No. 425. As directed, the City Attorney presented an I easement agreement to secure the aforementioned right-of-way and subject to the deletion of the following: (and in the event that the same cannot be so replaced the Grantee will pay to the Grantor!- the reasonable value of the damage done by it to the same.), ae the phrase appeared on page number two (2) of the agreement, it was moved by Commissioner Sedivy, seconded by Mayor Staudaher, that the C1 ty approve the agreement and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Commissioner Sedivy; those voting No, none. Reports The tollowing reports were presented as follows: Water Collector Ceme tery The City Manager commented on the reports and it was moved by Commis- sioner Sedivy, seconded by Mayor Staudaher, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher and Co~ssloner Sedivy; those voting I No, none. Adjournment There being no further business to come before the Commission at this time it was moved by Commissioner SediVY, seconded by Mayor Staudaher, that the meeting adjourn.
