The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, November 28, 1962 at 1:00 orclock p.m.
Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City
Manager Cutting, Asstt. City Manager Fryslie, City Attorney Berg and the Clerk. I
The following prooeedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as
read and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Staudaner, Commissioner Sedivy and Commissioner Morrow; those
voting No, none.
Bond & Contract -- S. I .D ., No. 425 -- Haggerty-Messmer
The contract documents for construction of Special Improvement District
No. 425, as awarded to Haggerty-Messmer Company were presented. The contract
and bond were approved as to form by the City Attorney and it was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, tha t the Ma yor and the
Clerk of the Commission be authorized to sign the contract for the City of
Bozeman and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy;
those voting No, none. I
Bond & Contract -- S. I.D., No. 426 -- Haggerty-Messmer
The contract documents for construction of Special Improvement District
No. 426, as awarded to Haggerty-Messmer Company were presented. The contract
and bond were approved as to form by the City Attorney and it was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that the Mayor and the
Clerk of the Commission be authorized to sign the contract for the City of
Bozeman and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow;
those voting No, none.
Claim for Right-of-way -- Assumed Damages, $1,500.00 -- Sande Property
(SID No. 425)
The City Manager referred the Commission to its action during the regular
sessions held November 14th, and November 21st, 1962, which pertained to the
securing of a proper right-of-way easement through the Sande property to permit
the construction of the improvements for Special Improvement District No. 425.
Claim No. 5002, in the amount of $1,500 in favor of Vernon S. Sande, et ai, pre-
pared as stipulated in the easement agreement, was placed before the Commission. I
The City Manager recommended that the claim be approved and the Director of
Finance directed to issue a warrant in payment. It was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the claim be approved and the
Director of Finance be authorized and directed to issue a warrant in the amount

of $l,500.vO, in payment. The motion was carried by the following Aye and No
vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and

Claim in Payment for Estimate No.1 -- SID No. 424 -- J. W. Merz ($16,915.27)
A claim in the amount of $16,915.27, which represented payment due J. W. Merz,
the contractor on Special Improvement District No. 424, for payment of estimate
No. One (i), was placed before the Commission. The City Manager reported that
I the amount was calculated on the portion of the contract completed to and including
October 26, 1962, and that the estimate had been prepared and recommended for pay~
ment by Harold Hoskins & Associates, consultant engineers for the district. It
was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the claim
be approved subject to final sale of the bonds of the district, and the Director
of Finance directed to issue a warrant in payment. The motion was carried by the
folloWing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Sedivy and Commissioner Morrow; those voting No, none.
Fraternity House Proposal ...... Pi Kappa Alpha, Proposed Purchase of Haeckel
House, Grand & Cleveland
The City Manager presented a sketch submitted by the iocal chapter of the
Pi Kappa Alpha Fraternity to iLlustrate its plan to provide oft-street parking
space that would be required of the fraternity in the event it purchased the
property known 8S the Haecke1 House located at the corner of Grand and Cleveland
Avenues. The City Manager suggested that, in view of protests already received,
and because off-street parking requirements seem to be the principle problem
I which involves the Cltyts Zoning Ordinance, the matter be referred to the Board
provide
of Adjustment to V;~ a public hearing and take such action as the Board deem
in the best public interest. It was moved by Commissioner Morrow, seconded by
,
Commissioner Sedivy, that the matter be referred to the Board of Adjustment as
recommended and the normal fee required for appeals to the Board, in this
,
instance, be waived. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner
Sedivy; those voting No, none.
Report of Civil De~ense Meeting -- Chief of Police Saunders
Chief of Police Saunders reported on his attendance at the Civil Defense
Meeting he attended at Butte, November 19th. His report consisted of a resume
of the proceedings of the meeting, its attendance, and his comment that the
Gallatin County Board of Commissioners had gone on record that Gallatin County
would give the program its full support. Chief Saunders, also, emphasized that
a Ninety-day Accelerated Program to streamline various procedures of the program
was now in progress.
I The members of the Commission commended Mr. Saunders on the completeness
of his report, and it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that the report be approved. The motion was carried by the following
Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy
and Commissioner Morrow; those voting No, none.

Approval of Civic Project -- Lions Club .. - Roadside Tourist Picnic
Facilities
A request submitted by the looal Lions Club that it be granted permission
to place picnic benches along the North Seventh Avenue area on U.S. Highway
No. lU, coming into Bozeman from the west was p~aced before the Commission.
After discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that permission to place the benches as requested be granted as a
temporary arrangement, subject to proper maintenanoe of the area, and final
approval of the plan by the Montana State Highway Department. The motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.

Resolution No. 1059 authorizing the issuance of bonds ot Special Improve- I

It was moved by Commissioner Morrow, seconded by commissioner SediVY,
that the resolution be passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Morrow and Commissioner SediVY; those voting No, none. .
Adjournment
There being no further business to come before the Commission at this
time it was moved by Commissioner Sedivy, seoonded by Commissioner Morrow,
that the meeting adjourn. The motion was carried by the following Aye and No
