The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, May 16th, 1962 at 1:00 o'clock p.m.
I Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City
Manager Cutting, City Attorney Berg and the Clerk.
The fOllowing proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.
Discussion -- Extension of City Limits to South
During the Commission meeting held May 9th, 1962, the Commission, under the
provisions of Section ll-4U3, R.C.M., 1947, directed the City Attorney to institute
the proper procedure to accomplish the annexation of approximatelY 206 acres of
land lying east of Third Avenue and south of the south City limits. Donald Weaver,
Norman Wallin and Ralph Aaker, owners of portions of the land to be included in
the action, appeared and discussed with the Commission and other City Officials
matters pertaining to their properties and various provisions of the Bozeman Muni-
I cipal Code as they apply to land now incorporated or to be incorporated within the
corporate limits of the City of Bozeman.
Extension of City Limits to the West
During the Commission meeting of May 9th, 1962, the Commission delayed action
on extending the City limits to annex some 300 acres of unplatted land in an area
lying west and northwest of the present City limits to permit a further study of
boundaries of the proposed area. The Commission was again referred to the plat
showing the area proposed which had been approved and recommended for annexation
by the Bozeman City-County Planning Board at its meeting of April 24th, 1962. It
was reported that letters of inquiry had been mailed to resident property owners
in the immediate area under study who had not indicated their attitude regarding
the proposed action, in an attempt to ascertain if any of these additional property
owners would be interested in being included in the annexation action and thus
accomplish more regular boundaries. However, very little response to the letters
of inquiry had been received. A group of interested resident freeholders in the
immediate area of the proposed annexation appeared and discussed the matter with
I the Commission. All interested persons present at the meeting were invited to
express their opinions in regard to the proposed action. The City Manager, after
stating specific reasons for it being to the best interests of the City of Bozeman
and in the public interest generally, recommended that action be initiated to annex
those areas approved for annexation by the Bozeman City-County Planning Board and
additional areas indicated on the aforementioned plat as follows:

( 1) ~ the area in Section Eleven (ll) lying east of the
west line of the EtEt of Section Eleven (11), T2S, R5E,
M.P.M.,
(2 ) That area bounded on the east by Eleventh Avenue, on the
west by South Fifteenth Avenue extended, on the south by
the present City limits line lying approximately Ninety I
(9U) feet north of West Curtiss Street and on the north
by U.S. Highway No. 191 and West Main Street, and
(3 ) !1! the area lying east of the west line of Section
One (1), T2S, R5E, M.P.M., bounded on the north by the
extension of the north boundary lines of the Simpson
and Nelson properties to the present City limits and
bounded on the south by Durston Road.
Further discussion of the matter followed and, after further presenta-
tions by property owners present, it was moved by Commissioner Sedivy, seconded
by Commissioner Morrow, that the City Attorney be instructed to proceed under
the provisions of Section 11-4u3, R.C.M., 1947, and the applicable provisions
of the Bozeman Municipal Code to institute the proper procedure to accomplish
the annextion to the City of Bozeman of the area as approved and recommended
for annexation by the Bozeman City-County Planning Board at its meeting of
April 24, 1962. The motion was carried by the fOllowing Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner
Morrow; those voting No, none.
Ptition Complaint -- Livestock Barns & Corrals on North Rouse Ave.
The Commission was referred to the petition complaint, filed May 9, 1962, I
which Bileged that unsightly and unheaithy conditions exist in the neighbor-
hood of rerkins Place because of the existence of livestock barns and corrals
in the area. The City Manager presented written reports of investigations of
the matter conducted by the Chiefs of the Fire and Police Departments and by
the County Health Officer which stated each offender in the area had been noti-
fied by registered letter to correct the unsanitary conditions which were found
to exist. The City Manager reported that the foregoing information would be
conveyed to the petitioner residents of the area.

The City Manager commented on the reports and recommended their approval.
It was moved by Commissioner SediVY, seconded by Commissioner Morrow, tha t the
reports be approved and ordered filed and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Sedivy and Commissioner Morrow; those voting No, none. I
Adjournment
There being no further business to come before the Commission at this
time it was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the meeting adjourn and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and
Commissioner Morrow; those voting No, none.
